(KGTV) - A new California law could let convicted killers out of prison, and San Diego County's district attorney said her office will fight it on a case-by-case basis.Senate Bill 1437 passed the state Legislature last year and went into effect on January 1. It narrows the definition of murder so that only people who are involved in a killing can be charged with that crime.Before the law, accomplices in a killing could also have been charged with murder."It may let murderers go free, because of how far it goes," said San Diego County District Attorney Summer Stephan.Stephan said her office will challenge some re-sentencing hearings based on the new law, although she said they don't know how many there will be.One possible case involves Kurese Bell, who He as convicted of murder in 2016 for his role in the robbery of a North Park marijuana dispensary.During the robbery, Bell and another man, Marlon Thomas, got into a shootout with a security guard at the dispensary. The guard shot and killed Thomas.The DA's office argued that Bell should face murder charges because his actions in the robbery led to the shootout and, ultimately, Thomas' death.Bell is currently serving a 65-year-to-life sentence.Stephan said criminals need to be held accountable for the crimes they commit and cause."It's really important that each offender is held culpable at the right level," she said. "That's what justice is about."Supporters of the new law say it is a vital part of California's efforts at criminal justice reform. They say the old law unfairly targeted young minorities.On its website, the group Restore California says the new law makes sentencing in California more "equitable." They also say it gives accomplices an incentive to cooperate with investigators."In a co-defendant felony murder case, co-defendants who were not the actual killers, who did not aid and abet the killing, or who did not act with reckless indifference to human life will now have an incentive to talk and tell the truth about what happened," the website reads. 2073

SAN DIEGO, Calif. (KGTV) -- A 64-year-old man is recovering after he was beaten in Kearny Mesa by a group of street racers so severely he had a brain bleed and fractured disk. "I felt my RV jostling around, like maybe they were standing on my bumper, so I got out and went around back to look and I look up and someone's standing on my RV," said the victim, who did not wish to be identified.Police said the beating happened on June 28 around 9:30 p.m. A group of street racers arrived in the area for an apparent “meet up” and gathered into a large group. Multiple vehicles arrived at the location and began doing “burn-outs” in the street. Some members of the group climbed on top of the victim’s RV. When the victim walked out of his vehicle to confront them, three of the men attacked him. Another man stole the man's phone from his pocket as he was lying on the ground unconscious. "The last thing I remember is one of his buddies jumping out and I don’t know what happened after that; I probably got hit from behind."The suspects fled the area in a grey, possibly 2003 Audi A4 sedan. The man was left lying in the street. Employees from a nearby business ran out to help him and called an ambulance. San Diego County Crime Stoppers along with investigators from the San Diego Police Department’s Eastern Division are asking for the public’s help in identifying and locating the attackers. Officers are investigating the attack as a felony battery and robbery case.Anyone with information on the identity or location of the suspects is asked to call SDPD’s Eastern Division at 858-495-7957 or the Crime Stoppers anonymous tip line at 888-580-8477. Crime Stoppers is offering up to a ,000 reward to anyone with information that leads to an arrest in this case. 1775

  

SAN DIEGO (KGTV) -The San Diego City College men's basketball team is looking to make it back to back California JUCO state titles.After winning the state title a year ago, the Knights are 28 - 2 this season. The players are not surprised at all their success the last two years, as they say head coach Mitch Charlens has them believing in themselves and very confident.San Diego City College is a rags to riches story. When coach Charlens took over the program 14 years ago, they did not have many players, no uniforms, and not a real gym to practice in.If they can win another California state JUCO title, they would become the first team to go back to back in over 60 years. 685

  

SAN DIEGO, Calif. (KGTV) - As protesters gather across the country to spread the message that black lives matter and there is a problem of police brutality against black people, not everyone is ready to join in the marches, but there are other ways to help the combat racism. “To make change, to build a movement, it takes all sorts of action. Everyone doesn’t need to go in the streets,” said Dayo Gore, UCSD Associate Professor in Ethnic Studies and Critical Gender Studies. While many have said they want change both verbally and through social media, she said people of color want that support to be taken to the next level. “This is not enough, your apology is not enough, feeling sorry is not enough, feeling my pain is not enough, I need some actual real change,” she said. To get that real change, people can use their voting powers to elect officials who will be an advocate, which is a point President Obama made in a publication addressing how people can make a difference in combating racism. He also noted that when making demands for officials, be specific with what you’re asking so it’s harder to ignore. Gore emphasized that point, citing specific examples of room for change in the San Diego community. She suggested a community review board that’s independent of the police department to review activity and oversee actions taken by police. She also said funding within the police department could be reevaluated. “Funding other things that will make communities more viable and able to survive, instead of simply policing communities,” said Gore. She also said in order to help get rid of racism, it’s important to first acknowledge there is an issue and educate yourself. “It starts with understanding what the problem is, and then figuring out where you best can raise your voice,” she said. She said another active step to take is speaking up among peers if someone says something racist, even if it’s uncomfortable. “When you’re hanging out with friends, do you say something when people say things racist or make assumptions based off the color of their skin?” she questioned. Gore also suggested people find groups in the community to both follow and support financially. Below is a list of suggestions of groups to research and support provided by Gore, which she said was created by another UCSD faculty member.
