SAN DIEGO (CNS) - The family of a 19-year-old San Diego State University student who died after falling from his bunk bed and striking his head following a night of drinking has filed a wrongful death lawsuit against several defendants, including the university, the fraternity he was pledging for, and the manufacturer of the bed he fell from.The lawsuit filed last week in San Diego Superior Court alleges Dylan Hernandez was hazed by members of Phi Gamma Delta just prior to his death, and that fraternity members not only failed to obtain medical attention for him after he became extremely intoxicated, but also attempted to hide evidence of misconduct following his fatal fall.Hernandez fell from his bed on Nov. 7, 2019, and died in a hospital the following day.RELATED: Investigation completed into death of SDSU student who died after fall from bedThe lawsuit alleges he attended a "Big Brother, Little Brother" fraternity event that had pledges "screamed at and demeaned, beaten with paddles and hands, and forced to consume shots of vodka and rum to the point of intoxication."Following his hospitalization, the lawsuit alleges Phi Gamma Delta members instructed others to remove incriminating material from their cell phones and in group chats, members were told to "Keep your mouths shut!" and "Just remember, Silence is Golden!"Representatives with Phi Gamma Delta did not respond to a request for comment.RELATED: Autopsy report of SDSU student who died after fall from bed releasedIts national office permanently suspended its SDSU chapter in August and SDSU expelled the fraternity until 2030.In July, it was announced that no criminal charges would be pursued in connection with Hernandez's death, which was ruled accidental. A joint statement released by the university's police department and the San Diego County District Attorney's Office stated there was "no basis" for manslaughter or hazing charges.Investigators said there were no injuries on Hernandez's body "that appeared consistent with hazing, and no evidence of student group activities likely to cause serious bodily injury or death, which is statutorily required to prove hazing." Other than Hernandez's "devastating head injuries," the only other wound to his body was an abrasion on his thigh, officials said.RELATED: San Diego State suspends 14 fraternities after student is hospitalizedOne month after that statement was released, Rob Caudill, the fraternity's executive director, sent SDSU a letter announcing the chapter's closure, stating the SDSU chapter had been found guilty of violating fraternity bylaws, including hazing, drug use and violations related to alcohol misuse.SDSU representatives said the university could not comment as it had not yet seen the lawsuit, but pointed to steps the university has taken to combat hazing activities on campus in the wake of Hernandez's death. These include the formations of two task forces examining student activities and alcohol/substance abuse. Task force recommendations led to the implementation of a Good Samaritan Policy, in which student organizations are encouraged to report concerns about student health and safety, and a Hazing Prevention Task Force that held its first meeting this fall.Hernandez's family alleges SDSU was aware of prior hazing issues involving Phi Gamma Delta and failed to properly discipline the fraternity for such activities. The family alleges SDSU was aware of prior instances when Phi Gamma Delta pledges were hazed or hospitalized for excessive drinking.The family also alleges the school created an unsafe environment in the Tenochca Residence Hall where Hernandez suffered the fatal fall by furnishing its rooms with bunk beds that didn't meet minimum safety standards.In suing SDSU and the bunk bed manufacturer, Foliot Furniture Pacific, the family alleges the beds featured "safety rails" that were defective, and contributed to 550,000 deaths nationwide over a 16-year period and 10 injuries at SDSU between 2017 and 2019. 4015

SAN DIEGO (CNS) - San Diego State University will not begin any of its fall sports earlier than Sept. 26 due to the ongoing pandemic, the university's athletics department announced Thursday.This follows guidance from the Mountain West Conference Board of Directors, which decided Wednesday to adjust conference team schedules to allow additional monitoring of ongoing COVID-19 developments and adjustments to keep student-athletes safe.The SDSU Aztecs football team will shrink its schedule to 10 games and most other fall sports will only play conference opponents."The Mountain West athletic directors and the conference office worked hard to develop a game plan for fall sports that will allow student- athletes to have a great experience and take in to account their health and well-being," said SDSU Director of Athletics John David Wicker. "Starting the season later allows us the opportunity to learn from professional sports and other conferences and continue to develop the best protocols possible to ensure the safest return to play model possible."The conference and school schedules align with the NCAA Board of Governors' directions, also released this week. The fall season will also continue to be evaluated in the context of the virus on campuses and within communities, and will be subject to directives from local, state and federal leaders."Should further modifications become necessary, including delay or cancellation of competition, the MW Board of Directors is prepared to do so," a conference statement said.The football team, coming off a 9-3 season including a blowout bowl win against Central Michigan, is also dealing with a new but familiar head coach.Head Coach Brady Hoke coached the Aztecs for the 2009 and 2010 seasons. He took over for Rocky Long in the offseason."It is exciting to get some positive news about a football season, but the safety and health is the first thing," Hoke said in a statement. "It gives us an opportunity to make sure our protocols are in place for the safety and health of the student-athletes, the staff, the athletic trainers and everyone associated with the program. We will continue to be smart as coaches and players on how we proceed."The SDSU cross country team is still awaiting an evaluation of its schedule. The men's soccer team -- which competes in the Pac-12 -- will compete in conference-only play, as will the women's soccer and volleyball teams, which both compete in the Mountain West.All Aztec fall competition in the sports of men's and women's golf, men's and women's tennis, swimming and diving, indoor track and field, softball and baseball have been canceled."The health and well-being of our students, student-athletes, coaches, staff and overall communities remain the first and foremost priority," said Mary Papazian, president at San Jose State University and chair of the Mountain West board. "The modified fall structure supports the measures being taken by each of our institutions to ensure responsible return to play. SAN DIEGO (CNS) - The San Diego City Council's Active Transportation and Infrastructure Committee unanimously voted Wednesday to send a set of proposed additions to the city's regulations on dockless scooters and bicycles to the full council for further consideration.The committee approved a handful of amendments to the ordinance at the behest of the mayor's office. The suggested changes include a rider curfew from midnight to 5 a.m., usage of one device per government ID, a fine structure and punitive actions for companies that violate city regulations and the elimination of the original ordinance's provision allowing for temporary fleet spikes during large events like Comic-Con.The amendments would also authorize the city to take actions like reducing a company's fleet size if it poses a public safety hazard or suspending a company outright for multiple violations and requiring the eventual use of geofencing technology to keep riders from traversing the city's sidewalks.RELATED: San Diego scooter ridership drops off dramaticallyThe council approved the original regulatory package in April after more than a year of complaints from residents about the need for oversight. The city sought to improve public safety while also keeping dockless mobility companies in the region as an affordable transportation alternative.The regulatory ordinance included limiting scooter speeds and parking in heavily trafficked areas of the city, operator permits and fees for scooter companies like Bird and Lime, documenting of scooter fleet size and data sharing requirements between scooter companies and the city.The city also introduced a webpage, sandiego.gov/bicycling/bicycle-and- scooter-sharing, giving residents the ability to view which companies operate in San Diego and contact information for each of them. "We want to stay in San Diego, especially with the new technologies that we are eager to test here that furthers public safety and education."RELATED: San Diego makes designated dockless scooter and bike spacesOne scooter company, Jump, left the San Diego market earlier this year due to its belief that the city could not effectively enforce its regulations and encourage good behavior by riders.Representatives from multiple companies, including Jump, and City Councilman Chris Cate suggested the establishment of a dynamic fleet cap that would limit companies that repeatedly violate the city's ordinance."In other cities, such as Santa Monica, that employ this kind of performance-based system, operators are focused on going above and beyond to demonstrate to city officials that they have earned the right to deploy more devices," Jump's Senior Operations Manager in San Diego Zach Williams said.City officials are expected to review the amendment package's legality before it comes before the full council. With only four meetings left before the council takes its winter holiday legislative recess, the council could wait to consider the ordinance until early next year. 3681

  

SAN DIEGO (CNS) - The president of the NAACP San Diego Branch Saturday criticized the proposal to de-escalate confrontational law enforcement situations adopted Wednesday by the San Diego County Police Chiefs and Sheriff's Association.The plan calls on all police personnel to "use tactics and techniques to persuade" suspects to "voluntarily comply" and mitigate the need to use increased physical tactics to resolve situations safely, the association said.Francine Maxwell, NAACP San Diego Branch president, issued a statement in reaction to the proposal: "We find this document to be profoundly tone- deaf and utterly inadequate. This document seems to have been prepared inside an echo chamber of highly paid law enforcement officials. Where was the input from the taxpaying public?"The policies unanimously adopted by the group are the culmination of a project that began last June with the creation of a committee tasked with exploring the hot-button issue. The committee included representatives from all countywide municipal police agencies, the San Diego County District Attorney's Office and a local psychiatric emergency-response team.Guiding the development of the new policy was "the overarching principle of reverence for human life in all investigative, enforcement and other interactions between law enforcement and members of the community," according to the association.But Maxwell responded to the proposal by asking, "Where in this document is it affirmed that the purpose of law enforcement is to protect and to serve, not to dominate and control? Where in this document are the policies and procedures needed to reign in the abuse, violence, and death that so regularly occur in citizen interactions with law enforcement?"Maxwell asked the law enforcement group to apologize for and withdraw the proposal, which said argued "does nothing to restore the public's trust and faith." She made a few other recommendations as well, including asking law enforcement to sit down with individuals who have suffered trauma and abuse, and she asked that officials move swiftly to build a new spirit of service and protection into their departments.She said officers who will not change should be removed, "rather than allow them to corrupt another generation of recruits with their aggression and violence."According to the association's strategy, peace officers should consider these concepts:-- Pre-engagements which involve "the process of gathering and assessing information prior to deploying the available personnel, tactics, equipment and other appropriate and obtainable resources" so as to "enhance the probability of a peaceful outcome."-- De-escalation, which hinges on the use of techniques intended "to gain voluntary compliance from an individual in order to gain or maintain control of an incident while reducing the need for physical coercion."-- Disengagement, or "tactical withdraw," an enforcement method that can "be a viable option for individuals in crisis who pose no additional threats to others, or resistant offenders who may later be apprehended under safer conditions."The mission of the project "was to not only define best practices for de-escalation, but to do so collectively to ensure the county is of one mind on the philosophy," said Chula Vista Police Chief Roxana Kennedy, president of the police-leadership body. "As part of this community, we understand the importance of violence prevention whenever possible, and de- escalation techniques are the best way to get there."The association included the law enforcement leadership of the county and all local cities, as well as San Diego Harbor Police, the county Probation Department and the police departments of the San Diego Community College District, San Diego State University, San Diego Unified School District and the University of California San Diego. 3867

  

SAN DIEGO (CNS) - San Diego County health officials reported 228 new COVID-19 infections, the smallest daily increase since June 19, raising the county's cumulative caseload to 32,975.No new coronavirus fatalities were reported Monday. The total death toll remains at 594.County health officials also reported five community outbreaks, bringing the number of outbreaks in the past week to 14.The latest outbreaks were reported in a restaurant, a restaurant/bar setting, a government office, a business and a grocery store, according to the county Health and Human Services Agency.The number of community outbreaks remains well above the county's goal of fewer than seven in a seven-day span. A community setting outbreak is defined as three or more COVID-19 cases in a setting and in people of different households in the past 14 days.The number of patients hospitalized for treatment for coronavirus totaled 321 as of Monday, with 101 of those patients in intensive care units. Sunday saw the fewest number of hospitalized COVID-19 patients since June.Of the total positive cases in the county, 2,752 -- or 8.3% -- have required hospitalization since the pandemic began, and 689 -- or 2.1% -- were admitted to an intensive care unit.The county's case rate per 100,000 residents Monday was 101.6. The state's goal is fewer than 100 per 100,000. The case rate is a 14-day average and is based on the date of the actual onset of the illness in each patient, not the date the illness was first reported by the county. Lags in reporting often lead to delays in new confirmed cases being reported to and announced by health officials.The county reported 7,570 tests Sunday, 3% of which returned positive. The 14-day rolling average percentage of positive cases is 5%. The state's target is fewer than 8.0% testing positive. The seven-day daily average of tests is 8,148.The next scheduled media briefing by county health officials will be Tuesday. No briefing was held Monday due to a county budget hearing.County Supervisor Nathan Fletcher said last Wednesday that because of problems with the state's electronic reporting system, which has led to a backlog in test results, additional cases might be retroactively added to both local and statewide case totals in coming weeks.The percentage of people testing positive for the illness who have been contacted by a county contact tracer in the first 48 hours increased from 7% on July 18 to 97% Monday. The county's target for this metric is more than 90%.Of the total hospitalized during the pandemic due to the illness, 71% have been 50 or older. But county residents ages 20-29 have accounted for 25.5% of COVID-19 cases, the highest of any age group, according to county data. That age group is also least likely to take precautionary measures to avoid spreading the illness, officials said."Some San Diegans think they're not going to get sick and therefore are not following the public health guidance," Dr. Wilma Wooten, the county's public health officer, said last week. "What they don't realize is that they could get infected and pass the virus to others who are vulnerable."The age group with the second-highest number of infections -- residents ages 30-39 -- represent 18.9% of the county's COVID-19 cases. 3272
