SAN DIEGO (CNS/KGTV) - A federal judge in San Diego today ordered the Trump administration to immediately start new asylum screenings for eligible reunified families, despite objections from the government that the agreement has not been finalized.Under the proposed settlement agreement – which U.S. District Judge Dana Sabraw gave unofficial preliminary approval to last month – reunited migrant families would get a second chance at applying for asylum.Attorneys for the migrant families argued that when the families were separated at the border, most children were not interviewed to determine if they had a credible fear of returning to their native country. Their parents were granted interviews, but were so distraught after being separated that they didn't clearly advocate for themselves, attorneys said.Under the settlement, reunited migrant families still in the U.S. will be allowed to remain until all family members have completed the asylum process.When Sabraw unofficially approved the settlement, both sides agreed that the asylum determination process should get underway as soon as possible.Sabraw granted preliminary approval last week, paving the way for credible fear interviews to proceed within days of a migrant confirming his or her wishes to go forward with an asylum claim.The ruling appears to apply to about 60 people who are detained and had signed paperwork agreeing to the terms of the new process.It could end up applying to many more.Another status conference on the class-action lawsuit is scheduled next month. 1576

SAN DIEGO (KGTV) -- Families worried about paying back rent due to the pandemic are getting more time.Tuesday, the San Diego City Council voted 5-4 to extendthe rent repayment period for commercial and residential renters to December 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would haveextended the repayment period for the eviction moratorium to March 31, 2021.Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergencyeviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused "substantial loss of income," according to city staff.Renters are also required to follow the rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.During the meeting, the council heard from landlords and realtors who say renters are taking advantage of the situation."The blanket moratorium has given criminals a free pass at the full expense of landlords, this is not a one size fits all," said property manager Claudia Cooper.Other callers said it would be a disaster to evict families just as children are starting school from home."Folks will be evicted and this pandemic won't be over anytime soon as the presentation mentioned, a lot of children are going to be learning from home and to be evicted right as school starts is just going to exacerbate the effect this pandemic has had on our kids," said one caller.Many callers said evictions must be prevented to avoid adding to the homeless problem."Many people have been out of work and eviction could mean death," said another caller.The moratorium on evictions expires September 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through December 30."We are all in it together," Gomez said before discussion of themotion. "The economy is not fully restored. It has also been one of the mostimpacted areas during the pandemic.According to a member of Gomez' staff, which gave the presentationon the topic, the city had started 15,659 rental relief applications usingfederal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday,not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent."It's a cruel hoax," she said. Bry said that by not paying rent ontime, tenants could be destroying their credit and leaving themselves withmountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, manyurging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright.About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.Councilmembers Chris Cate and Scott Sherman were opposed to theextension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year. SAN DIEGO (KGTV) -- A frustrating mystery is plaguing commuters in Carmel Valley.A seemingly perfectly good brand new lane meant to ease traffic to the 56 has been coned off for months. The project adds a third lane on southbound Camino del Sur from around Highland Village place to Highway 56. Greg Agius, who commutes that way, says it's been coned off for months. A city staffer told him it would be complete by the end of August, but on Monday it was still inaccessible to drivers. RELATED: San Diego road repairs are ahead of scheduleAgius, who also bikes in the area, said it is making for a tight merge that has led to near fender benders. "It's backing up my commute," he said. "I've actually over the last three to four months had maybe half a dozen close calls."The lane is meant to lighten the congestion in Carmel Valley, which is getting increasingly congested as more housing is built. Developer Lennar hired contractor MGI to add the lane as part of its approval for area housing projects. RELATED: San Diego projects receive funding due to controversial gas tax"This is the one that baffles me the most because it's more dangerous what they've done with the cones than if the cones weren't here," Agius said. The problem rests with the traffic light at the intersection. It doesn't stretch far enough over to be visible to all cars in the new lane. Caltrans Spokesman Ed Cartagena gave an example of cars next to a semi-truck.They wouldn't be able to see the traffic light if not in front of them. Cartagena said it needs to be extended before anyone can benefit from the new asphalt. He also noted recent other work on the lane, above and below ground, including removal of an electric box ten inches above ground.  Either way, Cartagena said the new light should be installed by the end of the week, clearing the way for the lane to open. A city spokesman said the contractor had delays in obtaining the signal pole and mast-arm for the traffic light. SAN DIEGO (KGTV) -- 33 San Diego County elementary schools were honored under the Distinguished Schools Program by State Superintendent of Public Instruction Tom Torlakson Monday.The program, which returned this year after a three-year break, replaces the California Gold Ribbon Schools Program.Schools were eligible based on test scores, suspension rates and English learner progress.Among those listed: Veterans Elementary (Chula Vista Elementary District), Green Elementary (San Diego Unified School District), Garfield Elementary (San Diego Unified School District), Monterey Ridge Elementary (Poway Unified), Ocean View Hills (San Ysidro Elementary), and Solana Pacific Elementary.“These schools implement outstanding educational programs and practices that help California students realize their potential, and put them on the path to achieve their dreams,” Torlakson said.“Every day at these schools, teachers, administrators and classified employees, working with parents, apply their dedication, creativity, and talents toward providing a great education for all their students.”According to the California Department of Education website, California is using a multiple measures accountability system to identify eligible schools based on their performance and progress on the state indicators as specified on the California School Dashboard. SAN DIEGO (KGTV) - A former San Diego Kaiser doctor who was caught watching child porn at work will have his license reinstated.The news of the reinstatement became available this week, in documents provided by the California Medical Board.Former psychiatrist Mark Zweifach went in front of the board three weeks ago for a hearing on reinstating his license. A video of the hearing recently became available to the public.For the first time on-camera, Zweifach describes his own shocking acts that still haunt him.LONGFORM: Former San Diego Kaiser doctor caught watching child porn at work tries to get his license back“Eleven years ago, on three occasions, I briefly viewed child pornography at my workplace,” he said.It was more than a decade ago that the admitted sex addict turned in his white coat, but the District Attorney's office didn't have enough evidence to bring criminal charges.California Medical Board paperwork reveals that the alarming discovery was made at a Kaiser Permanente Medical Center in El Cajon. Some of the paperwork reads, "While at work, on his Kaiser-issued computer, [he] viewed inappropriate images, including child pornography."“I didn't collect it. I didn't produce it. The day after 10News reached out, his name was removed.Documents outline his road to rehabilitation, like a 12-step “Sexaholics Anonymous” program and “regular therapy.”During his recent hearing, he describes having confronted whatever happened to him as a kid that apparently made him vulnerable to addiction.“I did have a history of being exposed to childhood sexual experiences that profoundly affected me,” he explains.Zweifach also told the board that he’s had two relapses with viewing adult pornography, but it stopped there.“I thank God that in the last eleven years, I’ve been entirely free of viewing the underage images that led to the loss of my license,” he adds.Zweifach has expressed a great deal of remorse for his actions.His license will officially be reinstated on September 14th.Zweifach will be on five years of probation which includes a number of stipulations, including not treating minors.
