It did not offer an explanation for its decision in a brief order posted online, saying only "FURTHER ORDERED that oral argument before the en banc court be heard at 9:30 a.m. on Tuesday, August 11, 2020. The parties should be prepared to address whether there are 'no other adequate means to attain the relief' desired."A three-judge panel of the court ruled 2-1 last month that U.S. District Judge Emmet Sullivan had overstepped his bounds by not granting the Justice Department’s request to dismiss the case against Flynn.The Justice Department in May moved to dismiss the case against Flynn, one of the signature prosecutions of special counsel Robert Mueller’s investigation into Russian election interference.The motion followed a review by a U.S. attorney appointed by Attorney General William Barr to scrutinize the case.But rather than immediately dismiss the case, Sullivan appointed a retired federal judge to argue against the Justice Department’s position and to consider whether Flynn could be held in criminal contempt for perjury. VIENNA — Austrian authorities say at least one gunman, shooting apparently at random in a popular Vienna nightlife area hours before a coronavirus lockdown took effect, killed four people in an Islamic extremist attack. They said Tuesday that the suspect, who was shot and killed by police, was a young Austrian-North Macedonian dual citizen who had a previous terror conviction for attempting to join the Islamic State extremist group in Syria.Chancellor Sebastian Kurz said two men and two women died from their injuries in the attack Monday evening. He said a police officer who tried to get in the attacker’s way was shot and wounded, and another 14 people were hurt. (KGTV) -- Authorities are searching for a suspect they say groped a 14-year-old girl at a Vista restaurant.According to the San Diego County Sheriff’s Department, a man walked into the Panda Express on Main Street in Vista and grabbed a 14-year-old on the buttocks on March 21.The department says the man then left the restaurant driving a black sedan.The suspect is described a black man between 35 to 45-years-old who is five feet, nine inches tall and weighs about 200 pounds.Anyone with information is asked to call Crime Stoppers at 888-580-8477. 573
