SAN DIEGO (CNS) - San Diego is the fourth-best large city in the country in which to live, according to a ranked list released Tuesday by the personal finance website WalletHub.WalletHub ranked cities with a population above 300,000 by evaluating their affordability, economic strength, education and health quality, quality of life and safety. A total of 62 cities were sampled for the list, with Virginia Beach, Virginia, taking the top spot.San Diego ranked 51st in affordability but ranked among the top-10 cities in education and health, quality of life and safety, and 12th in economic strength. SAN DIEGO (CNS) - Protesters are planning to assemble Saturday outside the California Democratic Party Convention in San Diego as part of a ``Working People's Day of Action,'' according to a local labor organization.The rally will start outside Convention Center Park at 3:30 p.m., according to the San Diego and Imperial Counties Labor Council. Workers will advocate for their rights two days before the U.S. Supreme Court is expected to hear a case that could have a dramatic impact on the ability of workers' unions to raise money.The case, Janus v. AFSCME Council 31, will determine whether public sector labor unions are allowed to charge mandatory fees to all workers in their organizations. The case could overturn the Supreme Court's 1977 ruling in Abood v. SAN DIEGO (CNS) - The city of San Diego has reached an agreement with two local nonprofit organizations to improve its stormwater infrastructure and local water quality, it was announced today.Under the agreement, the city pledged to improve its stormwater management sites at the Miramar Landfill, Metro Biosolids Center, North City Reclamation Plant, Point Loma Wastewater Treatment Plant and South Bay Water Reclamation Plant. San Diego Coastkeeper and the Coastal Environmental Rights Foundation will concurrently contribute ,000 to the San Diego Audubon Society to be used for water quality improvement and habitat conservation in Mission Bay.The city's Transportation and Storm Water Department, which oversees the Storm Water Division, declined to comment on the agreement, which was approved by a federal judge last Tuesday. SAN DIEGO (CNS) - The San Diego County Board of Supervisors Wednesday heard a proposal to reduce light pollution in two rural communities.The proposed amendment to the county's Light Pollution Chapter ordinance would cover the Julian and Borrego Springs Community Planning Areas.Both would be considered "Zone C" to receive a Dark Sky Community designation, which is generally more restrictive, according to a presentation at Wednesday's board meeting.Along with unanimously approving the ordinance amendment on first reading, the board also found it to be exempt from the state's Environmental Quality Act, as it does not affect land use or density.It would also support Julian in becoming an International Dark Sky Community and update Borrego Springs' light pollution standards.The board will consider formal adoption at its Nov. 18 meeting. If approved, the amended ordinance would take effect in January.Zone C is generally more restrictive and limits total amount of light per acre and has more restrictive standards for signage or nighttime sports.Proposed changes would include new lighting standards (for color type, levels and shielding) and sign illumination. The county would give existing developments 10-year grace period to come into compliance.Dark skies are important to astronomers for better viewing in rural communities, along with businesses that benefit from related tourism. SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826
