SAN DIEGO (KGTV) - The family of a mother and daughter killed by a YouTuber in a wrong-way crash on Interstate 805 filed a lawsuit this week against the teenager’s estate, the City of San Diego, and the County of San Diego. Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family’s SUV, which burst into flames. In their lawsuit, Aileen’s father Miguel Pizarro and son Dominic Pizarro cited the County and City for negligence resulting in death. The lawsuit cites an incident the day before the crash, during which the San Diego County Psychiatric Emergency Response Team responded to a call claiming Heitmann was “screaming, paranoid, and delusional”. A psychiatrist, Dr. Mary Rusher, told police she had evaluated Heitmann and he was “a danger to himself and to others and must be immediately detained on a California Welfare & Institutions Code 5150 hold,” the suit stated. Rusher also told a police dispatcher Heitmann had displayed manic symptoms and appeared paranoid, delusional, out of control, and threatened to harm his mother in preceding days, according to the court document. “Police left the home without any evaluation of Trevor’s condition, or notifying PERT, if they were not part of same (PERT),” the lawsuit says. The suit claims the police officers were not exercising their authority to place Heitmann on a 5150 hold in accordance with the law. While he was descending something happened, he had a heart attack I'm not sure," said Wingen.Joe's two sons, Jo Jo and Riley, now moving to Lake Elsinore to live with their mom, while grieving the loss of their father."Jo Jo, it's hitting him hard, he's 14... Riley's handling it well," Wingen said. He said the family created a Gofundme to help ease some of the hardship and support the boys' future."Jo Jo is going to get braces... We're going to put some of it in a college fund for when they hit 18," he said.Riley created a memorial video showing how much they idolized their dad, remembering jam sessions and adventures. SAN DIEGO (KGTV) - The California Department of Alcohol Beverage Control (ABC) made changes making it easier for businesses to sell alcohol.This week, the agency made major changes allowing restaurants to sell beer, wine and pre-mixed drinks or cocktails for pick-up or delivery as long as it is sold with food and has a secured top.While the changes will help many business owners, some San Diego bar owners say the ABC needs to take a look at other parts of the law as well."I know my seven employees are hurting, and I am too," said Tony Raso of Bar Sin Nombre.Raso said when the statewide order came down to close, he did. He has bar food he can sell, but where his problem comes in is with the beer that's already on tap."My struggle has been with all of the draft beer," he said. "We're primarily a draft house, and most of my money is in draft inventory."According to the ABC's website, restaurants "selling beer, wine, and pre-mixed drinks or cocktails for consumption off the licensed premises may do so when sold in conjunction with meals prepared for pick-up or delivery. Any such alcoholic beverages must be packaged in a container with a secure lid or cap and in a manner designed to prevent consumption without removal of the lid or cap."Raso said while he appreciates the relaxed restrictions, he's still sitting on at least ,000 in kegs he can't sell."Allow us to repackage the beer from the taps," Raso said. SAN DIEGO (KGTV) — The family of a Navy sailor nearly killed in Syria is starting the new year with one less challenge.Over a year ago Navy EOD Tech Kenton Stacy was left paralyzed after an IED explosion. As Stacy was recovering in San Diego, renters were destroying the family’s Virginia home. “Just with everything we’re going through, it added stress. I just couldn’t believe how someone could damage our home and be okay with it,” said Kenton’s wife Lindsey.The home reeked of cigarettes, and the carpet, walls, and blinds were destroyed. When the EOD community in Virginia learned what happened in November they began to make repairs on the home.Julie Fish, a real estate agent with Signature Realty Select, also stepped in to help, taking over as the realtor.After reaching out for more help, people around the country offered money, time, services and resources. “These guys are...it’s like a brotherhood, there’s nothing they wouldn’t do for one another, and I like to think the wives are the same way,” said Fish, whose husband is also a Navy EOD Tech.
