SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. But Tamburino said it would be hard for regulators to enforce.Malls and stores could hire Santas directly as independent contractors, Gonzalez’ office noted, since that kind of relationship passes AB-5’s three-pronged test.To do so, Tamburino said he would have to form his own LLC and said he doesn’t have the experience to run his own business.Tamburino said he would begin reaching out to other Santa-booking agencies in hopes they will hire him as an employee, but there’s a lot at stake: he receives about half of his annual income from Santa jobs. 1938

Dr. Watanbe is a radiologist, and the Chief Medical Officer for CureMetrix, an artificial intelligence (AI) technology company focused on early breast cancer detection.Their FDA-cleared software is able to learn, using millions of mammograms, to identify, mark, and score anomalies. "Cancers that were missed by a radiologist were detected by the machine, some of them weren't even small, sometimes they were just obscured by dense tissue," said Dr. Watanabe.She says the technology has found breast cancer up to five years earlier than it was found by the human radiologist. "It may detect features on mammograms the human eye can't detect," said Watanabe.The technology is already being used by doctors around the world and is also available to anyone with internet access.Women can pay 9 to get their own CureMetrix second opinion by uploading their mammogram to the online portal DocPanel.Dr. Watanabe says the software is not meant to replace humans but rather help them do their job better.San Diego resident Amanda Caniglia says the technology gave her peace of mind. "As a woman and going for my first mammogram and knowing the family history, there is a lot of anxiety going into it, you don't know what to expect," said Caniglia.While Caniglia's initial mammogram results came back normal, she wanted a second opinion because of her family history of cysts, tumors, and cancer. When the CureMetrix results also came back as normal, it was a huge relief. "it really lowered my anxiety and gave me peace of mind because I was able to know I'm good to go, I'm cancer-free."The technology is lowering the number of false positives and catching cancer earlier, giving more women the chance to find a cure in time. 1846

SAN DIEGO (KGTV) – Authorities are searching for a person suspected of starting a trash can fire that scorched the side of a Normal Heights home early Thursday morning.At around 2 a.m., San Diego Fire-Rescue crews were called to the 3300 block of Meade Avenue in response to a trash can on fire next to a house.Some residents told ABC 10News they heard noises at the trash cans and the saw a fire begin to ignite.Screams from residents apparently scared off a person believed to have sparked the blaze.As fire crews arrived, flames from the trash can burned the side of one house. The fire was quickly knocked down before it could engulf the entire home.ABC 10News learned one person was displaced due to the fire; no injuries were reported.A description of the person suspected of starting the fire was not immediately available.Arson investigators are involved in the fire probe. 889

SAN DIEGO (KGTV) — As former San Diego State star Kawhi Leonard readies for his Los Angeles Clippers debut Tuesday, another Aztec will also start the season on an active NBA roster.SDSU's Jalen McDaniels was signed to a multi-year contract and placed on the 17-man roster for the Charlotte Hornets Sunday, the team announced. McDaniels left SDSU after his sophomore season last spring and was picked 52nd overall in the 2019 NBA Draft.The 6-10 forward led the Aztecs in rebound average, total steals, and was second in scoring average last season. McDaniels signed with the Hornets on Oct. 10 under an unguaranteed Exhibit 10 contract, before the team converted it to a two-way contract on Saturday — meaning he could go back and forth between Charlotte's G League-affiliate, Greensboro Swarm, and the NBA. McDaniels participated in two preseason games with the Hornets, averaging 1.0 points and 0.5 rebounds in 5.3 minutes per game, according to the team.Sunday, the team bolstered his contract to a three-year, partially guaranteed contract ahead of the season opener. SAN DIEGO (KGTV) -- As the nation continues to process what happened during the first presidential debate, many are expressing frustration about what didn’t happen.Local and national Latino American leaders are calling out the moderator and the candidates for making no mention of the millions of Latinos in the country.Just moments after the debate ended Tuesday night, organizations like the National Association of Hispanic Journalists shared a series of tweets highlighting that Latinos were not mentioned during the debate.According to the Pew Research Center, more than 32 million Latino voters are eligible to vote in November.Voters like Denisse Roldan Newell wanted to hear more from both candidates about their policies on a range of issues.“It's not just immigration, it's not just the border wall, it's having to do with economics, with smalls business development, with affordable health care, with education,” said Roldan Newell.Roberto Alcantar with the Chicano Federation told ABC 10News it was concerning that the candidates made no mention about COVID-19 and it’s disproportionate affect on the Latino community.In San Diego, Latinos make up 34% of the population but 65% of COVID-19 cases."These are not just Latino issues, these are issues for all of us as American. While, yes, we are Latinos, we are American and our issues are America’s issues," said Alcantar.
