SAN DIEGO (KGTV) -- A federal judge ordered that the Trump administration reinstate the Deferred Action for Childhood Arrival program, also known as DACA. The DACA program - which protects nearly 800,000 undocumented immigrants brought to the United States as children from being deported. While the decision has been made, it won't be an easy road for the people involved. The restart is delayed until August 23, to allow the government time to appeal Judge John Bates' decision. For Dreamers like Ali Torabi, Friday's win is just the latest in the political tug of war.RELATED: San Diego Dreamers heading to the Capitol“I was preparing for, in the next four days, the complete opposite," Torabi said. He believed he might be deported. "I was actually working on my med school applications, and I was like, ‘I need to get my things together now.’”Torabi is a DACA student from Iran and a 22-year resident of San Diego. He said Judge Bates' decision is huge for the undocumented immigrants protected by the program. But being in constant limbo can be emotionally draining. "Having this back and forth, where one day we don’t know if we’ll have any protection and were up to be potentially deported or detained, to telling us, well yea we’ll keep the protections...it’s difficult," he said. "I’m not going to lie to you, it’s emotionally difficult.”It isn't over yet. Judge Bates ruling could conflict with another decision on the program - expected to be ruled on by a federal judge in Texas by as early as next week.The Texas Attorney General calls the program unconstitutional because it came from an executive order.“It invites future presidents to ignore the law, ignore the will of the people, and set their own policies on the second amendment, privacy rights, drug laws, or any other important issues debated in Congress," said Texas Attorney General Ken Paxton. SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. They feel this sense of loyalty," Schumacher said. SAN DIEGO (KGTV) - A 91-year-old woman died and a younger woman was injured in a crash in Clairemont Friday. The crash happened about 11:30 a.m. in the 6000 block of Balboa Avenue, near Mt. Alifan Drive, authorities said.The older woman was driving south on Mt. Alifan in a gray Toyota Camry. Police said the Camry and a car driven by a 32-year-old woman collided in the intersection of Balboa Ave.Wreckage was strewn across the Auto Zone parking lot at 6085 Balboa Ave.The 91-year-old woman, who has not been identified, died at the scene. The younger woman suffered minor scrapes and bruises, police said.The cause of the collision is unknown. Police said it was possible a car may have run a red light, leading to the crash.Balboa Avenue is closed in both directions from the 6000 block (Mt. Alifan Dr.) to 6600 block (Mt. Albertine Ave.) near Lindbergh/Schweitzer Elementary School. Police believe the road will reopen about 3 p.m. 973
SAN DIEGO (KGTV) - A colony of 300,000 bees lives on the roof of the Marriott Marquis in Downtown San Diego, and the hotel says that's perfectly fine with them.In fact, they planned it that way.The bees are part of Bee Leaf USA's Urban Bee Keeping program, which is an effort to help the struggling American Honey Bee population."This is the absolute most fantastic thing we can do for beekeeping at this point," says Travis Wolfe, from Bee Leaf USA."For a corporate entity to onboard something as outlandish as honey bees to offset their carbon footprint is one of the most moving and engaging things that one of these businesses can do," he says.The bees have been on the roof for about five years. They gather pollen in a three-mile radius around the hotel.They also make honey -- lots of it."They make about 7 gallons a year," says Wolfe. "That really is an enormous amount to consume."Fortunately, the hotel's Marina Kitchen and Bar helps use the honey."The ethos of the restaurant is to be as local as possible," says Executive Chef Aron Schwartz. "What could be more local than our roof?"Schwartz has put the honey in seasonal offerings for the last few years. Recently, it's been part of the salad dressing in their tomato and cucumber salad. It's also been featured on the charcuterie board and in a honey almond cake."It's about being restrained," says Schwartz. We're not going to put honey into 16 dishes. We're going to put it in one or two."This month, the bar is adding a honey-infused whiskey to several of its cocktails. They've partnered with Malahat Distillery in Miramar, which is aging their whiskey for six months in barrels coated with honey from the roof of the Marriott."We get a more naturally infused honey flavor out of that than some of the bigger producers who just stir honey into the whiskey," says Bar Operations Supervisor Michael Girard."It tastes amazing. You can smell the honey, you can taste the honey, but it's not a sweet sugar bomb," Girard says.The drinks will be available throughout the summer. Meanwhile, the bees will stay on the roof indefinitely."It really is a true demonstration of fantastic sustainability," says Wolfe. 2179
