(KGTV) - Nearly six years after it passed, Proposition B will be in front of two courts this week, with the future of San Diego pension reform on the line.Prop B was on the ballot in June of 2012 and passed with 65% of the vote. It promised to solve San Diego's pension crisis by giving new City hires a 401(k) style retirement plan instead of a pension. The change went into effect for all city hires except police officers.Since then, it's been mired in legal challenges.Shortly after it passed, union leaders sued, arguing that any changes to union employment agreements have to be negotiated first before they're placed on a ballot. They said that then-Mayor Jerry Sanders violated that rule when he openly campaigned for the Proposition in 2012.In 2015, the State Labor Board agreed with the union claims.That ruling went to the California 4th District Court of Appeals, who overturned the Labor Board's findings in 2017.In 2018, the State Supreme Court reversed the 4th District's ruling. The Supreme Court sent the issue back to the lower courts to decide what an appropriate "remedy" would be to Sanders' improper campaigning."They did not say 'Overturn Prop B.' They could have," says Reform California's Carl DeMaio, who wrote Proposition B. "They said, 'Hey, district court, find out how you punish the City of San Diego for this violation.' What’s the punishment? A slap on the wrist, a speeding ticket?"The 4th District will hold an open session on Monday, March 11 to begin that process. DeMaio says if the District Court rules to overturn Prop B, he plans to appeal that decision."Do you think they’ll actually overturn the citizens initiative? If they do, we will counter-sue on the punishment phase," says DeMaio.Meanwhile, the US Supreme Court will also look into the Proposition this week. On Friday, they'll decide whether or not to hear a case based on the First Amendment. Supporters of Prop B say the California Supreme Court's ruling violated Mayor Sanders' First Amendment rights of free speech and his ability to openly support or oppose items on a ballot."The issue is whether for not elected officials have first amendment rights," says DeMaio. "Can an elected official actually give an opinion on a ballot measure? I think yes. Even if I disagree with that opinion, it is their constitutional right. He doesn’t lose his personal free speech rights to take positions once he's elected."The US Supreme Court will announce their decision on Monday, March 18th. 2515

SAN DIEGO (KGTV)— The man accused of raping and torturing a woman in his home in Rancho Penasquitos faced a judge today. 32-year-old Uber driver, Seyed Hassan Kaboli pleaded not guilty to 12 counts of sexual crimes. Kaboli peaked through his holding cell, as the judge announced his fate. San Diego Police said Kaboli bound, raped, and tortured a woman, multiple times at his home in Rancho Penasquitos on May 19th and 20th. Sky10 footage showed the victim being consoled by the police on Monday, and she said she ran naked to escape 24 hours of brutal misery. The next day, Kaboli was arrested just north of National City. 10News obtained a copy of the criminal complaint, explaining Kaboli’s 12 felony charges. They include:(5) Forcible oral copulation (2) Rape(1) Rape by a foreign object(1) Torture(1) Assault with great bodily injury(1) Sexual battery(1) False imprisonmentThe complaint also suggests that there may be another person involved in the crimes. Under count three, it reads Kaboli “inflicted aggravated mayhem and torture on the victim and another person.”Under count eleven, it reads “said person was unlawfully restrained by said defendant and an accomplice.”In the courtroom, neither the defense nor the district attorney would comment on a possible third party.Still, the judge issued a protective order for the victim— a woman, whose relationship was not disclosed. But Kaboli’s defense attorney said she was not his Uber customer. “There is no prior relationship,” Kaboli’s attorney, Ryan Tegnelia said. “He is not denying that they came into contact with each other on the date of the incident. But before that, they did not have any relationship.”Tegnelia said Kaboli’s family describes him as an introverted man who keeps to himself. They said they are shocked at his arrest. “This obviously came completely out of left field for them, caught everybody by surprise,” Tegnelia said. The judge set Kaboli’s bail amount at 0,000. If convicted, Kaboli faces 200 years to life in prison. 2024

SAN DIEGO, California — An 18-year-old San Diego woman died and her 16-year-old cousin were injured in a crash on Interstate 10 on the way to the Coachella Music Festival in Indio, a friend told KGTV television station in San Diego.Federico Pedrazzini confirmed Ginevra Gallone-Latte died in the crash in Banning early Thursday morning. Her cousin Manuela was injured.The California Highway Patrol said 21-year-old Cesar Hernandezozuna was speeding when his BMW drifted onto the dirt shoulder. The driver tried to get back onto the freeway but went over an embankment and hit two trees, officers said.The crash split the car in two. Gallone-Latte was thrown and died at the scene, according to the CHP.Her cousin was taken to the hospital with serious injuries. Hernandezozuna suffered a facial injury, according to the CHP.Both teens had previously attended La Jolla High School.Officers ruled out alcohol and drugs as contributing factors in the crash but had not determined the cause, the CHP said. 1019

  

San Diego (KGTV)- For weeks, the pandemic left nursing students at CSU San Marcos in limbo when it came to completing their graduation requirements. Now, thanks to the county, the students can get their clinical hours.When the pandemic hit in March, nursing students were forced out of public health facilities to get their hands-on experience for their classes.“We didn’t know when we were going to go back, and it was halfway through the spring semester,” says nursing student Winter Minton.Minton will be graduating from CSU San Marcos in the spring.The nursing student says for weeks, students were unsure about how they would obtain their clinical hours. A total of 135 hours are needed for two classes.“When we were ready to go back, the county was not willing, ready to have nursing students on site at all,” says Course Coordinator Madelyn Lewis.In August, the county opened a COVID-19 testing clinic on campus and allowed nursing students to work on-site. The students assist patients with self-administered COVID tests while wearing full protective gear.“Not only does it benefit us, but it benefits so many people,” says Minton. “I heard people driving all the way down from Irvine or Fullerton just to get the exam done.”Minton says the walk-in clinic sees more than 300 patients a day.The testing site is open to the public seven days a week. 1363

  

SAN DIEGO (KGTV)-- On a clear, sunny day in February, the sound of a bell announces the arrival of Naval Commander John C. Witte as he boards the USS Annapolis. He's in charge of the roughly 160 sailors who serve aboard the submarine, one of several boats stationed at Naval Base Point Loma."Submarining takes a lot of mental toughness and these guys will work long hours but they'll do what it takes to get the mission done," Witte told 10News. As you can imagine space is limited on board, nearly every inch is utilized, especially in the command area. But that's not to say the crew doesn't ever use their eyes. The periscope is still something the submarine crew utilizes regularly. "We may want to look at what other ships are doing we may want to try to observe other navy's activity stuff like that," Witte said. Everyone on board has a specialized skill, but because of the isolation that comes with being underwater for long periods of time, everyone has to take on multiple roles. When it's time to eat, the culinary specialists use the limited supply of ingredients to make every meal and also bake things like fresh bread and cookies pretty often. "We don't carry a lot of pre-made bread because it takes up too much room so a lot of our bread is made fresh a lot of our cookies are made fresh so its a pretty good," Witte explained.
