People are exhausting their personal savings. They are shutting their businesses and they just don’t know what to do,” said Andrew Rigie.Rigie is with the New York City Hospitality Alliance. In NYC alone, at least 1,289 restaurants have closed since March, according to the Office of New York Comptroller. Across the country, Yelp has gathered data from its platform that show that number is around 16,000.“It’s a really dire situation,” added Rigie.The situation is the direst for independent restaurants, because the same Bank of America study that showed sales still down 15% at mom and pop restaurants, shows chain restaurant sales are now up 2% higher than they were pre-pandemic.Industry experts believe a continuing trend of these numbers could reshape the industry.Chains restaurants are now in a better position to replace space occupied by folded restaurants or struggling ones, potentially shifting the flavor of the restaurant industry toward chain food.“I’m not knocking or saying there is anything bad about a chain, but we really want our beloved mom and pop businesses,” said Rigie. "We really need support from the federal, state and local governments to ensure these places are able to recover.”Legislation was presented to Congress in June, the Restaurants Act, to help struggling independent restaurants with grant money. However, there has been no vote on the bill or any signs it could pass.Without additional help, the latest estimate by the Independent Restaurant Coalition is that upwards of 85% of independent restaurants could fold by the end of the pandemic. 1870

The US Food and Drug Administration approved two cancer treatments, Vitrakvi and Xospata, this week after expedited reviews.Vitrakvi, approved Monday, is "a treatment for adult and pediatric patients whose cancers have a specific genetic feature (biomarker)."The FDA said in a statement that it is the second approved cancer treatment that is based on a tumor biomarker instead of the place in the body where the tumor originated.Vitrakvi will be used for the treatment of solid tumors that have an NTRK (neurotrophic receptor tyrosine kinase) gene fusion that do not have a known resistance mutation, that are not metastatic or where surgical removal is likely to lead to severe morbidity, and that have no alternative treatments or have progressed after treatments.NTRK genes are rare but occur in many types of cancer, the FDA said, such as mammary analogue secretory carcinoma and infantile fibrosarcoma.Xospata tablets, approved Wednesday, are for the "treatment of adult patients who have relapsed or refractory acute myeloid leukemia (AML) with a FLT3 mutation," according to the FDA.Alongside the tablets, the agency also approved a diagnostic to detect the mutation."Approximately 25 to 30 percent of patients with AML have a mutation in the FLT3 gene. These mutations are associated with a particularly aggressive form of the disease and a higher risk of relapse," Dr. Richard Pazdur, director of the FDA's Oncology Center of Excellence, said in the statement.AML is a rapidly progressing cancer that affects the numbers of normal blood cells and calls for continuous transfusions, the FDA said.Both treatments were granted Priority Review designation.Priority Review, established in 1992, means the FDA aims to review the drug or treatment within six months, opposed to 10 months for a standard review."A Priority Review designation will direct overall attention and resources to the evaluation of applications for drugs that, if approved, would be significant improvements in the safety or effectiveness of the treatment, diagnosis, or prevention of serious conditions when compared to standard applications," the FDA says.Both treatments also received?orphan drug?designation, a status granted to drugs for rare diseases or conditions. 2261

There were heavily in debt and had court fees."Moved by her experiences watching other men and women struggle to raise children for whom they had never expected to be responsible, Hatfield began petitioning the state to bring back kinship care, which would specifically create an allowance for those permanently caring for their relatives' children. "It's so the kids stay with that family instead of foster care," she said.The United States 6th Circuit Court of Appeals ruled in October 2017 that Kentucky would be required to pay relatives who temporarily house children the same fee as foster parents.Although only 16 families will have received such payments by the end of February, the Kentucky Cabinet for Health and Family Services estimated by June 2019 the payments could affect 1,590 children and total about .3 million."It's a start," Hatfield said, although she would still prefer the establishment of a fund for relatives who will care for their kin permanently -- not just on a temporary basis. The Supreme Court ruled in favor of Booking.com Tuesday in a landmark trademark case.In an 8-1 decision, the Supreme Court upheld a lower court ruling that determined that Booking.com is not a generic trademark because the term held meaning with consumers.Justice Stephen Breyer, a liberal judge, was the lone dissenting opinion.Other businesses including Cars.com, Dictionary.com, Newspapers.com and Wine.com said the outcome in the case would affect their ability to trademark their names too. 503

  

The University of Tennessee's football season is officially over.On Monday, Tennessee issued a statement saying they would have to withdraw from the Liberty Bowl because of positive COVID-19 tests within their football program.According to the Associated Press, the team agreed on Sunday to play West Virginia before announcing Monday. They had to also pause all team activities after receiving their results of Sunday's COVID tests. The Liberty Bowl is set to take place on Dec. 31 in Memphis.The team said they decided to withdraw after consulting with health officials, the Southeastern Conference, and officials with the Liberty Bowl."The student-athletes and staff affected are taking the appropriate safety measures in accordance with University, CDC, and local health department guidelines," the team said in the news release. "The University of Tennessee extends its sincere appreciation to the AutoZone Liberty Bowl and the city of Memphis and is disappointed it will not be able to fulfill its commitment on New Year's Eve."Third-year head coach Jeremy Pruitt is among those who tested positive.Pruitt said that other than experiencing mild symptoms he is "doing fine.""We are obviously disappointed that we will not be able to play in the AutoZone Liberty Bowl, but the health and safety of our student-athletes will always remain our top priority," Pruitt said in a statement.
