SAN DIEGO (KGTV) — For the first time in 40 days, San Diego County has fallen below the state's County Monitoring List threshold for coronavirus case rate.San Diego County was placed on the list on July 3 after it crossed the state metric of 100 cases per 100,000 people over 14 days. Wednesday, the county reported a case rate of 94.1.The county will have to remain off the watch list for another three days to get off California's watch list and an additional 14 days in order for local schools grades 7th through 12th can return to in-person instruction.No other businesses are slated to be allowed to reopen after that 17-day window unless the state provides more guidance for business reopenings, according to the county.San Diego County reported 236 new COVID-19 cases on Wednesday, a 3% positive rate out of 7,339 reported tests. Six new deaths were also reported, including five women and one man who died between July 28 and Aug. 11. All of the victims had underlying conditions, county officials said.The county also reported two new community outbreaks, one in a grocery setting and one in a manufacturing setting.While the county's case rate has fallen, it continues to be high above its community outbreak threshold of seven in seven days. Currently, the county has 26 community outbreaks in a week. A community outbreak is three or more coronavirus cases in the same setting in people of different households in the past two weeks.Supervisor Nathan Fletcher said of the drop in the county's case rate: "San Diegans should be proud of the progress we have made, but we have to recognize the goal is not just to get our cases down, it is to keep them down. We’ve seen progress because of a renewed focus and vigilance, and we need that same focus going forward." 1782

SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights.The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses.All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis.He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. She explained that businesses that would be impacted the most by purple tier restrictions, like restaurants and gyms, are not the cause for the local increase in COVID-19 cases.The lawsuit said despite the data provided by Dr. Wooten, the CDPH still denied the request without any justification based on science or data.Both the law firm that filed the lawsuit and the County of San Diego refused to comment on this matter, stating they do not comment on pending litigation. 2646

SAN DIEGO (KGTV) -- Father Joe's Villages hosted two Thanksgiving meal services Wednesday for homeless residents in San Diego, but perhaps no one was more thankful than the people who helped prepare the food.Three chefs-in-training in the Father Joe’s Culinary Arts Program spent days preparing the turkey dinner, which was served to an estimated 2,300 to 2,600 people.“They changed my life by far,” student Brian Anziano said of Father Joe’s.Anziano said he got involved in “stupid stuff” last year that left him homeless, but at the suggestion of friend, he began turning his life around with the help of Father Joe’s.Anziano enrolled in the 15-week culinary course, considered the most rigorous of the 10 workforce development programs offered by Father Joe’s.“They buy your shoes, they buy your pants, they buy your uniform,” he said. “Everything you need.”The massive Thanksgiving meal is kind of like a midterm, said Culinary Arts Program instructor chef Theresa Fields.“We work 14 hour days, 16 hour days. We’re always on call,” said student Lister Lane with a smile.Lane said his dream is to graduate and open his own restaurant. “And I want to give back to the homeless like they helped me,” he said.Past graduates have gone from these kitchens to jobs at Kansas City Barbeque, PETCO Park, the Hard Rock Hotel, Amplified Ale Works and more, FIelds said.Father Joe’s said about 80 students have graduated from its various workforce training programs so far, and they’re on pace to graduate about 100 students by the end of the year. New programs, including one in hydroponics, are planned for next year. 1620

  

SAN DIEGO (KGTV) -- Democrat Ammar-Campa Najjar and Republican Darrell Issa have emerged as the favorites to represent East County's 50th Congressional District, according to a scientific poll released Tuesday. The 10News/Union-Tribune scientific poll comes one week before the March primary, in which voters will head to the polls for the first time since Republican Congressman Duncan Hunter resigned in January after pleading guilty to one count of felony campaign fraud. The poll, of 552 likely voters, shows Campa-Najjar, the lone household Democrat, leading the field with 35 percent of the vote. Former Congressman Issa, a Republican, comes in second with 21 percent, with former San Diego City Councilman Carl DeMaio at 15 percent. The poll had 12 percent undecided and State Sen. Brian Jones, a Republican, at 7 percent. 837
