SAN DIEGO (KGTV) — The new community plan for Kearny Mesa, given final approval by the City Council earlier this week, takes effect Friday. Several properties are being rezoned with 27,000 new housing units planned for those parcels.“My vision is that within five years, you’ll be able to live on Convoy, enjoy the restaurants and the shops that are on Convoy, and work in a job in Kearny Mesa, all in one community," City Councilmember Chris Cate, who represents the area, told ABC 10News ahead of the final vote.Cate says the city is trying to encourage a"live-work" village concept for many San Diego neighborhoods, especially those that are major job centers, such as Kearny Mesa. The idea is that by creating housing and recreational possibilities in the same communities where people work, they will have to commute less. That has numerous benefits across the city, including less traffic and car pollution.It is anticipated that many of the new projects will replace aging strip malls whose parking lots remain vacant much of the time. Cate hopes the areas around Convoy St., Clairemont Mesa Blvd., and Aero Dr. will become similar to the feel of Little Italy.Because parameters have already been set for how many homes will go onto each affected parcel, as well as other necessities such as pathways, street improvements, and parks, there will not be the same drawn-out approval process that has been seen with other recent attempts at development. Cate says that means developers who acquire the land will be able to move quickly, as long as their design stays within the parameters of the community plan. “They already have an understanding of what these projects will look like, what’s required of them, where different pathways or parks will go. All these things are already agreed to on the front end," Cate said.Cate says he anticipates that the first projects could break ground in 2021. 1910

SAN DIEGO (KGTV) - The City of San Diego is rolling out the second phase of the polystyrene foam and single-use plastics ordinance as the Memorial Day weekend kicks off. Starting May 24, a ban on the sale and distribution of egg cartons, food service ware and food trays made from polystyrene foam begins. The ban includes bowls, plates, trays, cups, lids and other similar items designed for single-use. According to the city, polystyrene foam doesn’t biodegrade and can be mistaken for food by marine life and other animals. Acceptable alternatives include recyclable plastic, aluminum and recyclable paper products, the city says. Some businesses that make less than 0,000 are exempt until 2020. “The City’s goal is to achieve zero waste by 2040,” said the City’s Environmental Services Department Director, Mario X. Sierra. “This ordinance not only helps in achieving that goal, but also improves water quality, reduces pollution and keeps our environment healthy.” 980

SAN DIEGO (KGTV) - The boy who was critically injured in a crash in San Ysidro joined his parents Friday outside the courthouse where the alleged driver is on trial.Prosecutors said Constantino Banda Acosta, an undocumented immigrant, was drunk May 6 when he hit the Lake family on their way home from Disneyland.Lennox Lake was hospitalized for 18 days with multiple skull fractures. SAN DIEGO (KGTV) - The hospital patient who brutally beat a San Diego nurse faced a judge on Friday for his sentencing. 10News was in the courtroom, where the nurse described how she fought for her life while 41 year-old Geoffrey Brizzolara attacked her.“I stood in his doorway and I said, ‘How may I help you, sir?’ His response was to lift a 25-pound chair over his head and throw it at me,” nursing supervisor Mary Prehoden told the courtroom. “Mr. Brizzolara beat me with his fists. He kicked me and then scratched me and he pulled a handful of hair straight out of my head,” she went on to say.The attack happened last summer at Scripps Mercy Hospital in Hillcrest. He was a patient at the hospital and apparently has a history of mental health issues. He did not know Nurse Preholden.“His actions were deliberate and vicious. I was defenseless,” she told the courtroom.She was joined by other nurses who say that patient violence against nurses is a constant concern across the country. Nurse Trish Mcauliffe told us, “The resources have to be increased- mental health resources.” Mcauliffe described how she was once attacked by a different patient at another hospital. “I ended up with a split lip [and] loose teeth and then he stood in the doorway, laughing.”Friday, Brizzolara was sentenced to one year behind bars, with an option for early-release to a mental health treatment facility.“Every single one of us who chooses to do this for a living is under threat every day in every hospital in this country,” added Prehoden. 1542

SAN DIEGO (KGTV) - The man who attacked a teenage Syrian refugee on a San Diego trolley pleaded guilty Monday. Adrian Vergara, 26, was arrested Oct. 22 on an unrelated misdemeanor drug charge. While he was in custody, he was recognized in connection to the ongoing hate crime investigation. The 17-year-old boy was beaten on a Metropolitan Transit System car Oct. 15. Representatives for the Partnership for the Advancement of New Americans (PANA), who spoke on the teen's behalf, told 10News the teen was speaking Arabic while on FaceTime with a friend when a man on the trolley asked him, "Where are you from? Are you Mexican?" RELATED: Teen attacked on trolley in possible hate crime The teen reportedly responded, "No, I am Arab." According to the teen, the man then started punching him and cursing while using racial slurs. The victim left the trolley at the 62nd Street station in Encanto. Vergara pleaded guilty to assault and hate crime charges. As part of the plea deal, Vergara will be sentenced December 5 to five years in prison. 1051
