SAN DIEGO (CNS) - A former San Diego High School teacher who sexually and physically assaulted an underage female student pleaded guilty to 11 felonies Tuesday, including lewd acts on a child and assault.Juan Carlos Herrera, 49, formerly a special needs curriculum instructor, is slated to be sentenced to 10 years in state prison next month for assaulting the unidentified victim "on almost a daily basis" between February 2018 and March of this year, when the girl was 15 and 16 years old, according to Deputy District Attorney Jessica Coto.His plea agreement includes lifetime registration as a sex offender and a strike offense for his plea to a dissuading a witness count for threatening the girl if she told anyone about what happened.RELATED: SDHS teacher accused of having sex with student represents himself in courtIn addition to the sexual assaults, Herrera threatened to cut the girl's arms and legs off if she told anyone what was going on, choked her and threw her on the ground, according to the prosecutor.The crimes occurred in his classroom, his car and at a hotel, prosecutors said.The prosecutor said the girl was a San Diego High School student, but is not a special needs student and was not one of Herrera's students."This case involves emotional manipulation by the defendant, who was verbally abusive and coercive towards the victim in this case, who was particularly vulnerable, as (Herrera) took advantage of information he knew about her background and used it to manipulate her," Coto said following his May arraignment.The investigation into Herrera began earlier this year, when the victim's mother reported finding suspicious and concerning text messages from Herrera on the girl's cellphone, SDPD Lt. SALT LAKE CITY, Utah — A Utah family that ordered free coronavirus masks through a state program say they were sent politically-charged face coverings featuring a handgun and a controversial slogan.Christine Passey-Spencer of Rose Park says she ordered the masks through a sate program, "A Mask for Every Utahn." Since April, the campaign has used federal COVID-19 money to purchase more than 2 million masks from local and international manufacturers to limit the spread of the virus."I was just shocked," Passey-Spencer said.The two masks feature an American flag with a handgun printed across the front. The face coverings also feature the slogan "Don't Tread on Me," written below a coiled rattlesnake."I think the thing that bothered me most is that I knew my tax dollars paid for this, and this is very politically-charged speech," Passey-Spencer said.The Gadsden Flag — the inspiration for the snake and "Don't Tread on Me" slogan — was first used in the Revolutionary War. But in recent years, the image has been co-opted by the Tea Party, anti-gun control activists and white supremacists. In 2016, it was deemed to have "racially-tinged" messaging in some contexts by the federal government. More recently, the image has been used by people believing COVID-19 health restrictions take away their constitutional rights."We hope this is an isolated incident; that we just missed these couple of masks," said Ben Hart, who oversees Utah's mask program for the Governor's Office of Economic Development.Hart admits about 100 of the "Don't Tread on Me" masks were included in a shipment last month. Hart says the staff deemed them "inappropriate" and attempted to set all of them aside."We will not be using taxpayer dollars to pay for these masks. SAN DIEGO (CNS) - A former Torrey Pines High School student who posted threats targeting the school on his Instagram account was sentenced Friday to a year in custody, with at least six months to be served at a residential alcohol and mental health treatment facility.Kevin Matlak, 21, pleaded guilty last month to one count of making a criminal threat.Superior Court Judge Polly Shamoon placed Matlak on five years probation and ordered him to stay away from Torrey Pines High and have no contact with three people named in a criminal complaint.RELATED: Former Torrey Pines student faces judge in online threats caseDefense attorney Brian Watkins said Matlak didn't threaten anyone directly, but three former classmates -- whom the defendant didn't know -- read his posts on Instagram and felt threatened by them.The classmates of Matlak's who graduated in 2015 reported the threats to law enforcement on May 30, leading to his arrest."I hate all of you," Matlak wrote in one post, according to Deputy District Attorney Matthew Greco.RELATED: Former Torrey Pines High School student seeking psychiatric help after online threat"Get the (expletive) out of San Diego 2K18 before I find u," the defendant wrote in another post. Matlak also posted a photo of him holding an AR-15 rifle in one hand and giving the middle finger with the other hand, Greco said.The principal of Torrey Pines High School wrote a letter to the court, detailing how the threats impacted him and his assistant principals, knowing that the person making the threats had not been arrested and knowing that they could be in harm's way after they made the decision to keep the school open the next day. 1690
