SAN DIEGO (KGTV) — Holiday Bowl officials said Thursday that its 43rd annual football game will not be played this year.Due to the pandemic, the bowl's Board of Directors voted unanimously to cancel the December game, which has been played since 1978. The bowl’s traditional Bowl Week events had already been canceled for this year, including the Holiday Bowl Parade.Holiday Bowl CEO Mark Neville said that in addition to challenges in holding the game safely for fans, the virus had, "created a situation in that we wouldn’t be able to welcome fans, ultimately resulting in no tourism. Couple that with the financial and potential health risks of trying to play the game during this pandemic and it was clear this was the right decision for us.""This has been the most difficult decision our Board has ever had to make since our bowl game started in 1978," said Neville. "While it’s not the decision we wanted to make, it’s the right decision for our non-profit association and the community for the long term."The game has brought in an average million in economic benefit and led to more than 28,000 hotel room nights annually for the region, the board said. Vista Way was closed over three months ago due to the COVID-19 pandemic, but on Saturday, June 20, guests will be allowed to return.In a press release, officials said, “Boomers Vista will build upon its longstanding commitment to cleanliness and safety by implementing a series of measures following the recommendations of the Centers for Disease Control & Prevention and best practices within the amusement and attractions industries.”The following measures will be in place at the Vista facility:-- The center and mini golf course will operate under limited capacity-- Face coverings/masks required for all guests and staff members; kids under 3 won’t be required to wear face coverings, guests can remove masks when eating-- Employees will be we wearing personal protective equipment such as face shields and gloves-- Six feet of social distancing between parties are required; markers are posted throughout the property, including parking lots and entrances-- Temperature checks will be conducted for all guests and workers upon entry-- Guests and all staff are being asked to frequently wash hands-- Hand sanitizer stations will be located throughout the center-- Staff will carry out frequent sanitization of high-touch surfaces and rides and high-traffic locationsFacility General Manager Garrett Gross said, “The health and safety of our Guests and Team Members continues to be our number one priority as we work to welcome guests back to the Park. SAN DIEGO (KGTV) - Each day that the courts in San Diego are closed, an already daunting case load grows.The closure leaves San Diegans wondering if, and when, they’ll get justice.According to the San Diego Superior Court, “On Tuesday, May 26, the Court will resume many services, though most will be provided remotely. With the community spread of COVID-19 still a concern, in-person services at the courthouses will continue to be limited to urgent needs.” The court said it’s in the process of sending out rescheduling notices to the parties involved in more than 87,000 hearings.To help cut down the backlog in the civil arena, a group of attorneys is working together to ensure San Diegans have an opportunity to have their case either mediated or have their dispute handled. It’s called RESOLVE Law San Diego.“Without some mechanism to try and deal with these cases, like a settlement conference or mediation, there's really no way for a person who's involved in a lawsuit to have their things resolved,” said attorney Benjamin Bunn.“We have in San Diego over a dozen calendar departments, each of those departments has over 1,000 cases assigned to it, and every Friday each of those independent calendar departments have law and motion hearings that involved at least a dozen and usually two dozen or more cases,” explained attorney William Low. “All of those hearings have been put on hold for the last eight weeks. Nothing has been happening to resolve those cases. RESOLVE Law San Diego is specifically targeted to help those litigants resolve those matters sooner rather than later.”RESOLVE Law San Diego will give people involved in civil cases the opportunity to connect with a retired judge or a qualified local attorney who will agree to hear matters free of charge.“If you go to court right now you might not get a hearing date until November, but if you want to use RESOLVE Law, you’re going to have a hearing within the next two weeks,” said attorney Amy Martell.According to the group, it’s not a court-sponsored program; it is both voluntary and by stipulation of the parties only. The program will only last for a set amount of time and is designed to streamline the law and motion and mediation process so that cases can move forward while the court reopens and manages its caseload.So far more than 175 people have signed up to volunteer their time."By the program that we have set up, we have very good lawyers and retired judges volunteering their free time over the next 120 days to help resolve issues and to help get the court system moving again,” said attorney David Casey.The attorneys involved said hearings will be handled over the phone or through teleconferencing, a safe and easy way to communicate during COVID-19.The program aims to give people a little certainty in times that are anything but that."It will help them get justice quicker, sooner, with less frustrations,” said attorney Heather Rosing.According to the RESOLVE Law website, this type of venture is the first of its kind in the state designed to provide civil litigants an alternative and free venue for dispute resolution during this crisis.In a statement to 10News, San Diego Superior Court Presiding Judge Lorna Alksne wrote, “This effort is a great example of San Diego’s lawyers and retired judges coming together to help the community obtain resolutions of their disputes and to help reduce the backlog of cases due to the pandemic.” 3450

SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said.  3412
