SAN DIEGO (KGTV) - With young children fast asleep in their bedroom, surveillance video shows a burglar on the prowl at a home in South Park. Just off 32nd Street, Billy McCowan woke up to a disturbing sight on Wednesday morning."Came over and saw the side door open to the garage," said McCowan.RELATED: La Mesa woman wakes up to burglar in her bedroomA look at the surveillance video revealed who had been on his property. Starting at about 8 p.m., a pickup truck pulls up and parks across from his home. At about 5 a.m., a man wrapped in a blanket emerges from the truck and walks through his front gate.McCowan believes the burglar walked through the unlocked door to a detached garage - a converted office - and grabbed an iPhone. Video shows the man roaming the property. Next up was a detached hot tub room."We had a small TV in here," said McCowan.In the video, the burglar is seen carrying that TV. Meanwhile, inside the home were McCowan's wife, and two children, ages 3 and 5. They were all asleep.Forty-five minutes after the man first arrives, the intruder is seen peering into the children's bedroom. By this time, McCowan has woken up and he's making coffee in the kitchen. The man appears to see him and ducks down, before quietly getting into his truck and driving off. It was a fortunate twist. SAN DIEGO (KGTV) — Each year thousands of people in San Diego County face eviction from the place they call home. With rising rents and mortgage rates increasing, experts say that trend is about to get worse.“On November 5 my family and I are going to be homeless because it’s very hard to find places,” said Margot Velez.Velez is being evicted from her apartment, the complex she’s called home for nearly a decade. She explained the owners of the complex claim she’s about ,000 behind, which is about three months rent.Team 10 investigator Adam Racusin asked Velez if there’s a possibility she ends up on the street.“Yeah, a real possibility,” she said.RELATED: More space for your money: Top neighborhoodsVelez is just one of the thousands in San Diego County facing an eviction.According to San Diego County Court records, there were more than 9,000 unlawful detainer cases filed last fiscal year. Those are eviction lawsuits.A report by the group Tenants Together, a statewide organization for tenants’ rights, stated landlords file an average of 166,337 eviction lawsuits annually in California, with a total of 499,010 households facing eviction in the three-year period. An estimated 1.5 million Californians faced court evictions over the last three years.RELATED:?Developer plans 300 new apartments in Otay Ranch"Evictions are on the [rise] in San Diego, and it's largely because there's just a depletion of rental stock,” said attorney Christian Curry with the Tenants Legal Center, a San Diego Law Firm. “Really, what it is is they get behind on their rent, and by the time they come to us usually they have the money to pay, but the landlord just won’t take it anymore."Curry said rents are going up and many people can't keep up, but in San Diego County, there are laws to help protect renters.The Tenants’ Right to Know regulations has a section that outlines termination of tenancy guidelines.RELATED: Housing swaps offer vacation savingsAccording to the regulations, a residential tenancy of more than two years duration shall not be terminated, nor shall its renewal be refused unless for things such as nonpayment of rent, the landlord intends to withdraw all rental units in all buildings or structures on a parcel of land from the rental market or the owner of blood relative plans to occupy the rental unit as their principal residence.If you’ve broken the rules and you haven’t been in your home for more than two years and you're facing eviction, there is a process for removal. According to Curry’s website, “After receiving an UNLAWFUL DETAINER [sic], the tenant/occupant must respond timely or lose the case. If you are personally served, you have only five calendar days to respond. If someone is served for you, you may have an additional 10 days. Weekends are counted but the last day to respond cannot land on a weekend (or holiday). If it does, the 'last day' carries over to the next business day. There are many defenses which can be raised.”Curry said tenants should know their rights and try to talk with the landlord ahead of time. SAN DIEGO (KGTV) - Only recently identified through DNA testing, Marine Sgt. Millard Odom was laid to rest Tuesday at Miramar National Cemetery.Tuesday was the 75th anniversary of Odom's being killed in action during World War II in the battle for the Pacific Island of Tarawa.Sgt. Odom had been buried in Hawaii for 69 years with no name on his marker. Now his loved ones are able to pay tribute.His niece, Pollyanna Brown, spoke at the service."Even after 75 years our family is one of the lucky ones that have the privilege and honor to bury our lost loved one," said Brown.Several other veterans, including the Patriot Guard Riders, attended the service. 687
SAN DIEGO (KGTV) — While many houses of worship have moved outdoors in compliance with the latest purple tier restrictions, others say this infringes on their religious rights.Many churches have chosen to keep their doors open for indoor worship, and a San Diego attorney is helping some fight this in court.“The restrictions on houses of worship are arbitrary,” said Paul Jonna, an attorney with law firm LiMandri & Jonna LLP. “No matter what size the church is, they’re closed indoors.”Jonna represents religious leaders and churches in three separate legal battles happening in Los Angeles, Kern, and San Diego counties.“You can’t treat a church like a hair salon,” he said. “Churches are entitled to heightened protection; if you’re going to restrict the fundamental right to exercise religion, which is protected under the first amendment, you need a really, really good reason.”He believes religious services are essential, and shutdown orders on churches are not constitutional.“It’s affecting people’s mental health, it’s affecting their spiritual health, for people of faith there’s nothing more important than going to church and worshiping God,” he said.The local church represented by Jonna is South Bay Pentecostal Church. They initially took their fight to keep churches open all the way to the U.S. Supreme Court a few months ago but lost in a 5 to 4 decision.The battle isn’t over just yet; Jonna submitted a petition to the U.S. Supreme Court on Thursday calling for an emergency review of South Bay Pentecostal Church’s case.“We are quite confident that in the very near future, we’ll get a good ruling from the Supreme Court,” he said. “We also think the dynamic has changed now with Justice Barrett being confirmed to the Supreme Court.”Doctors, state and county health officials have repeatedly said indoor gatherings are dangerous during this pandemic, as COVID-19 could spread easily inside.According to San Diego Health and Human Services Agency data, in the first two weeks of November, 7,661 positive COVID-19 cases were reported.Of those cases, 4,917 people were interviewed, and 168 cases were possibly contracted at places of worship.Jonna said his client, Bishop Arthur Hodges, the senior pastor of South Bay Pentecostal Church, is doing all he can to make sure worshippers are safe in his church.“He goes above and beyond the CDC guidelines,” said Jonna. “He requires people to get temperature checks; he’s complying with the masks, social distancing, everything, ventilation systems.”Bishop Hodges tells ABC 10News that since reopening, he has seen zero COVID-19 cases due to being in his church. 2640
SAN DIEGO (KGTV)- A troubled spot in Lincoln Park is getting a new look. The community came together to clean up the site.The intersection of Euclid and Imperial Avenues was once known as the "Four Corners of Death" because of the high crime, gang activity, and homelessness. Now the area is getting some long-overdue attention."I remember when that area was bustling with businesses and commerce," says Brian Pollard, President of the Urban Collaborative Project.Since 2017, the Urban Collaborative Project has been working with community members, the city, and county to clean up the area and find help for those living on the streets.Brian Pollard says there has been an increase in affordable housing in the area, but resources like healthcare and food are still limited."We're putting more people in here but not increasing the services that are needed to support these affordable housing units. Food is a very big issue."The group's first significant project was bringing the Food 4 Less, located in Market Creek Plaza, to Southeast San Diego years ago. This part of town has virtually no major grocery stores."Until we start acknowledging that and pumping resources and shifting priorities, we will never catch up," says Pollard.UCP hopes to redevelop the Lincoln Park area, near Euclid and Imperial Avenues, to see it thrive as it did years ago, inviting businesses to invest in the process.The group is planning a community clean up in the coming weeks to beautify the area. 1491
