SAN DIEGO (CNS) - A 24-year-old La Jolla man who was wearing a Jesus costume when he sucker-punched a San Diego police officer at a Gaslamp District Halloween street festival was sentenced Thursday to 270 days in jail, which will be served on weekends.Eric Van Vleet, who was arrested in Idaho's Cassia County four days after the Nov. 1, 2019, attack, pleaded guilty last year to a felony count of battery on a peace officer resulting in injury.San Diego County Superior Court Judge Melinda J. Lasater ordered that Van Vleet serve his time in county jail on 35 consecutive three-day weekends, totaling 105 days, with the rest of the time earned through custody credits. Lasater, who also imposed five years of probation, ordered that the jail term be re-evaluated and potentially modified after 15 weekends.RELATED: Man in Jesus Halloween costume accused of punching San Diego police officerDeputy District Attorney Will Hopkins said San Diego Police Officer Ben Hall and his partner, Kristen Robinson, witnessed a fight break out among several people outside the Atomic bar about 1 a.m.Hall pepper-sprayed the combatants, including one man, who punched his girlfriend after being blinded by the mace.When Robinson went to detain the man, with Hall assisting, Hopkins said Van Vleet -- who was dressed as Jesus Christ with devil horns -- yelled, "(Expletive) the police" and punched the lawman in the side of the head.He then walked away from the ruckus, disappearing into a crowd and getting into a ridesharing vehicle, and eventually left the state. -SAN CLEMENTE ISLAND (CNS) - The remains of seven U.S. Marines and a Navy sailor were recovered Friday after going missing near San Clemente Island when their amphibious vehicle sank during a training mission last month.The remains were recovered during underwater salvage operations, the 1st Marine Expeditionary Force announced Friday evening. The remains will be transferred to Dover Air Force Base in Delaware to be prepared for burial."Our hearts and thoughts of the 15th Marine Expeditionary Unit are with the families of our recovered Marines and Sailor," said Col. "We hope the successful recovery of our fallen warriors brings some measure of comfort."The U.S. military announced Tuesday it had located the amphibious assault vehicle that sank last week off the coast of San Diego County, killing nine young servicemen, and confirmed the presence of human remains where the vessel came to rest on the sea floor.The naval Undersea Rescue Command made the discovery near San Clemente Island on Monday using video systems remotely operated aboard the HOS Dominator, a merchant vessel whose crew specializes in undersea search and rescue.The amphibious troop-transport vehicle was en route to a waiting ship during a maritime training mission about 80 miles west of Encinitas when it foundered for unknown reasons about 5:45 p.m. July 30, according to Lt. Gen. Joseph Osterman, commanding general of I MEF.The 26-ton vessel went down roughly 1,600 yards from a beach on the northwest side of the island in water nearly 400 feet deep.Seven members of the Camp Pendleton-based crew survived the accident. Medics took two of them to Scripps Memorial Hospital La Jolla, where both were admitted in critical status. One was upgraded to stable condition as of Sunday night.The other five rescued Marines received clean bills of health and returned to their units.Pronounced dead at the scene of the accident was Lance Cpl. Guillermo S. Perez of New Braunfels, Texas. Perez, 20, was a rifleman with Bravo Company, Battalion Landing Team 1/4, 15th Marine Expeditionary Unit.The 15th MEU, I MEF and Makin Island Amphibious Ready Group searched in vain for nearly two days for more survivors or their bodies, finally concluding the operation Saturday after 40 hours of scanning some 1,325 square miles of water by sea and air.The other lost service members have been identified as:-- Pfc. SAN DIEGO (CNS) - A judge Monday denied a request by four San Diego County businesses seeking to resume indoor operations following the county's recent slide into the purple tier of the state's coronavirus reopening plan.San Diego Superior Court Judge Kenneth J. Medel heard arguments Friday on the lawsuit, which was filed earlier this month on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic, shortly before indoor operations were suspended for nonessential businesses in the county due to rising COVID-19 case numbers.The businesses sought a temporary restraining order halting the prohibition on indoor operations, contending that San Diego County's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses impacted by the closures.While Medel and the state conceded pandemic restrictions have created negative economic impacts for businesses, both stated the public health concerns outweighed those harms.In his ruling, Medel wrote, "In the court's mind, the impact on public health of dismantling a portion of the state's COVID-19 response designed to reduce community spread outweighs the economic harm to plaintiffs at least pending further examination of these issues in any upcoming hearing on preliminary injunction."A status conference was scheduled for Dec. 2 for discussion regarding a preliminary injunction hearing.Wilson Elser, the law firm representing the businesses, declined comment on the ruling, stating through a spokesperson that it does not comment on active lawsuits.The lawsuit cited figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of infections and confirmed community outbreaks.During Friday afternoon's hearing, attorney Bruno Katz, representing the businesses, referenced an adjudication request submitted to the state by San Diego County Public Health Officer Dr. Wilma Wooten, which sought to have San Diego County remain in the red tier. SAN DIEGO (CNS) - A 69-year-old man was hospitalized this morning with a broken leg he sustained in a hit-and-run crash in the Teralta West neighborhood.The pedestrian was crossing northbound at the intersection of Orange and Central avenues at 10:15 p.m. Friday when a vehicle driving east on Orange Avenue turned north onto Central Avenue and struck the man, according to Officer Robert Heims of the San Diego Police Department.The vehicle backed up after the crash, then drove away west on Orange Avenue, Heims said.The victim sustained non-life-threatening injuries and was taken to a hospital, Heims said.The suspect vehicle was described as a light-colored, 4-door sedan, possibly a Pontiac G6 or similar vehicle.
