SAN DIEGO (KGTV) - The U.S. Coast Guard reports sightings of a whale in San Diego Bay.Several pictures were posted online by San Diego Floating Lab, which is located off Shelter Island in America's Cup Harbor.Captain Rick Scott of Ocean Odyssey took the photos. An employee at the business said it's common for juvenile whales to enter the bay, but they tend to find their way back out.The Coast Guard has not determined what type of whale is in the bay.Watch a Facebook live of the whale in the player below: Have you seen the whale? SAN DIEGO (KGTV) -- The San Diego Unified School District is releasing an update on the next phases of its plan to reopen schools for in-person learning.The current plan to begin Phase Two for elementary school students is after the winter break on Jan. 4, said SDUSD Board President John Lee Evans.Middle and high Schools will start Jan. 25, at the beginning of the third academic quarter, said Evans.Elementary students will be divided between morning and afternoon sessions to allow for social distancing in the classroom. Middle and high school students will attend in person sessions, two days per week.All families will have the option to continue distance learning, said Evans."What can throw this plan off track? There are two main factors," said Evans. "Number one, lack of success of controlling the virus in phase one -- which we don't believe will happen; or two, external conditions of the virus in the community.""I would like to make an appeal to our community to assist us in reopening our schools," said Evans. "Personally, I do not believe that bars and restaurants should be open before our schools are open." 1136

SAN DIEGO (KGTV) -- The San Diego County District Attorney announced Monday that criminal charges have been filed against a former San Diego Sheriff’s deputy accused of fatally shooting a detainee.Former deputy Aaron Russell, 23, is being charged with murder in the second degree after being accused of shooting and killing Nicholas Bils, 36, who escaped from a California State Park Officer’s car outside San Diego Central Jail on May 1. Bils was allegedly running away from officers unarmed when he was shot. He was initially arrested for reportedly threatening a ranger with a golf club at Old Town San Diego State Park.RELATED: San Diego County sheriff’s deputy who fatally shot escaped detainee resigns from department“We reached the decision to file criminal charges following a thorough review of all the objective facts and evidence in this case by specialized prosecutors and investigators in our Special Operations Division,” said San Diego County District Attorney Summer Stephan.“When a life is taken, we must make decisions based in facts and law, and not ones that are influenced by the status of the accused as a peace officer nor the status of the victim. These decisions must be made solely in the interest of justice and not based on favoritism nor public opinion. SAN DIEGO (KGTV) -- The San Diego Unified School District says it has removed a letter from President Trump inserted into food baskets that, according to the district, downplays the importance of wearing a mask. The district says the letter “significantly diminishes the scientifically-backed importance of wearing a mask to protect against the transmission of COVID-19.”According to the district, the letter was placed into boxes of free groceries set to be distributed to 50 million families across the country.The district says President Trump’s letter recommends that Americans practice social distancing and “consider wearing a face covering in public.”“Science is clear: wearing a mask works to prevent the spread of the coronavirus,” Superintendent Cindy Marten said. “Masks are required in California and on every San Diego Unified school campus. It is not optional, as the President wrote in his letter.”The state currently requires that people wear face coverings when in public spaces, indoors, and areas where physical distancing is not possible. 1066

  

SAN DIEGO (KGTV) - The place where an 87-year-old woman was hit and killed by a FedEx truck, is now covered with candles, flowers, and messages from loved ones.Mary Francel was a mother to eight and grandmother to dozens more.She was walking back from church and crossing a driveway on Balboa Avenue near Mount Albertine Avenue when the FedEx truck hit her. The driver immediately stopped after the crash."She was very much well-loved and she put all of us first at all times, it was never about her," said Joey Villegas, one of Francel's grandchildren. "I wrote her and told her thank you, for how much she taught us. Me and my brother, she basically helped raise us when we were young."Villegas says his grandma loved bingo, drove a big truck and was incredibly devoted to her family and friends.At this time the driver has not been arrested or cited for the accident.   890
