SAN DIEGO (KGTV) — A Pacific Beach woman is appealing for tips after a hit-and-run driver struck the motor scooter she was riding, leaving her with serious injuries.On Saturday afternoon around 1 p.m., yoga teacher Fallon Lev was headed to a yoga studio, riding her motor scooter on Ingraham Street, when she exited onto Sunset Cliffs Boulevard."Just gotten onto the ramp, going a reasonable speed," said Lev.In a one-lane section, she looked to her left and felt a car right next to her."It bumped me, causing the scooter wiggle back and forth. Instantly, I'm like on the floor, and my whole body is tumbleweeding on the cement. I must have gone five or six times," said Lev.She says the driver kept going. Later, at the hospital came the diagnosis and surgery."I broke my pelvis in two different areas and have these two bars sticking out of my hipbone and a bar straight across," said Lev.She also suffered a painful road rash and a broken tooth. Her road to recovery will be a long one. Lev, a yoga teacher whose income was greatly impacted by the pandemic, is trying to stay positive. The actions of the driver make her angry."I'm trying not to affect it my healing. Of course, it's extremely disturbing and disappointing ... There is no way the driver didn’t see me go down. They actively chose to leave me," said Lev.In fact, Lev remembers feeling like this was no accident. She was leaving traffic on a one-lane section of the roadway."I felt like it was on purpose. I wasn’t going fast enough, and that was my payback," said Lev.Lev is now hoping for tips to track down a hit-and-run driver."The driver deserves to know that’s not the way you treat a human being," said Lev.Lev recalls an older model, maroon sedan, which may have been the car right behind the car that hit her. SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown. A city spokesperson said, “the city looks forward to working with the community and Council office on this matter.” A court hearing on the TRO is scheduled for Feb. 7. 2661

SAN DIEGO (KGTV) - A man was arrested Monday morning on suspicion of breaking into a Pacific Beach home and sexually assaulting a sleeping woman earlier in the month, San Diego Police said.Jeffrey Hanze, also known as Jeffrey Hanre, was taken into custody in Los Angeles County by sheriff’s deputies at 3:45 a.m. No details about the arrest were released.Hanze entered a home in Pacific Beach through an open window about 2 a.m. the morning of October 1, San Diego Police said. RELATED: Police release photo of Pacific Beach sexual assault suspectInvestigators said Hanze sexually assaulted the woman who was sleeping, but left when she woke up.Hanze was considered armed and dangerous at the time of his arrest.10News checked Hanze's criminal background and found he has at least two felonies out of San Diego. He was also charged with several sex crimes in Arizona in 2011, including public sexual indecency, indecent exposure to a person 15 years old or more, and disorderly conduct. SAN DIEGO (KGTV) — A growing group in San Diego is flipping the script on those who fight dense development in their own backyards.They're calling themselves the 'YIMBY' Democrats. YIMBY for "yes in my backyard." Their solution is for more dense development in urban areas where people can live and work. They also seek legislative reform and developments that help combat climate change."It's basic supply and demand," said member Dike Anyiwo. "The more sort of inventory that we're able to produce and build and create, then it stands to reason that prices should go down."RELATED: MISD: Granny flat permits soarTheir ideas appear to be gaining traction. The city recently passed Mayor Kevin Faulconer's plan eliminating parking requirements near transit centers. And the YIMBYs are getting visits from some key politicians, including Assemblyman Todd Gloria, City Councilmembers Monica Montgomery and Chris Ward, and County Supervisor Nathan Fletcher. Plus, some of its members are now landing spots on city planning groups. Anyiwo is now on the Midway Pacific Highway Community Planning Group. Still, concerns remain that the YIMBY plans could lead to too much crowding for the city's infrastructure. SAN DIEGO (KGTV) – A sailor who was rescued at sea off San Onofre State Beach in San Clemente was taken to San Diego by the Coast Guard Monday.The man called Joint Harbor Operations in San Diego about 11:20 a.m. to report his 18-foot boat was taking on water 12 miles offshore.“I tried a couple of things to fix the problem and couldn’t figure out where the water was coming in from,” Gillest said.He was able to radio the Coast Guard for help, who sent a helicopter crew to rescue him.“I was in contact with the pilot. He said if the stern starts going underwater, its time to get away from the boat,” Gillest said.  “The uncertainty was when I was getting out to me, watching it fill with water, I was like who’s going to get out here? Am I going to be in the water before anyone gets here?”By around 12:45 p.m., the boat began to sink and Gillest was forced to jump into the water. Gillest, who is retired military and a strong swimmer, says he was in the water for about 10 minutes.The Coast Guard deployed a rescue swimmer and basket into the water, who was able to reach Gillest, put him into the basket, and hoist him up into the chopper. “Not really scared because I know the coast guard guys and they’re awesome,” Gillest said, “Everything went textbook.” 1282
