SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. SAN DIEGO — The race to replace former Congressman Duncan Hunter in California's 50th Congressional District is in a virtual deadheat, according to a new scientific poll.The ABC-10News Union-Tribune SurveyUSA poll shows Republican Darrell Issa, a former congressman, leading Democrat Ammar Campa-Najjar 46 percent to 45 percent, within the 5.4 percent margin of error. “This poll I think is a shocker for many political observers, including myself,” said Thad Kousser, political scientist at UC San Diego. “You have an establishment, well-known candidate in Darrell Issa with proven fundraising ability in a district that until a couple years ago was the reddest district in California, so many people thought that by this time the real start of the campaign season Darrell Issa would have a huge lead over Ammar Campa-Najjar.”Hunter resigned in January after pleading guilty to a single felony conspiracy count. Federal prosecutors accused him and his wife Margaret of misusing 0,000 in campaign funds. Hunter, under indictment during the 2018 election, still defeated Campa-Najjar by 3 percentage points, or 9,000 votes in the 50th District, which leans Republican.Campa-Najjar is running in 2020 to take the open seat. SALT LAKE CITY, Utah — A teenager was hospitalized after he was shot by a police officer in Salt Lake City Friday night.According to Salt Lake City police Sgt. Keith Horrocks, officers were dispatched to the area of 500 South and Navajo Street just after 10 p.m. on reports of a "juvenile" — police did not release his exact age — having a mental health episode and threatening people with a weapon.Police say the boy fled on foot when officers arrived, and one officer shot him.Officers administered aid until medical personnel arrived and transported the boy to a local hospital in serious condition.Wesley Barton, who said he is the boy's brother, tweeted that he is 13 years old and is in stable condition.An officer-involved critical incident protocol investigation has been launched, which includes an investigation conducted by local departments other than Salt Lake City Police Department (SLCPD). SAN BERNARDINO, Calif. (AP) — Searchers are combing a section of the San Bernardino Mountains for signs of a missing off-duty firefighter. The San Bernardino County Sheriff's Department says the search Saturday is focusing on an area of Highway 18 where Carlos Baltazar’s car was located by the California Highway Patrol on Sept. 20. Baltazar is a member of a U.S. Forest Service Interagency Hotshot Crew. He was reported missing by family members on Sept. 24. At the time, he was off duty and not in the area of the El Dorado Fire in the San Bernardino National Forest. Another hotshot, Charles Morton, died while fighting that fire on Sept. 17. 654
