SAN DIEGO (KGTV) - A Chula Vista woman is keeping vigil after her parents holiday vacation turned into nightmare, when both become sick with COVID-19.Jose and Gloria Arellano had a dilemma. Their daughter Joselyn says they had airfare credits from a postponed trip to southern Mexico but the deadline to use the credits was about the run out."They had their trip postpone the trip two or three times. They didn't want to lose the money, so they decided to go this time.On November 11, they flew out from Tijuana to Oaxaca for a two-week vacation. Apprehensive about rising COVID-19 rates, they went prepared with goggles and masks. Gloria also had a face shield. Once there, they did a little sightseeing. When they were near anybody, they wore masks."Their main thing is to try food. They were mostly at restaurants. They were also at the beach a lot," said Joselyn.About six days into their trip, Jose, 56, became sick."For him, it was coughing. He has asthma, and it just got into his lungs," said Joselyn.A few days later, Gloria, 54, also became ill. They went to a local hospital, received COVID-19 tests, and tested positive. Jose got sicker and the family contracted at air ambulance to fly him back to San Diego two days before Thanksgiving.Jose, a former investigator with the San Diego County District Attorney's Office and former Navy, is being treated at the VA Medical Center in La Jolla."He's been stabile, on a ventilator and taking antibiotics," said Joselyn.Joselyn calls her father's situation a helpless waiting game. Her mother ended up in a hospital in Oaxaca, intubated for several days, before being released Monday. Right now, she's quarantining at an Airbnb in Oaxaca."It's a vacation, for them, they’ll regret forever," said Joselyn.Joselyn is trying to stay optimistic with so much uncertainty about her father. She is certain about one thing. There will be no vacations in her family's near future."It's not worth it. It's not worth the risk," said Joselyn.Joselyn's brother flew to Oaxaca to help their mother. SAN DIEGO (KGTV) - A former Yuma Police officer testified Tuesday in his trial for the rape of a woman in Kensington.Jared Elkins, 34, raped his wife’s cousin after a family gathering at her home on Marlborough Drive last year, prosecutors said. The group had been out to dinner, then watched a movie while drinking beer and wine at home.She testified last week, saying she didn’t yell during the alleged attack because Elkins threatened to kill her. His wife was asleep across the hall at the time.After the encounter, the woman said she ran into her mother’s room for help, and they both escaped out a window.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Police said Elkins told them that the sex was consensual and the rape charges were made out of guilt.Elkins told the jury the alleged victim started flirting with him after everyone else went to sleep.“There was mutual flirtations between the two of us and we were being adults,” said Elkins, who testified the woman was “cuddling, almost snuggling” with him.“She said yeah, it was surprising to me; I was excited a younger attractive woman, you know, it kind of confirmed everything on the couch,” Elkins said.Elkins resigned from the Yuma Police Department in 2017. He is facing nine felony counts including forcible rape and could serve 14 years in prison if convicted.City News Service contributed to this report. 1462

SAN DIEGO (KGTV) — A former San Diego Sheriff's Department Captain accused of operating an illegal firearms trafficking business was arrested Friday.Former SDSO Capt. Marco Garmo is accused of operating the illegal firearms trafficking business, at times from his office at Rancho San Diego Station, authorities say. The indictment also accuses a fellow Sheriff's deputy, Lt. Fred Magana, prominent San Diego jeweler Leo Hamel, firearms dealer Giovanni Tilotta, and El Cajon resident Waiel Anton with aiding the Captain's business.Officials say Garmo was operating the illegal business during his entire tenure as Captain at the Rancho San Diego Station. The 27-year veteran of the department, who retired in September, is accused of beginning the business for profit and to gain future donors for an anticipated campaign for San Diego County Sheriff.RELATED: San Diego Sheriff's captain on leave during criminal investigationFriday morning, Magana and Hamel both plead guilty to charges including engaging in the business of dealing in firearms without a license, false statement in acquisition of a firearm, and conducting firearms transaction in violation of state law.Both admitted to aiding Garmo's business by making "straw purchases" of firearms, or purchases of firearms on behalf of someone else. The pair also admitted to creating false records to conceal those purchases, and offering to promote Garmo's weapons. As part of his plea, Hamel admitted to buying a variety of handguns from Garmo and making purchases in which Garmo would falsely report that he had acquired the guns for himself, not Hamel. The local jeweler also admitted to acquiring several firearms from Garmo without proper documentation and planning a false paper trail.Hamel must forfeit more than 200 firearms and 100,000 rounds of ammunition seized during a February 2019 raid.RELATED: FBI, ATF raid home, businesses of prominent San Diego jeweler Leo HamelMagana admitted to straw purchasing a pair of "off-roster" firearms, which are guns made available for law enforcement but not the public, for Hamel at Garmo's direction and advertising Garmo's firearms to potential customers.Officials say Anton helped buyers apply for concealed carry permits as part of his "consulting" business and received money to give buyers early appointments and avoid the backlog of other applicants. Anton is charged with also giving "kickbacks" to Garmo for referrals.Investigators accuse Tilotta, the owner of Honey Badger Firearms, with organizing Garmo's straw purchases and submitting false firearms records. Friday's indictment also accused Tilotta of selling and transferring guns inside Garmo's Rancho San Diego office.RELATED: Drug cartels recruiting children as young as 11 for smuggling, officials warnMany of Garmo's gun transactions included buying and reselling off roster handguns. While law enforcement officers are allowed to resell off roster guns in certain instances, Garmo was reportedly warned by the ATF that excessive resales for profit could violate federal law. Officials say Garmo acquired about 146 firearms between March 2013 and February 2019 and sold or transferred 104 of them.Investigators also accused Garmo of lying about tipping off a cousin, who was a partner in an illegal marijuana dispensary called Campo Greens, of an impending warrant search he had received for the business. The tip off allowed the business to clear any products or cash before authorities arrived.Sheriff Bill Gore said in a statement Friday that Garmo's actions do not represent the department:"In the spring of 2017, the San Diego County Sheriff's Department learned an employee was possibly involved in misconduct. Upon confirming the information and determining the misconduct potentially involved criminal activity, the Sheriff's Department requested an investigation by the Federal Bureau of Investigation (FBI) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The FBI and ATF conducted a thorough investigation and the United States Attorney's Office, Southern District of California, issued indictments on one current Sheriff's employee and one former employee. I want to thank our federal law enforcement partners for their diligence on this case, and I have the utmost confidence in the criminal justice system.Acts such as these are a violation of public trust and tarnish the reputation of law enforcement. I am disappointed by the actions of these two individuals, as they do not reflect the values of this department and its thousands of trustworthy, hard-working employees. The Sheriff's Department will not tolerate criminal behavior amongst its ranks and will hold its employees accountable for their actions."Magana and Hamel are out on bail and scheduled to be sentenced on Feb. 21, 2020.Anton and Garmo are set to be arraigned Friday. SAN DIEGO (KGTV) - 10 years ago, a Poway teen disappeared during a jog, and a collective sense of security was never the same. What followed were massive searches and an outpouring of support from the community. The investigation led to the arrest of the man who killed teenagers Chelsea King, 17, and Amber Dubois, 14. Carrie Cave's daughter Amber vanished in 2009 while walking to Escondido High. She planned to purchase a lamb that day and raise it as part of a school program. Her fate was revealed a year later after Poway High School senior Chelsea King went missing during a jog near Lake Hodges."I remember not being able to breathe. Your whole body is shaking," said Brent King, Chelsea's father.The evidence trail led to convicted sex offender John Gardner, who was ultimately convicted for a series of crimes, including the rape and murder of the two girls. Their bodies were recovered. After an emotional confrontation with Gardner in prison, Cave decided to forgive Gardner before he was sentenced."I got the answers about her last moments that I wanted ... I forgave him because I had another daughter to raise, and if I didn't, I wouldn't be able to live," said Cave.Cave started a search and rescue group. Her dog Amber discovered the remains of missing San Diego native and nursing student Michelle Le in the Bay Area in 2011."It was a lot to take in. I sat under a tree for two hours and cried," said Cave.That emotion is something the King family also knows well. The family channeled their grief and helped pass Chelsea's Law, a state law which enhanced sentences, parole terms and monitoring for violent sex offenders who commit crimes against children. To date, more than 2,500 offenders have been charged under Chelsea's Law."Because of Chelsea's Law, our children are safer, but that doesn't mean they're safe," said King.Besides advocating for laws, the King family's nonprofit Chelsea's Light Foundation has handed out over 0,000 in scholarships to local children. A run celebrating Chelsea's memory was held for eight years, before coming to an end.In 2014, Chelsea’s brother Tyler King directed a documentary he called “Chelsea’s Light: A Brother’s Journey.” "She is with us. That's the best I can tell you. She drives us every day to smile, to see life in a really beautiful way," said King.For Cave, a decade after the arrest of her daughter's killer, her grief is still complicated."It gets easier, but it still hurts ... I do good sometimes and then my emotions get all screwed up," said Cave.Cave says her she's still forging her daughter's legacy. She plans to start fostering children in the probation system."Not many people are willing to take in the kids. I just want to help kids. That would be a good legacy," said Cave. 2773

SAN DIEGO (KGTV) – A group of parents rallied in Mira Mesa Thursday morning to urge the San Diego Unified School District to reopen schools for in-person learning sooner rather than later.Since March, the district has kept school doors shut, but officials recently announced plans to initiate Phase 2 of a return plan come January.At Thursday’s rally, parents said that's not soon enough."Kids are depressed. We're trying to get them outside safe, but they need socialization and to be with friends. That's half of what they get out of school,” a parent said.City Councilmember Chris Cate joined parents Thursday in support, adding, "Every day that passes is critical."Cate said San Diego's climate could have easily played a part in welcome all students back to class by now."Outdoor learning, why are we not taking advantage of the climate we have here in San Diego? Yes, it's innovative and costly but ideas could be put forward when we know in fact, and have data that says, 'This is working' or 'this isn't working.’”Even though the trend of rallies has made a difference for districts in Poway, Carlsbad, Del Mar and Vista, it came with a cost.One week after Vista Unified welcomed students back into classrooms, five COVID-19 cases arose in their district, resulting in a lack of teachers to fill in and a quick move by the board to set new rules.Some parents in Vista even thought twice about their decision to send kids back to class, including parent Timothy Hernandez."I think they need to re-evaluate their plan and I wouldn't bring them back until next summer. I know they had trouble with subs and that says a lot,” Hernandez said.Yet parents like SUHSD dad Edward Ewing had opposing views."It seems like they're not putting the kids first, the psychological effect on kids are going to be felt for generations,” Ewing said.Carlsbad is the latest district to announce an in-person learning hybrid program that includes some students returning as soon as Nov. 30. 1984
