SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102

SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) -- A driver lost control of their vehicle Tuesday night, crashing into a power pole while trying to avoid other cars Tuesday night.The crash, which happened around 8 p.m., caused an explosion and sent power lines arching. Several nearby bushes caught fire because of the explosion but firefighters were able to put them out quickly.The incident happened near South 43rd and Division Streets.   428

SAN DIEGO (CNS) - The two owners and two employees of San Diego-based pornographic website GirlsDoPorn.com were charged with federal sex trafficking counts Thursday, with prosecutors alleging the defendants coerced and threatened the victims into appearing in online pornography videos.According to the U.S. Attorney's Office, numerous young women who initially responded to ads for modeling jobs were deceived by the defendants to appear in adult films.Once the victims learned the work involved pornography, the defendants allegedly told them the videos would be distributed to private clients, and not disseminated on the internet.RELATED: San Diego porn case: Civil trial against porn website operators beginsProsecutors say the women were "pressured into signing documents without reviewing them and then threatened with legal action or outing if they failed to perform." Others were not allowed to leave the shoots -- which were conducted at various San Diego hotels -- until the videos were completed, which sometimes involved sex acts the victims initially declined to perform, prosecutors say.Website owners Michael James Pratt, 36, and Matthew Isaac Wolfe, 37, are charged along with porn actor Ruben Andre Garcia, 31, and administrative assistant Valerie Moser, 37. The charges carry a maximum penalty of life in prison, according to the U.S. Attorney's Office.Prosecutors say Pratt remains outstanding, while Wolfe was arrested Tuesday, and Garcia was arrested Wednesday. It was not clear when Moser was arrested, but the U.S. Attorney's Office said she is slated to be arraigned in San Diego federal court on Friday.In addition, FBI agents executed a search warrant Wednesday night at an office in the Spreckels Theatre Building in downtown San Diego, where prosecutors say the website operated from. The website and its sister sites allegedly generated more than million in revenue.The defendants are also currently involved in an ongoing San Diego civil trial in which they are being sued by 22 women who appeared in videos on the site. SAN DIEGO (CNS) - UCSD and Scripps Institution of Oceanography alumna Megan McArthur will head to space as the pilot for the SpaceX Crew-2 mission in early 2021, NASA announced this week.The Crew-2 flight will be the second SpaceX Crew Dragon flight to the International Space Station as part of NASA's commercial crew program.McArthur, who received her doctorate in oceanography from Scripps in 2002, traveled to space aboard the space shuttle Atlantis in 2009. She and her crew were part of a 12-day mission to repair the Hubble Space Telescope. McArthur operated the shuttle's robotic arm that grabbed and released the telescope, making her the last person to "touch" the telescope. She was born in Honolulu but considers California her home state. She holds a bachelor's degree in engineering from UCLA.The SpaceX Crew-2 flight will be her first trip to the International Space Station.Joining McArthur is NASA astronaut Shane Kimbrough as mission commander with Japan Aerospace Exploration Agency astronaut Akihiko Hoshide and European Space Agency astronaut Thomas Pesquet as mission specialists.McArthur is one of two Scripps Oceanography alumni who are astronauts. Alumna Jessica Meir returned from a visit to the International Space Station in April.
