WASHINGTON — The Supreme Court sounded skeptical Monday that President Donald Trump could categorically exclude people living in the country illegally from the population count used to allot seats among the states in the House of Representatives.But it also appeared possible that the justices could avoid a final ruling on the issue until they know how broadly the Trump administration acts in its final days in office and whether the division of House seats is affected.No president has tried to do what Trump outlined in a memo in July — remove millions of noncitizens from the once-a-decade head count of the U.S. population that determines how many seats each state gets in the House of Representatives, as well as the allocation of some federal funding.Justice Amy Coney Barrett was among several members of the court who said the administration’s argument for broad discretion in deciding whom to exclude is troublesome because “a lot of the historical evidence and long-standing practice really cuts against your position.”The court decided to hear the case on a fast track, based on the administration’s plea for a decision by early January, when Trump is required by law to transmit census numbers to Congress. The Census Bureau is supposed to send the data to Trump by Dec. 31. However, the bureau said last month they are checking anomalies and the data will be delayed. They did not give a new date, only saying they hope some data will be available in January. Another unknown is if data quality will be affected by the pandemic, a shortened schedule and natural disasters in 2020 that displaced thousands of people.In 2019, the Supreme Court ruled that the Trump administration could not include a question on the census that asked if a person was an American citizen. 1791

VISTA (CNS) - A man who allegedly fired a BB gun at an Oceanside business that had put up a sign supporting the Black Lives Matter movement was charged Friday with felony vandalism and a hate crime allegation.Steve Soto, 23, of Carlsbad, allegedly drove by Bliss Tea & Treats around 7:10 p.m. on June 4, then fired a BB gun out the window of his vehicle, shattering a window at the Mission Avenue business and causing more than ,800 in damage, Oceanside police Sgt. John McKean said.The business had a sign in the window at the time that read: "Black owned, we stand with you," McKean said.RELATED: Man arrested, accused of firing pellet gun at Oceanside business windowThe sergeant said surveillance video helped detectives identify the vehicle used in the crime and, ultimately, Soto, who was arrested July 15.Soto is charged with vandalism and a hate crime allegation in connection with the Bliss Tea & Treats shooting, and assault with a deadly weapon for allegedly shooting a man with a BB gun on May 28.He also faces two misdemeanor counts of discharging a BB gun in a grossly negligent manner stemming from unspecified incidents occurring in June and July, according to the criminal complaint.During his arraignment Friday morning, Soto pleaded not guilty to all charges and was served with a criminal protective order requiring him to stay away from Bliss Tea & Treats' owner, as well as the victim of the alleged May 28 shooting.Soto remains in custody in lieu of ,000 bail and is due back in court Aug. 28 for a readiness conference.A GoFundMe page created last month to raise funds to repair the damage to the shop has raised more than ,000. VISTA (CNS) - An Oceanside man convicted of abusing his neighbors' dogs, including gouging out the eye of a Siberian Husky, was sentenced to nearly 10 years in custody Friday.Jurors last summer found 37-year-old David C. The dog has never been found and is presumed dead.Police found a small amount of blood in Herbert's car and on a baseball bat he owned.Herbert, who represented himself at trial, testified that Lala jumped in his car and he was about to take her to a shelter when she jumped out and ran off. 1580
