SAN DIEGO (KGTV) — The downtown building at 101 Ash Street has been sitting vacant for most of the last four years and as it continues to sit empty, taxpayers are footing the ,000 per day bill.City Council leaders voted 5-4 — with Council members Vivian Moreno, Monica Montgomery, Barbara Bry, and Georgette Gómezto voting in opposition — to request monthly updates on the building's status and costs for several options presented by Mayor Kevin Faulconer's office.The mayor's options included putting millions of dollars more into the building for the needed repairs, buying out the lease, pursue a new landlord, trying to renegotiate its lease, or walking away entirely, the last of which could risk litigation and credit damage.The coronavirus pandemic has cleared out office buildings across downtown San Diego. But emptiness is business as usual for the old Sempra building at 101 Ash.In 2016, the city approved a lease-to-own agreement for the building, valued at million. The idea was to move upwards of 1,100 city employees into the facility.But officials quickly discovered a series of problems requiring major renovations to the site's 19 floors.In December 2019, the city finally began moving workers into the building, only to vacate them a month later when the county found traces of asbestos.So how did the city get into this mess? A new investigation shows it really never did its homework for such a big purchase from the start.The law firm Hugo Parker found that, "at no time, however, did the city formally inspect 101 Ash before closing escrow."In January, councilmember Barbara Bry showed ABC 10News a document that the city accepted the property as is."That is stupid to do when you are doing a long-term lease purchase on a building that was built in the 1960s," Bry said.An additional new report from Kitchell says the building needs 5 million of repairs, which is well more than what the city paid for it. 1947

SAN DIEGO (KGTV) -- The man accused of shooting two people outside a Metallica concert in the Gaslamp, including an off-duty sheriff’s deputy was back in court Tuesday.In July Ray Pitoau had his first trial. He was found guilty of three firearm charges, including felon in possession of a gun.The jury deadlocked when charging him with three counts of assault with a deadly weapon. The District Attorney’s Office refiled for a retrial.RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffA few months later that retrial is in session and Pitoau now faces potential life in prison for allegedly shooting sheriff’s deputy Jason Philpot three times, aiming the gun at his brother, Joshua Philpot and shooting and hitting a third person walking by.During his testimony Tuesday, Pitoau tells the jury he didn’t intent on actually firing the gun. "When I see the gun it was like okay you know what I mean, just show it to these guys. It be like okay split parts, I run this way they run that way. It be cool," Pitoau said.Pitoau was asked by the defense attorney and prosecutor to recollect the night of August 7, 2017. The night he got into an altercation with the Philpot brothers and it ended in shots fired.RELATED: Suspect in Gaslamp shooting that injured off-duty deputy arrested in MexicoWhen Pitoau grabbed the gun from his friend that night he tells the jurors he didn’t think Jason Philpot in law enforcement and would know how to remove a gun from a shooter.“I had it in my right hand his left hand cam over my hand and his right hand came under my hand,” Pitoau continued. “So he grabbed the whole thing like he close don it so he started twisting my wrist." Pitoau went over the entire night and even included details of fleeing the country after he saw the shooting on the news the next morning. “I took off to Mexico, well I cut my hair, shaved my beard and then I walked to the trolley station and went to Mexico."After a month in Tijuana he was brought back to the United States and immediately handed over to U.S. Marshals. SAN DIEGO (KGTV) - The Coronado Police Department released an image Monday of a vehicle that may be related to BB gun incidents in Coronado Sunday. 10news has learned five people were struck in the downtown area. Police spent the morning scouring the ground near State Street and West Broadway. An officer told 10news four people were crossing State Street late Saturday night or early Sunday evening when three of them were hit. The extent of their injuries are unknown. At the corner of L Street and Sixth Avenue in the East Village, a woman was shot in the arm early Sunday morning, according to San Diego Police. She was walking in a small group and one of the men was an exhibitor at Comic Con, staying at the Omni Hotel, where they were headed before the shooting. The early morning shooting was not the only one that occurred overnight. In National City and Paradise Hills, at least a dozen cars were hit, and in Coronado, police said at least 23 businesses, homes an cars were struck by BBs.10news brought the image of a white sedan released by Coronado Police to Roman Beck, who has worked as an accident reconstruction expert for two decades."I believe it's a 2005 to 2010 Chrysler 300 sedan. SAN DIEGO (KGTV) - Surveillance video from a Clairemont church shows a woman with a gun in one hand and her baby in the other, prosecutors said.The video was played in court Friday as the preliminary hearing started for Anna Conkey.Conkey is accused of walking into Sunday services at Church Tsidkenu in April and making threats while holding her 10-month-old son.Pastor Benjamin Wisan testified Conkey pointed the gun at parishioners and her own baby. Wisan was on stage and tried to calm everyone by telling them the weapon was a Taser. A 911 call prosecutors say Conkey made to report herself was played for the jury."Hi, yes, there's a woman at a church and she's saying she's going to blow up the foundation of the church,” said the person in the 911 call. RELATED: Woman tackled to the ground after showing up at San Diego church with handgunChurchgoers tackled Conkey and held her until officers arrived. The baby was not injured. Police later determined the weapon was not loaded. Wisan said Conkey had disrupted services weeks before the incident. He had tried to set up a meeting with her but it did not happen. Conkey pleaded not guilty to several felony counts including child abuse, making criminal threats, and a false report of a bomb. A judge will determined if the case will go to trial. 1312

SAN DIEGO (KGTV) - The city updated the Sherman Heights community and surrounding neighborhoods Wednesday evening, about the transitional homeless storage facility that's set to open.  The facility is scheduled to open at the corner of the Commerical and 20th Streets on June 13.  It's been a controversial project from the beginning. The storage facility will hold 500 units for homeless people to store their things while they look for work and get back on their feet.  RELATED:  514
