Chad Daybell, the husband of a woman whose children have been missing since September, appeared in court on Wednesday after two sets of human remains were found on his property.During Wednesday's court appearance, prosecutor Rob Wood said the remains were those of 7-year-old Joshua "JJ" Vallow and 17-year-old Tylee Ryan, both of whom have been missing since September.Kay Woodcock, JJ's grandmother, also confirmed to East Idaho News that one set of the remains are those of her grandson's.Police have not yet publicly confirmed the identity of the remains.Daybell faces two counts of evidence destruction, alteration or concealment. His bail was set at million. Should Daybell make bail, he will be required to stay in certain parts of Idaho and will wear an ankle monitor. He also cannot have contact with the families of the victims. Daybell was arrested Tuesday shortly after police served a search warrant on his home in Idaho. Two criminal complaints allege Daybell willfully concealed or aided and abetted in the willful concealment of human remains, "knowing that said human remains were about to be produced, used and/or discovered as evidence in a felony proceeding, inquiry and/or investigation authorized by law, with the intent to prevent it from being so produced, used and/or discovered."Daybell is married to Lori Vallow, the mother of JJ and Tylee. She was arrested in Hawaii in connection with her children's disappearance on Feb. 20 and was extradited back to Idaho. She remained jailed despite several attempts to lower her bond.JJ and Tylee went missing in September, shortly after Daybell and Vallow married. Daybell's former wife, Tammy, died of what was believed to be natural causes shortly before Daybell and Vallow married. CARLSBAD (CNS) -- A state appellate court panel reversed the molestation conviction Friday for a former Carlsbad military boarding school administrator who was tried twice on allegations that he molested a cadet at the Army and Navy Academy.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison for the conviction.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial.The panel ruled Friday that Barton's trial may very well have concluded differently had the juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged.The convictions came in Barton's second trial.In his first trial, almost two years before , a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on those charges. 1908

(KGTV) - A brush fire broke out in Carlsbad Friday morning along busy Palomar Airport Road.The fire started about 11:15 a.m. and sent a plume of smoke above the area near Palomar Oaks Way, between Aviara Parkway and El Camino Real. Flames were contained to about five acres by 1 p.m. They appeared to be confined to eucalyptus trees east of The Crossings golf course and near office buildings.Carlsbad Police reported on twitter they briefly evacuated businesses on Dryden Place about noon. The evacuation was lifted about 20 minutes later. There was no word on what caused the fire.Westbound traffic on Palomar Airport Road was stopped at Camino Vida Roble.Check traffic 696
CARLSBAD, Calif. (KGTV) - A woman was stabbed in the parking lot of the Carlsbad Costco Friday evening, police said. Officers arrived at the store at 951 Palomar Airport Road east of Interstate 5 just before 3 p.m. They found the victim in serious condition with several stab wounds.The suspect, 62-year-old Charles Higgins, left the scene before police arrived. He was arrested later in Temecula with the help of Murrieta Police, the U.S. Border Patrol, and the Riverside County Sheriff's Department.Police say the victim and suspect knew each other and this was not a random act. Carnival Cruise Line announced Thursday that most of its remaining US-based cruises for 2020 have been canceled due to coronavirus concerns.The cruise line canceled all cruises originating from US ports except for those leaving Miami and Port Carnival during November and December. Carnival said Thursday that it’s possible all remaining cruises in the US will be canceled amid the pandemic.“As we have said throughout this pause, our return to operations will be gradual and phased in.
