SAN DIEGO (KGTV) – A new public service announcement produced by the California Highway Patrol focuses on the deaths of a Valley Center family in a 2017 DUI-related crash and its impact on an officer and his niece, the lone survivor of the tragedy.In November 2017, the Latulippe family were traveling in Austin, Texas, when a drunken driver crashed into their vehicle.Scott Latulippe, his wife Nancy, and their 14-year-old son Jackson died in the wreck. I’m filling in."The CHP’s documentary-style PSA, titled “Falling,” tells the story of the Latulippe family, but it also shows the dramatic effects DUI can have on people’s lives.Officer Latulippe said, “DUI is a constant issue that is not going away … DUI is a choice. DUI is completely preventable.”He tells ABC 10News that his goal is to make someone stop and think before drinking and driving."Have a plan," he said. SAN DIEGO (KGTV) — A man who neighbors say was acting erratically in the Middletown neighborhood on Sunday was pronounced dead shortly after police arrived and found him lying in the street.San Diego Police officers received numerous calls regarding a man screaming, vandalizing a vehicle, and stripping his clothes off at Columbia Street near Sassafras St. just after 12:30 p.m. Police said officers arrived and were directed to the man, who was lying down in the street. Officers placed the man in handcuffs but noticed he was in medical distress. They took the handcuffs off the man and began CPR, police say. A witness who was a doctor also helped perform CPR until San Diego Fire-Rescue arrived, but the man died at the scene, according to SDPD.The man was not identified by name, but police said he was a black male in his mid-thirties.SDPD homicide detectives are investigating the death out of "an abundance of caution," police said. SAN DIEGO (KGTV) - A homeowner in Clairemont hopes surveillance video is the key to tracking down the intruder who climbed straight through his window, before making off with some family heirlooms.Just off Balboa Avenue around 1:30 p.m. Monday, a man is seen ringing the doorbell at the home of Jeff Howell. After minutes of ringing and knocking, the man is recorded heading for the backyard, where he peers into the patio door and grabs a chair. He then pries open a locked window, steps onto the chair and into the home.MAP: Track crime happening in your neighborhood"Just a sense of violation," said Howell.The man is then seen on the phone, possibly with a lookout."You can hear him discussing 'it's safe now' or 'somebody just went by,'" said Howell.Moments later, the man heads straight for the bedroom closet, dragging out a small safe, before carrying it out the front door.By the time Howell saw his text alert, the intruder was gone. The man was in the home for about 15 minutes. Inside the safe: authentication documents for artwork and family heirlooms belonging to his 11-year-old son, including a silver spoon given to him at birth and something from his rodeo-competing great-grandfather, who has passed."He had a prize-winning, silver belt buckle. SAN DIEGO (KGTV) -- A restaurant and dollar store were damaged Sunday morning after a fire started in Lincoln Park.The fire started inside the Herencias Mexican Food restaurant around 6 a.m. on the 5000 block of Logan Avenue.Crews arrived on scene and the fire was knocked out by 8 a.m.No one was inside the restaurant at the time of the blaze, but fire crews say a neighboring Family Dollar store was damaged.The cause of the fire is under investigation. 463

  

SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. His first trial ended in a mistrial. 1695
