PHILADELPHIA (AP) — Bill Cosby's lawyers are arguing in a new appeals filing that it was “fundamentally unfair” to let prosecutors use Cosby's damaging deposition from a sex accuser's lawsuit against him at trial. Job Wallace, 20, was last seen leaving a friend's house in Surprise, Arizona, between 8:30 and 9 p.m. Monday, his mother, Stacy Wallace, said. He loves the Marines, was recently promoted and was excited to get back to Pendleton after a three-day leave that took him home to the suburbs west of Phoenix and a camping trip. "He got into several colleges and missed scholarship opportunities just so that he could be a Marine, because he felt it was his duty to serve his country," Wallace said. Wallace said law enforcement officials told her that her son's phone was last pinged Monday night in Arizona. But a Border Patrol camera spotted his truck the next morning traveling eastbound on Interstate 10 near Fort Hancock, Texas, southeast of El Paso. A Surprise police spokesman says officers took a report and have turned the matter over to the Naval Criminal Investigative Service. "NCIS and our partners are working diligently to locate Lance Cpl. Wallace and bring him home safely," Kurt Thomas, special agent in charge of the NCIS Marine Corps West Field Office, said in a statement. (KGTV) - A Pine Valley restaurant owner is defying San Diego County orders to move his restaurant outside, saying he will continue to ignore the purple tier rules to keep his business afloat.When it was announced that San Diego County would move into the more restrictive purple tier, Major’s Diner owner Larry McNamer told ABC 10News he had plans to stay open inside, even though all restaurants are required to move outside completely. He stayed true to his word, operating indoors, saying he still follows social distancing practices, but needs the inside space because his restaurant is only open for breakfast and lunch, and the winter months bring temperatures in the 30s for the mountain community.“They’re saying they wanted us back outside and we said no absolutely not, not going to do it,” said McNamer.RELATED: "We are over it." Pizza Hut has teamed up with an educational non-profit to launch a series of antiracism resources for educators.On Wednesday, the pizza company announced they were partnering with First Book on the initiative Empowering Educators, which will provide books, videos, and activities for educators to use when talking about race.The initiative was created after First Book surveyed teachers in 2019 and found that 66% wanted to find a way to talk about racism with students, but didn't feel comfortable doing so.“From the neighborhood to the national level, America is on a critical journey: from identifying racism, to deeper understanding – and finally to dismantling systemic racism,” said Kyle Zimmer, president, CEO and co-founder of First Book in the press release. “To support this journey, First Book is honored to partner with Pizza Hut to launch an unprecedented effort to empower educators – and the children they serve.
