Alifan Drive into roughly 50 apartments for the homeless. The location is near the Vons shopping plaza.“It’s just not acceptable. I’m not against homeless shelters by any means but this is not the proper location,” said Mark Bromley. He believes the site is too close to homes and schools.San Diego City Councilman Chris Cate said the developer has not yet applied for a permit to start the project. Cate told 10News he can’t give his opinion on the project in case the issue goes before the Council.Organizers shut down the planned open house after more than 200 people attended due to possible fire code violations given the size of the crowd.Another informational meeting is tentatively scheduled for next Tuesday at a larger location. 973

SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. Businesses can ask if a person has a disability, but not much beyond that.RELATED: Confrontation over wearing a mask at Coronado coffee shop"You can't delve into someone's medical condition and ask them a bunch of questions," said attorney Colin Harrison. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. So what's reasonable?"A reasonable accommodation might be to ask the person to wear a face shield, which is about an inch and away and probably wouldn't restrict their ability to breathe," says attorney Steven Elia.RELATED: GoFundMe started for San Diego barista after woman posts about not wearing mask at StarbucksElia says other accommodations might include curbside pickup, but the ADA has limits: businesses don't have to fundamentally alter the way they operate."Customer says I don't want to wear a mask, I want you to deliver to my home. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. There have been at least nine across the country. But businesses that win can pursue legal fees from the other party. 2548

SAN DIEGO (KGTV) - Dreams of a degree take a backseat when you’re trying to find a safe place to sleep every night. As part of 10News’ Facing It Together initiative, we’re sharing a glimpse into life for homeless students and what’s being done to help them. “I’ve got to finish, that’s why I keep coming, I’ve got to finish,” said Brandon, a San Diego native who only wanted to be identified by his first name. Brandon started taking classes at City College three years ago in hopes of becoming a psychologist. “I love City, I love City, I feel so safe here and welcome here, I always have.” Six years sober, Brandon overcame a meth and heroin addiction. But he's been in and out of homelessness for several years. Complete Coverage: Facing It Together“Education will help me get out of this homeless situation, education will help my family, my kids included, get out of poverty.” Brandon spends more hours getting to and from school than inside the actual classroom. Living in Escondido, it's a two-hour bus commute each way. He and his dog are currently living in a shed with a bed made out of recycled materials. “I would love to have my own pad, that I can actually take a shower and wash dishes in a sink. Hot water, it’s been a while.” After surviving a suicide attempt in 2003, Brandon wants to help others struggling. And there are many. A 2018 study found 9 percent of university students were homeless in the last year. The figure was 12 percent for community college students. Stephanie Hernandez and her husband, both Palomar College students, became homeless after their landlord raised the rent. They spent a year and a half living in their car. “The biggest struggle was going to sleep at night and not knowing if you’d get woken up by the cops,” Hernandez said. “Having no job, having nothing, this being your home with no gas, and being stuck somewhere…it’s heart-shattering.” Hernandez was ready to quit until she confided in school employees, who told her about the campus food pantry. Palomar College helped Hernandez get a job and an emergency grant for a car expense. “I think we really addressed the food and nutrition part first; the homelessness thing is going to probably take a little longer.” Aiden Ely with Palomar College said the school has created a task force to look into safe overnight parking lots for students. SAN DIEGO (KGTV) -- Gas prices continue to soar in Southern California, rising nearly two cents more Monday. According to figures from AAA, the price for a gallon of gas gone up more than 50 cents in less than a month. AAA also says that the price has risen for 21 consecutive days and 27 of the last 28 days in San Diego County. RELATED: San Diego's gas prices could soon hit average, something not seen for yearsThe price per-gallon is more than 20 cents more than a week ago, 51.7 cents more than a month ago and over 27 cents higher than a year ago. California's gas tax is also set to increase by 5.6 cents on July 1, 2019. Meanwhile, the national average for a gallon of gas Monday was .74.AAA says a series of refinery issues reduced gas supplies.Bloomberg Phillips 66 refinery in Los Angeles, and Chevron Corp.'s El Segundo plants all experienced shut downs and stalls in oil production due to various problems.
