San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. Former City Councilman Carl DeMaio, a major proponent of Prop B, said he would seek to defend the measure in court. 1722

SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. He said if a church is impacted by blanket rules for an area, they would likely not win in court. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

Dr. Chris Warren is an Assistant Professor of Digital Composition and Sound Design at San Diego State University and said “Echo Thief” started about ten years ago and is a project he’s been growing ever since. He’s been traveling around North America and using an acoustic measurement tool to gather and capture sound in different types of acoustic environments. His personal addition to the recording field is creating a way to capture sound in noisy environments. Typically, the reverb of a space can only be captured when it’s silent, like in a church. However, he has created a way do it in a loud area, like capturing the sound of being under a bridge even if there are cars driving by. He’s been using the library and plug-in with his audio production students. Then Kayla Gautereaux, a former SDSU student who is now on the faculty at the New England Conservatory, came to him and asked the audio pro if there would be a way for musicians to use his tool for their practice. Warren then created an easy-to-use website for anyone to play music or sing, and have it sound like they’re in a variety of locations. “We were able to take the sounds from around North America, a bunch of fascinating acoustic spaces, and make reverberators out them so people can virtually perform in these spaces,” he said. Gautereaux said she can now sit in her living room and sing, but it sounds like she’s somewhere else. “It feels like you’re there not just because the app has a picture there, but because you can hear the response of your voice or whatever instrument you play into that space,” she said. She also added that the space a musician performs inside is just as important as an instrument or vocals, so this is a welcome addition to the music world. 1873

  

SAN DIEGO, Calif (KGTV) - Doctors are warning that this winter's wet weather means an early start to allergy season."We anticipate that it could get pretty bad," says Dr. Dana Ger, the Clinical Director of Scripps Health Express.She says her offices have already seen people with all the symptoms; sneezing, runny noses, scratchy throats, coughs and congestion.Dr. Ger says you can blame it on the rain. All the wet weather in January and February kept the pollen close to the ground instead letting it disperse into the atmosphere. It's also creating a perfect environment for allergies to develop."We get mold because we have a warm and wet environment," she says. "With that we have these allergy symptoms."The rain is also bringing a high likelihood of a super bloom, with wildflowers throughout the state. Those will add more pollen to the air.And because allergy season is starting sooner, it could make symptoms worse as the spring moves along."If you have mild allergies when it's a mild spring, or a small amounts of pollen, you can have increasing allergies when there is significantly more amounts of allergies or mold," says Dr. Ger.To treat the symptoms, Dr. Ger recommends a nasal irrigation with salt water or a spray. She also says over the counter medicines will usually take care of the problem.If they don't, Dr. Ger says you should see a doctor to make sure there isn't a bigger problem, like Sinusitis."That's when it becomes critical that we have diagnosis," she says. SAN DIEGO, Calif. (KGTV) - Developers in San Diego are offering a new concept for families looking for homes: Multi-Generational Housing.The homes include a separate suite within a single structure. The suite has a bedroom, living area, bathroom and a small kitchen.Developers say the idea designed with let elderly relatives, adult children who move back home or relatives with special needs in mind."You’re still with the family, but you have that privacy to step away and still be independent," says Bill Ostrem, the San Diego Division President for Lennar Homes. "At the same time, if you want to engage with the family, the family wants to engage with you it’s right there."Lennar says they started developing these kinds of homes in 2011 in Arizona. They saw a need as more extended families began living together.The suites help with that.Currently, Lennar is building their "NextGen" homes in the Sterling Heights community near 4-S Ranch. Ostrem says it's become their most popular model.About 1/3 of all the homes they've sold in Sterling Heights have the extra suite. They have other developments with NextGen homes in 13 states."I think it just makes sense," says Austin Dias, a Co-Partner with The Phair Company. They're about to start construction on La Mesa Summit Estates just north of the 94 freeway near Lemon Grove. The overwhelming response they got was from families looking for these kinds of homes."We see this a lot in other countries," Dias says. "Now people in America are starting to embrace it."The homes are pricey. Models in Lennar's Sterling Heights development run between .7 and million.
