SAN DIEGO (KGTV)- One month after the deadly bluff collapse in Encinitas, the husband of one of the victims is speaking out for the very first time. Dr. Pat Davis is a well-known dentist in the community. He lost his wife, daughter, and sister-in-law in that tragic collapse. Davis says he’s still in a state of healing. But despite the pain of losing his family members, he is now urging local leaders to come up with a plan, so no family has to go through this again. “It’s a terrible thing to experience,” says Davis. “I can’t think of a worse situation that could of happened to me as a family man.”The Davis family was out for a day at the beach back on August 2nd. Davis’ wife Julie, daughter Annie Clave and Sister-in-law Elizabeth Davis were sitting under the cliff when it gave out, killing all three women. “People in my family have been down to Grandview beach a thousand times, over the last 25 years,” says Davis. “We’ve never looked at it as being a place that was really dangerous.”Annie Clave’s friend, Tiffany Rogers, was also at the beach that day. She held back tears describing her three friends. ““Three extraordinary women who had just everything, just beautiful, so beautiful on the inside,” says Rogers. As part of healing, Dr. Davis says his new purpose in life is to find a solution to stabilize the bluffs. He supports options like cutting off some access to the beach, sand replenishment, or putting a barrier wall along the cliffs. Just this past weekend, there have been two more bluff collapses, in Encinitas and Torrey Pines State Beach. A couple of weeks ago, Davis made a passionate plea before the Encinitas City Council to take action. Thursday afternoon, he shared his concerns with Congressman Mike Levin who is fighting to get federal funding to shore up the bluffs. “It’s not a question of if this is going to happen. It’s when it’s going to happen again,” says Davis. “All you have to do is go walk along our beaches up here; you see cliffs that look like they could fall at any time.” 2034

Gavin Newsom’s opposition to Pacific Gas & Electric’s restructuring plan just a week after it struck a .5 billion settlement with fire victims is forcing the nation’s largest utility to go back to the negotiating table and come up with a solution fairly quickly.The San Francisco-based company needs to pull a deal off to meet a June 30 deadline to emerge from bankruptcy protection and regain its financial footing.Missing the deadline would prevent PG&E from being able to draw from a special fund created by the Democratic governor and state lawmakers to help insulate California utilities from future fires that many people believe are bound to erupt as a changing climate continues to create hazardous conditions. Utilities are at risk because their aging electric transmission lines are expected to take years to upgrade.On Thursday, PG&E filed an amended reorganization plan with the U.S. Bankruptcy Court after reaching a settlement on Dec. 6 with thousands of people who lost homes, businesses and family members in a series of devastating fires.In his letter on Friday, Newsom said the plan does not comply with state law and does not achieve the goal of addressing what he considers its most important elements: providing safe and reliable power to PG&E customers.“In my judgment, the amended plan and the restructuring transactions do not result in a reorganized company positioned to provide safe, reliable, and affordable service,” he said.The governor said PG&E’s plan did not go far enough in improving safety, corporate governance and the company’s financial position. The company has until Tuesday to appease Newsom and get him to sign off on the plan.“We’ve welcomed feedback from all stakeholders throughout these proceedings and will continue to work diligently in the coming days to resolve any issues that may arise,” PG&E said in a statement.Without the added protection of the California wildfire fund, PG&E would likely find it more difficult to borrow money to pay for the necessary upgrades and perhaps even fund its ongoing operations if it remains mired in bankruptcy proceedings beyond June 30.If PG&E can’t get a revised deal with the fire victims approved, it also will face the specter of navigating through two other legal gauntlets early next year that would be used as an alternative way to estimate how much the company owes for the catastrophic wildfires in 2017 and 2018 that killed nearly 130 people and destroyed about 28,000 structures in its sprawling service territory.One, a California state trial to be held in January, will determine whether PG&E is liable for a 2017 fire in Sonoma County that the company hasn’t accepted full responsibility for. The trial would also award damages to the victims if PG&E is blamed. A subsequent proceeding, known as an estimation hearing, is scheduled in February before a federal judge to determine PG&E’s total bill for all the fires that could have been covered in the settlement that had been worked out with the victims.Attorneys for the fire victims so far have collectively lodged claims of about billion against PG&E, according to court documents. But that figure could rise even higher after the state trial and estimation hearing, and it if does would likely leave PG&E unable to meet its financial obligations — a development that could lead U.S. Bankruptcy Judge Dennis Montali to declare the company insolvent.If that were to happen, it would automatically void a separate billion settlement deal PG&E has reached with insurers who say they are owed billion for the fire insurance claims they expect to pay their policyholders in the wildfires blamed on the utility. The insurance settlement, though, is also being opposed by Newsom, and is still awaiting Montali’s approval.The governor “may have upset a rather delicate bankruptcy process,” said Jared Ellias, a bankruptcy expert at University of California, Hastings College of the Law.“We’re going to see how resilient the deal that comes out of this process is going to be and whether it can adjust to meet his approval,” he said. 4197

While she hasn't waited in a polling line for over three decades, she hasn't missed an election."Living outside of America doesn’t mean you’re not American, it doesn't mean you don’t care about the issues, and it certainly doesn’t mean that you don’t have an opinion about who you want to lead your country," said Zwisler.Now back in the states, she still exercises her constitutional right via the U.S. Postal Service.“I honestly prefer the luxury of voting at home because I can look online, and I can check the websites of what both party's opinions are of the initiatives or of the candidate's backgrounds," said Zwisler.In states like California, Oregon and Colorado, voters have had this option for many years.According to a Pew Research Center analysis, the share of voters casting a ballot by mail has been growing steadily over the years, increasing nearly threefold between 1996 and 2016, from 7.8% to nearly 21%.But while states like Oregon and Washington conduct their elections almost entirely by mail, other states have seen relatively few mail ballots, the analysis goes on to explain.“I think everyone has to weigh in on what’s happening right now, it’s critical," said Zwisler.As the pandemic reshapes how we vote in this election, Zwisler believes the changes could actually strengthen our democracy, making voting easier and convenient for more Americans. 1868

(KGTV) -- Mexican authorities are investigating the discovery of a tunnel near the Otay Mesa border in San Diego, U.S. officials said.Department of Homeland Security officials confirmed the discovery Thursday morning but did not provide any further details.“At this time, U.S. authorities are aware of a tunnel discovered by Mexican law enforcement officials near the Otay Mesa border. However, we have not yet determined whether the tunnel entered into the U.S.," said Lauren Mack, a spokeswoman with the DHS.All that is known at this time is that the tunnel is in Mexican territory, south of Otay Mesa which stretches east of 805 and south of the 905 freeways.10News station partner Televisa reports that the tunnel does cross the border. (KGTV) - A fire on the USS Bonhomme Richard at Naval Base San Diego started Sunday morning and as of Monday afternoon, continues to burn, adding smoke to the sky and raising concerns over air quality in San Diego.Related: USS Bonhomme Richard fire: 57 treated for injuries after fire erupts aboard Naval Base San Diego shipBill Brick is the Chief of Monitoring and Technical Services Division at the Air Pollution Control District and said there are concerns in some areas but not everywhere. He said they have received reports of people smelling the smoke as far away as Oceanside and Escondido. According to Brick, those people who are farther away may be able to smell the smoke but the particulate matter is less concentrated, so it should not pose a health risk.He said the people who should be aware of health concerns are those nearby the fire who end up directly in the path of the smoke due to wind and also those with prior health concerns such as asthma, lung or heart problems. He said if anyone is close enough to smell the smoke and also gets irritated eyes, they should also be aware that there could be health risks. For any of those people, he advises to avoid exercise, go inside and close the windows to avoid breathing in that air.Brick also said that a problem with this fire is they don’t know exactly what has burned. While the Navy has said they are still within EPA standards, Brick said the focus has been on fighting the fire so it has been hard for them to determine everything that has burned. Brick said they did take samples of the air to see if anything toxic is in the air, but those results will not come back for a few days, so he advises everyone to use caution while the fire still burns. 1751
