LOS ANGELES (CNS) - Uber and Lyft will keep operating in San Diego and across California -- for now -- with a state appeals court Thursday putting on hold a ruling requiring the ride-hailing companies to classify their drivers as employees instead of independent contractors.The decision by the state's 1st District Court of Appeal averted threats by Uber and Lyft to shut down all California operations at midnight. Uber officials said earlier this week they would likely shut down, and Lyft issued a statement earlier Thursday saying its operations would be halting at midnight.In a blog post on Thursday morning, Lyft stated: “At 11:59PM PT today our rideshare operations in California will be suspended. This is not something we wanted to do, as we know millions of Californians depend on Lyft for daily, essential trips.”Lyft added: “This change would also necessitate an overhaul of the entire business model -- it’s not a switch that can be flipped overnight.”The dispute traces its roots to the state's passage of Assembly Bill 5, which effectively required the companies to classify their drivers as employees, a move supporters said would guarantee their wages and assure them of other benefits and workplace protections.The companies, however, said the move would require a complete overhaul of their operations and would actually hurt drivers -- forcing them to work set schedules instead of giving them the flexibility to work only when they wanted. The companies also said the move would result in many drivers losing their jobs unless they could work standard hours, and would likely also harm overall service for riders.California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco argued in court that Uber and Lyft have misclassified their drivers as independent contractors, preventing them from receiving "the compensation and benefits they have earned through the dignity of their labor" such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.On Aug. 10, San Francisco-based Judge Ethan P. Schulman ruled against the companies, but he stayed his decision for 10 days to give them time to appeal. They did so, resulting in Thursday's last-minute ruling putting Schulman's ruling on hold.The court, however, warned the companies to continue preparing for the possible switch to employee drivers, saying each company must submit a sworn statement by Sept. 4 "confirming that it has developed implementation plans." The companies must also affirm they are prepared to actually implement those plans and switch to the employee system within 30 days if they ultimately lose their appeal and a company-sponsored measure on the November ballot fails.That ballot measure, Proposition 22, would allow ride-hailing drivers to work as independent contractors.The court scheduled oral arguments in the appeal for Oct. 13.Lyft contends that four out of five drivers prefer working as independent contractors so they can have more flexibility. 3056

LONDON – British actress Diana Rigg has died at the age of 82.Rigg’s agent told the BBC the Associated Press that the actress died peacefully at her home Thursday morning, surrounded by family members who have asked for privacy.The agent did not disclose a cause of death.Rigg was known for her television roles. Local police have noted a disturbing increase in the amount of animals found to have been shot and dumped left to die.Previously, Scripps station WTVF in Nashville reported a?spike in the number of canine thefts in Middle Tennessee that was possibly connected to a local theft ring. Now, rather than just disappearing, the dogs are being killed.One beagle did survive. It was shot in the head and found dumped in a bag. Thankfully, veterinarians in nearby Winchester were able to save the dog.But others were not so lucky. Concerned citizens have sent in photos of dogs found shot and then dumped by the side of the road in a half-dozen middle Tennessee counties."It think it's horrible and we need to figure out why it's happening and who is doing it," said veterinarian Allison Fields at the Hermitage Animal Clinic in Davidson County.The dogs were shot with guns in more rural counties. Now, many wonder if some of them were among the many stolen in recent months."This is a big problem of people taking dogs from people coming into the yard and just snatching them out of yards and just taking them," said Earl Stouzenberger, who lost his dog Leia, earlier this year.Police have been checking for chips in the dead dogs hoping to locate owners."Absolutely, I'm sure they have. Animal Control or police stations will have a scanner," Fields said. But identifying the dogs doesn't solve the riddle of why they were shot and often dumped in public places. To date, no one has been charged or arrested in connection with the dog thefts or killings.Catching those responsible is a long shot. The best and really only line of defense for local pet owners is to keep an eye on them.Investigators say the shootings are difficult to explain. LOS ANGELES (AP) — California health officials Tuesday urged consumers to stop vaping marijuana or tobacco products until investigators determine why hundreds of people nationwide have been sickened after using the devices.Ninety people with a history of vaping have been hospitalized for severe breathing problems and lung damage in the state, and two people have died. With no known cause, officials say consumers should refrain from vaping of any kind until investigations are completed."We are seeing something that we have not seen before," Acting State Public Health Officer Charity Dean said in a statement. LOS ANGELES (AP) — A woman at Dodger Stadium was taken to a hospital Sunday for precautionary tests after being struck in the head by a foul ball from Los Angeles star Cody Bellinger during the first inning of a game against the Colorado Rockies.The young woman was sitting four rows from the field along the first base line, just beyond protective netting that extends to the end of the visiting dugout. She was hit by a sharp line drive by Bellinger, who checked on her between innings. She at first stayed in her seat and was given an ice pack, but she left about 15 minutes later for further attention.A first-aid person who treated the woman says she was taken to the hospital for precautionary tests but that she was alert and answering questions. The name of the woman was not released."It was weird. I saw it literally hit her face," Bellinger said. "I'm sure it was tough for everyone. I went over the next half inning to make sure. She said she was all right and gave me a thumb's up."Manager Dave Roberts came out to talk with Bellinger after the foul ball. Play was delayed for nearly six minutes as players watched the first-aid crew treat the woman.A woman died last August after being struck in the head by a foul ball at Dodger Stadium.All 30 major league stadiums expanded protective netting to at least the far ends of the dugouts at the start of the 2018 season after several fans were injured by foul balls two years ago.Fan safety has received further scrutiny after a young girl was struck by a foul ball in Houston during a game on May 29. The Chicago White Sox and Washington Nationals recently announced that they will extend their netting to the foul poles.Roberts said he would like to see it happen at other ballparks."I think that definitely talks like that need to intensify," he said. "For me, as we talk about getting ahead of things, I don't see anything wrong with that idea."Bellinger is also in favor of extending the netting."I would assume that would be a smart decision," he said.
