SAN DIEGO (KGTV) — Wednesday a preliminary hearing began for a man accused of aiming a loaded gun at off-duty San Diego Police officers at a Mission Valley bar parking lot last November.A San Diego Superior Court Judge listened to testimony from officers in case involving the defendant Jonathan Felix. The incident happened outside of McGreggor’s Bar and Grill on Nov. 7, 2018.Wednesday, officer Jonathan Rodriquez was the first witness on the stand. Rodriguez said he had a few beers after work with coworkers that night. He said Felix was sitting about 20 feet away from the off-duty officers.Once the bar was closing they all walked out into the parking lot.RELATED: San Diego man says off-duty SDPD officers assaulted himRodriguez claims he saw Felix looking into his car or looking at his car. He said after that he and the other officers watched Felix go to his own car.“The defendant got a bicycle out of his car, I thought it was strange and he left,” said Rodrigues. “After he left he came back a second time.”Felix claims he lives nearby and uses the parking lot at that shopping center because parking is limited at his apartment complex. Rodriguez says an off-duty officer then walked over to Felix and had an “innocent conversation." He said Felix asked the officers if they’d like to smoke, but they all denied him. Rodriguez decided he did not feel comfortable being there, and says he left in his own vehicle.After that, surveillance video shows what transpired.Felix is seen having interactions with the other off-duty officers, and then he’s seen holding a gun.The officers began beating Felix, leaving him with a bloody head, several lacerations and bruises. He was arrested that night. Second on the stand was officer Andrew Duncan. He was one of the officers involved in the fight. He claims they walked out of the bar and saw Felix acting strange. Duncan says Felix left and came back saying the other officers threatened to beat him. Duncan went on to testify that's when Felix showed his gun. Then, Duncan said, all 4 officers pointed their gun at Felix then tackled him. They say they were wrestling with him to get the gun away. Tasha Williamson with Building Justice says Felix shouldn't be facing these charges, but that the officers should face assault charges because Felix wasn't doing anything wrong that night. Williamson says the officers were off-duty and should have left Felix alone.Felix is charged with two felony weapons charges for being a felon in possession of a firearm and ammunition. He’s also charged with and a misdemeanor drug charge for being in possession of a controlled substance.Before the preliminary hearing started his lawyer, Alicia Freeze, spoke outside of the courtroom.“Uniquely and I think very creatively, my client is not being charged with brandishing a weapon, he’s not being charged with assault with a deadly weapon, he’s not being charged with a lot of the initial charges he was booked under,” she said.On Jan. 4 the San Diego Police Department issued the following statement: “The San Diego Police Department submitted a criminal case to the District Attorney's Office regarding this incident, in which Mr. Felix pulled a gun on four off-duty police officers. He has been charged with unlawful possession of a firearm, unlawful possession of ammunition, and possession of a controlled substance. Mr. Felix is entitled to the presumption of innocence and the full facts of this case will be litigated as the criminal case proceeds. As in any situation where there are allegations of misconduct, the San Diego Police Department has initiated an internal investigation. If found, any misconduct will be handled accordingly.”At the end of this preliminary hearing a judge will decide if there’s enough evidence for the case to move to trial. If the case goes to trial and Felix is found guilty and convicted, his lawyer says he could be looking at one to two years in prison.Several supporters of Felix showed up to court today and plan to have a press conference following the hearing. 4063

SAN DIEGO (KGTV)- A splash of color brings life back to Bay Park Elementary. Over the weekend, parents and volunteers joined together to give the school a facelift. The beautification project now has kids excited to come to school. “They were just blown away,” says Emily Auer. “Their face just lit up. They actually touched the walls.”Bay Park Elementary is approaching it’s the 80th anniversary. The school’s beautification team brought together almost 80 volunteers. The project started Friday night until late Sunday afternoon. Volunteers painted the walls and wooden backpack holders. Parents tell 10News one family donated a bunch of small desks with chairs that now sit in the halls. Behr gave the paint for the project. “Such a wonderful group of kids, so positive,” says parent Erica Krystek. “We really wanted that positivity reflected in the hallways.”The Bay Park Elementary Beautification Team plans to do more upgrades in the future. They hope to paint and add new carpet to the school’s auditorium. 1022

SAN DIEGO (KGTV) — A homeowner woke up in her Del Cerro home and realized a burglar had been in her room, stealing from her.Just off College Avenue, Kathleen Wavra was sleeping in last Monday morning. Feeling sick, she had taken medication with a sleep aid. Wavra, who is deaf in one ear, was sleeping on her "good ear."She says something jolted her out of sleep around 9:30 a.m.MAP: Track crime happening in your neighborhood"Startled and stood up and looked immediately at my dresser and saw the missing jewelry boxes," said Wavra.All three jewelry boxes were gone. A panicked Wavra quickly found this: Her front door open with the locks and wood splinters on the ground. The wooden door is about 25 years old.Police believe the intruder either kicked or shoved his way in. SAN DIEGO (KGTV) – With just hours until Election Day, several local law enforcement agencies are already on high-alert in the event that large demonstrations arise."We are comfortable with the staffing level we have for [Tuesday] and into the weekend,” SDPD Lieutenant Shawn Takeuchi told ABC10 News on Monday and added, “We're monitoring social media and any information available to the public about any groups that are planning to protest or celebrate.” He said San Diego Police Department is well prepared for any potential unrest although officers have no credible knowledge of plans for it. On Tuesday, SDPD will open its Department Operations Center (DOC) which is only activated during major events as a hub to filter and disseminate intelligence. “We are not fully staffing the DOC. We are putting it on a monitoring status [and] we feel that's prudent given the climate that we're in,” he added.“I think anxieties are very high all over the country,” San Diego County Sheriff Bill Gore told ABC10 News on Monday. He said that his Department will be adequately staffed. “We fully respect everyone's right to peacefully demonstrate [and] to express their first amendment rights. However, when those peaceful demonstrations cross that line into criminal activity, deputy sheriffs and local law enforcement will be ready to act to keep everybody in the crowd safe so that they can express their legitimate first amendment rights,” he added.On Monday, California Highway Patrol told ABC10 News that its officers are being moved to 12 hour shifts. A statement reads, “The protection of state of California properties, including state buildings and state highways, is the primary responsibility and jurisdiction of the CHP. As a statewide law enforcement agency, the CHP has officers available to respond to any incident or a request for assistance by an allied agency through the mutual aid process anywhere in California. As for the days leading up to election day, if a community member receives threats or intimidation intended to affect their vote, they are encouraged to give us a call. SAN DIEGO (KGTV) - A local Marine's dreams are close to becoming a reality in the form of a massive property in Dulzura. It is not just for Kalani Creutzberg. His efforts to help others prompted an Animal Planet star to join the cause. Nate Schoemer was also a Marine. He was fresh out of high school with his blood type on his boots when he joined the invasion of Iraq.  "The first group was out there for three days and when they came back you could tell that they've just been through hell," Schoemer said. "This is hard for me to talk about," he said with tears in his eyes. It is especially hard to him to discuss it with civilians who often cannot comprehend the horrors of war. He lost some friends on that deployment in 2003."I could hear it from where I was," he started. "I mean I could hear them screaming," It haunted his heart on home soil., but he said his dog's love lifted his spirits. "I need to continue on this mission and helping others the way she helped me," he added.When he got out of the service he became a master dog trainer. He went on to host an Animal Planet show called "Rescue Dog to Super Dog". In it, he saved shelter dogs and turned them into service dogs for people in need. In episode one, he trained Bas for Creutzberg, which is how the two met. Creutzberg survived chilling deployments, but the fight for his life followed him home. "Before I knew it I was homeless," Creutzberg explained. "It was embarrassing, it was shameful," Bas gave him a sense of purpose. "When I was going there to rescue him he was actually the one rescuing me," Creutzberg added. Now, he is on a mission to give homeless vets a home. He plans to buy a property that is nearly 300 acres in Dulzura. "We're going to run our day to day operations very much like when we were back in the service," he explained. "There will be structure, we will work together…… the very things that a lot of us miss."It does not end there.  They will also rescue homeless dogs  about to be euthanized."[We'll] allow both the veterans and the dogs to grow relationships and start anew," he said. Schoemer believed in the Cammies and Canines Sanctuary so much, he joined the efforts. He plans to turn some of the dogs on death row into service dogs for vets. "Just being around Marines and veterans is a great thing,"  Schoemer said with a big grin. Their goal is to get back to tackling battles together.
