The National Hurricane Center said on Tuesday that it plans on sending a US Air Force reconnaissance aircraft on Wednesday as a storm system spins in the northern Gulf of Mexico. The National Hurricane Center said on Tuesday that the storm has a 70 percent chance of becoming a tropical depression or tropical storm by Thursday, and an 80 percent chance of becoming a depression or storm by the weekend. The center of the storm was located just off the Florida Gulf Coast. Regardless of the disturbance's status, it is still likely to bring heavy rain from the upper Texas coast to the Florida panhandle. The National Hurricane Center warns that the northern Gulf of Mexico has favorable conditions to form a tropical system. The next tropical storm in the Atlantic basin will be named Barry. The unnamed system is spinning in the same general area where Hurricane Michael gained strength last October. Hurricane Michael became a Category 5 hurricane just two days after becoming a hurricane. The man who drove into a crowd of counterprotesters in Charlottesville's "Unite the Right" rally two years ago has pleaded for mercy and asked for a sentence less than life imprisonment in his federal hate crimes case.In a sentencing memorandum filed in federal court Friday, James A. Fields Jr. said the court should not give him a life sentence because of his young age, history of mental illness and childhood trauma, and to show that no one is defined by their worst moments."James did not come to Charlottesville with any plan to commit an act of violence. In the space of only a few minutes, caught in circumstances he did not intend to create, he acted in an aggressive and impulsive manner consistent with his mental health history and his age," the memo reads."In a matter of seconds he caused irreparable harm for which there is no excuse. But this Court can understand his actions, without excusing them, as symptomatic of transient immaturity, and not consider them to be predictive of who he might be in the future with time and medication."The memorandum notes that Fields' grandfather killed his grandmother and then himself, and that his father died in a car accident before Fields was born. His mother was in an accident that left her paraplegic before he was born and raised him as a single mother. The memo also says he has been taking medication since his imprisonment that has controlled his symptoms."No amount of punishment imposed on James can repair the damage he caused to dozens of innocent people. But this Court should find that retribution has limits," the memo states.The memo comes ahead of his sentencing in his federal case, in which he pleaded guilty to 29 hate crimes in order to avoid the death penalty.Fields was 20 when he attended the August 2017 demonstrations in Charlottesville, Virginia, and joined white nationalists, neo-Nazis and other groups opposed to the city's decision to remove a statue of Confederate Gen. Robert E. Lee. During a day of violent clashes in the city, Fields drove his vehicle into a crowd of counterprotesters, killing Heather Heyer, a 32-year-old paralegal.Fields was convicted in state court of first-degree murder and other charges, and the jury recommended a sentence of life in prison. He is due to be sentenced in that case on July 15, Commonwealth's Attorney Joseph Platania said in March. 2377

  

The Chicago police union again is calling for a federal investigation into State's Attorney Kim Foxx to determine the extent of her involvement with the Jussie Smollett case.Kevin Graham, president of the Chicago Fraternal Order of Police, said the demand is based on news reports about text messages between Foxx and an attorney about, according to him, "diverting the case from Chicago police department to a federal investigation."Foxx, the state's attorney for Cook County, recused herself from the Smollett investigation in mid-February.Graham, who spoke to reporters after prosecutors announced they were dropping charges against Smollett, said he originally made the request to the US Department of Justice last week. He also has asked federal investigators to look into a letter sent to Smollett days before he alleged he was attacked on a Chicago street."We're doubling down on that. We want to make sure that the Justice Department takes a very hard look with that case and what went on today," he said.Text messages obtained by CNN through an open records request show Smollett family friend Tina Tchen -- a former chief of staff for first lady Michelle Obama and a lawyer -- reached out to Foxx on February 1. Tchen wrote the family had "concerns about the investigation."Foxx emailed Tchen saying in part, "Spoke to Superintendent Johnson. I convinced him to (r)each out to FBI to ask that they take over the investigation. He is reaching out now and will get back to me shortly."Later another person, identified by Foxx's office as a family friend, asked the prosecutor whether they could talk on the phone. She says Tchen gave her Foxx's number.Hours later, Foxx texts the unidentified family friend that she "spoke to the (police) superintendent earlier, he made the ask. Trying to figure out the logistics."The person responds: "Omg this would be a huge victory."The text message exchange went back and forth with Foxx and the family friend until Feb. 13 and these messages are why Foxx recused herself from the investigation, Cook County State Attorney's Office spokeswoman Tandra Simonton said earlier this month.CNN reached out to Foxx on Tuesday but didn't get a response.Efforts to get a comment from the Department of Justice on Tuesday night were also unsuccessful. 2301
