EL CAJON (CNS) - A driver whose blood-alcohol content was nearly quadruple the legal limit slammed into the back of a pregnant woman's car in Ramona two years ago, killing the woman and her unborn child, a prosecutor told a jury Wednesday.But a defense attorney denied that his client caused the crash, claiming the prosecution's case was based entirely on circumstantial evidence and a shoddy police investigation.Andrew Milonis, 46, is accused in the Mother's Day 2017 crash that killed 29-year-old Jessica Foderingham and her unborn child, a girl who Foderingham and her husband planned to name Ayanna. Milonis is charged with two counts each of second-degree murder, gross vehicular manslaughter while intoxicated, hit-and-run and drunken driving.RELATED: Witness: Driver in El Cajon crash, that killed pregnant mother, was 'very intoxicated'Foderingham was eight months pregnant when her Dodge Dart was hit, sending it careening into a tree in the center median on San Vicente Road about 6:45 p.m. May 14, 2017.Deputy District Attorney Laura Evans said in her opening statement that Milonis had been drinking throughout the day, having at least seven drinks at a local bar before he got behind the wheel of his GMC Yukon.The prosecutor said a bartender recommended that Milonis arrange a Lyft ride to get home, but he ignored the advice. Then while driving, Milonis struck a tree and multiple telephone poles before crashing into Foderingham's car, Evans said.RELATED: Driver accused of killing pregnant woman, taking Lyft to barAfter the crash, Milonis continued driving to a nearby hotel, where employees called a Lyft driver for him, Evans said. When the Lyft driver arrived and asked Milonis where he wanted to go, the defendant allegedly told the driver something to the effect of, "Anywhere I can get a drink," according to Evans.He was driven to a bar on Main Street, where sheriff's deputies located and arrested him shortly after he arrived. When his blood was tested, he had a blood-alcohol content of 0.20, but Evans alleged it was above 0.30 at the time of the crash -- well above the 0.08 legal limit.The prosecutor told jurors the impact of the crash left a partial imprint from Milonis' license plate on the back of Foderingham's car, and there was no evidence of mechanical issues on either car that might have contributed factors to the crash.RELATED: Vigil held for pregnant Ramona crash victimSix months earlier, Milonis has been arrested on suspicion of DUI for allegedly driving drunk and hitting a neighbor's fence before going home, according to Evans, who said he suffered a minor head injury in the crash and had a 0.28 blood alcohol content at the time.Christian Foderingham, a U.S. Marine, testified Wednesday that he and his wife's two young sons from a previous relationship began Mother's Day by making her breakfast and showering her with gifts throughout the day. The couple then left home for Jessica Foderingham's grandmother's house in Ramona, taking two cars -- Jessica in her Dodge Dart and Christian driving the boys in his Hyundai.He was driving ahead of his wife when he heard a loud bang behind him, saw a dark-colored SUV swerve onto a sidewalk and witnessed his wife's car slam into a tree. He testified that after hearing the loud noise, he saw his wife's car flying through the air before it struck the tree head-on and bounced back into lanes of traffic.RELATED: Judge raises bail to M in Ramona fatal hit and run"It felt like my heart stopped," he testified.Foderingham said he ran to his wife's car, smashed the driver's side window open and cut off her seatbelt to remove her from the wreckage. An off- duty firefighter helped Foderingham perform CPR until emergency personnel arrived and took her to Palomar Medical Center in Escondido, where she died, according to the victim's husband.Milonis' attorney, Ward Clay, told jurors the crash was "a tragic accident" but said Milonis was not responsible."No one witnessed exactly how the accident happened," Clay said.The attorney said Christian Foderingham never got a good look at the SUV driver.Foderingham testified that the SUV had tinted windows and there might have been two people inside. He could only confirm that the driver was Caucasian.Clay claimed that at the time of the crash, Milonis was not near the crash scene.The attorney also said the California Highway Patrol "made major mistakes" in their investigation of the case, and that "critical, forensic evidence" had been lost or destroyed, though he did not specify what that evidence was.Clay said he expected the jury to be "angry and want to hold someone responsible. (KGTV) — An El Cajon Popeyes location has been approved to reopen after county health officials deemed the location an "imminent health hazard," forcing a temporary closure.Popeyes Louisiana Kitchen at 110 Jamacha Rd. was closed this week after an inspection by the county Department of Environmental Health (DEH) on Jan. 21, 2020 found a cockroach infestation, according to the notice. That same day and the next, the location underwent pest control treatment and a complete sanitation of the restaurant.A 10News viewer reached out after finding the location shuttered.The DEH returned Thursday and determined the infestation was cleared, scoring an A (100%), allowing the restaurant to reopen.A routine follow-up inspection will be conducted in 60-90 days, according to the city.10News reached out to Popeyes for comment, but have not heard back. 873

  

DICKSON, Tenn. — Animal rescue officials said dogs found with signs of abuse and neglect belonged to the family of missing 5-year-old Joe Clyde Daniels.Two dogs were found left on a stranger’s property on Garners Creek Road last Sunday night, three days before Joe Clyde was reported missing by his parents.The Dickson County Humane Society and TCB Kennels Boarding & Rescue have been working to give the dogs proper care. “It was pretty sad,” said DCHS General Manager Vivienne Akhdary. “They were very skinny. They were covered in fleas and ticks and were very scared. The dogs were not well taken care of, and behavior shows definite signs of abuse.”“They just pulled over and dropped them off,” said TCB Kennels Boarding & Rescue Founder Trisha Davis.Davis has been taking care of the dogs because the animal shelter is full. The homeowner who found them first contacted her.“They’re actually still searching for the property where the dogs were dropped off,” added Davis.They said it was confirmed the dogs belonged to the Daniels family by relatives and neighbors.The homeowner lived nine miles away from the Daniels. More than a week later, the dogs, now named Joey and Clyde to honor the 5-year-old boy, have been doing better and hope to find a more permanent home soon. Davis said no one has claimed the dogs back. The body of Joe Clyde has not been found, but the search continued one week later.His father, Joseph Daniels, was charged with one count of criminal homicide after he confessed to allegedly beating his son to death and disposing of his body in a rural and remote location.His mother, Krystal Daniels, was later arrested for child neglect or endangerment after she admitted to being at the house when her son died and failed to report the abuse or alleged homicide despite multiple opportunities, according to court documents. Belle Daniels, Joe’s grandmother, told Scripps station WTVF in Nashville she does not know why her son would commit the alleged crime.Akhdary said she cannot help but feel uneasy of what could have gone on behind closed doors.“The parents did not take care of their kids. I don’t think they spent a lot of time taking good care of the dogs.”To help the shelter and donate to the dogs’ cause, visit the Humane Society of Dickson County online.WTVF stopped at the family's house this week, but they declined to do an interview. 2442

  

EL CAJON, Calif. (KGTV) - Renovations are underway at the East County Performing Arts Center to turn the nearly 50-year-old performance hall into a rock and roll concert venue."We have to change the vibe, the feel of what this building is," said Dirk Epperson, El Cajon's Director of Public Works.The venue closed in 2009 when the recession forced cuts in the city budget. Now, the renovations come as tour promoter Live Nation prepares to take over the venue. The City of El Cajon entered into a five year deal with the concert company to manage the building. As part of the agreement, Live Nation will bring 50 events to the venue in 2019, and as many as 70 events by 2023. Live Nation also manages the House of Blues in San Diego and Mattress Firm Amphitheater in Chula Vista."We're not sure what it will be like," said Mayor Bill Wells.  "We've never had this regular, steady diet of top name acts that are coming in. So nobody's quite sure how much this is going to have a ripple effect around El Cajon. But everybody thinks it will be positive."The city is now spending .3 million to upgrade the facility. Improvements include new amenities like modern concessions, a more open entrance, and lobby area and new plush seating in the first few rows. The seating capacity for the main hall will also increase to 1,300. Part of the plan also calls for a brand new VIP Lounge at the back of the venue. The money for the project comes from the sale of the old police headquarters.As for what kind of acts will fill the venue, Epperson said it's entirely up to Live Nation."It can pretty much be any type of act or band," he said, adding the city will let the experts decide. "But you can imagine the ones that are on their way up or on their way down will be coming to this size venue."Smaller, local performances like school concerts and recitals will still be held at the venue, which Wells says is part of the community. With the upgrades, he said it should stay that way for a long time."We're in it to win it," said Wells. "We'll be successful with this." 2120
