SAN DIEGO (KGTV) – Investigators are still piecing together the circumstances surrounding the 2-year-old girl who died after she was found in a hot car in Tierrasanta. Police tell 10News the mother called 911 Monday afternoon, saying she had just woken up from a nap and could not find her daughter in their home on Leary Street. The woman later called back and said she found her daughter in her Nissan Altima, unresponsive and not breathing, according to police. It is still unclear how long the child was in the vehicle. The Child Abuse Unit is now investigating.“The biggest mistake anyone could ever make is to think that it couldn’t happen to them,” said Janette Fennell, founder of Kids and Cars. The organization’s statistics showed 26 kids have died after being left in a hot car so far this year. Right now, technology does exist to alert families of an unattended child in a vehicle. One device is called “Sense-A-Life,” created by two Florida dads. It involves a sensor placed under a car seat. If you put the vehicle in park and open the door, an alarm will remind the driver of a child in the back. If there’s no response, it will send an alert to our phone. A few cars, like the Kia Telluride, has a sensor system built into it. It warns the driver when you exit your vehicle that someone may still be inside. The vehicle’s horn will go off if you have not returned to open the door.Fennell said there is a push to get the Hot Cars Act passed at a federal level. It would mandate technology in all vehicles that would alert drivers to someone left in their car, but she said there has been resistance. “It probably comes down to money, but it also comes down to the auto industry that fights against all these types of things,” Fennell said. “Every single safety item in your vehicle people should understand have been very long, hard battles. Like decades.”Fennell said it will take in part, political will to get the Hot Cars Act passed. 1962

SAN DIEGO (KGTV) -- La Mesa Police Department announced it has dropped their charges against Amaurie Johnson, a black man whose controversial arrest was captured in a viral video last week.La Mesa Chief of Police Walt Vasquez said that "after a full review of all of the evidence in the criminal investigation" against Johnson, the police department will not seek prosecution "on any of the alleged misdemeanor charges."The announcement comes two days since the department released body camera footage showing the events that led up to an arrest video that surfaced last week.A week prior, a video surfaced showing an argument between Johnson, a black man, and a white police officer at the Grossmont Trolley Station. The officer is seen pushing Johnson into a sitting position onto a bench. Eventually, Johnson is handcuffed and told he is being charged with assaulting an officer. It's unknown what actually occurred in the first few moments of the encounter because the witness video began recording sometime after the confrontation began, and the first the 30 seconds of the video provide by police starts without any sound. On the day the body camera video was released, Vasquez said the beginning of the video is muted because of the way the body camera is activated."Mr. Johnson is relieved that the criminal aspect of this case seems to be over with (but) until we have something formal from the prosecuting agency, he is not at rest in believing that it is completely over with," Johnson's attorney, Troy Owens, said. "He has still expressed that he is shaken up and upset by what took place. He has expressed that this is not the first time an incident like that has happened, it's just the first time it happened to be captured on camera, so Mr. Johnson is adamant he wants to see change.""We do believe that the officer should be investigated for potential criminal liability, but there is also a civil aspect to this. Mr. Johnson and I are discussing our options as far as moving forward with a complaint with the city of la mesa and potentially taking this to state or federal court," Owens added. The incident sparked a large protest last Saturday in La Mesa. Thousands of demonstrators took over city's streets to protest Johnson's arrest and the department's investigation of the incident. The peaceful demonstration and marches ended when a large group gathered outside of the La Mesa Police Department and began attacking a bear cat vehicle that was brought in to help disperse the crowd. Within hours, rioters set fires to vehicles and buildings while looters ransacked various buildings throughout the business district. The protest in La Mesa followed a week of fiery demonstrations across the country stemming from the Memorial Day death of George Floyd, a 46-year-old black man who died after a Minneapolis police officer knelt on his neck. The City of La Mesa full statement:After a full review of all of the evidence in the criminal investigation against Amaurie Johnson, 23, the La Mesa Police Department has decided it will not be seeking prosecution of Mr. Johnson on any of the alleged misdemeanor charges 3143

SAN DIEGO (KGTV) - In a graphic display, a former charter boat captain demonstrated Wednesday how to make the knots found on Rebecca Zahau’s body, according to the San Diego Union-Tribune.Zahau was discovered bound and hanging from a balcony of the Spreckels Mansion in Coronado in 2011.While the San Diego County Medical Examiner’s office determined the death was a suicide, Zahau’s family believes she was murdered. The Zahau family filed a wrongful death lawsuit against Adam Shacknai, the brother of Rebecca’s boyfriend and the only other person in the home at the time of her death.Lindsey Philpott used a lifelike mannequin covered with a white sheet to show the overhand and clove hitch knots, which, according to the U-T report, Philpott said were common for nautical uses.Shacknai works as a tugboat captain.Philpott said under cross-examination that both knots are simple and widely used, the Union-Tribune reported. The Zahau wrongful death trial, which was in its fifth day Wednesday, is expected to last four weeks. 1034

SAN DIEGO (KGTV) — It's been 25 years since President Bill Clinton approved Operation Gatekeeper, the measure focused on the issue of immigrants crossing the border illegally — specifically the San Diego sector. Two key parts of Operation Gatekeeper were surveillance equipment and enforcement infrastructure, like walls and fences. Twenty-five years later, Border Patrol Agent Theron Francisco tells 10News, "Before Gatekeeper this area was in utter chaos, agents were apprehending 1,000 per shift. We had hundred of thousands of apprehensions a year." It's a measure that Francisco says paved the way for Border Patrol today."It's absolutely night and day from where we were back then," Francisco said.Tuesday, those against Operation Gatekeeper held a rally. Former Border Patrol agent Jenn Budd tells 10News, "That was the whole purpose, to push them out here to make it more difficult and dangerous for them to cross. I didn't want to be a part of it but its something I have to admit I was a part of."Budd tells 10News, it's partly why she left Border Patrol, "I left because I felt the policies we were enacting were killing people and what we were representing to the public wasn't the truth." Meantime, Border Patrol agents say it's only helped increase San Diego safety."The days are gone where illegal aliens are running through people's backyards trying to hide from Border Patrol," Francisco added. Budd says, "We need them to work for us, we need them to protect our borders we need them to keep drug smugglers out, but we don't need children dying in their custody and all sorts of things they're doing right now." 1637
