SAN DIEGO (KGTV) — Jalen McDaniels, San Diego State University basketball's sophomore forward, was accused of filming consensual sex acts with a classmate in 2016 without her knowledge and sharing it with friends, according to a civil lawsuit filed Wednesday in Washington.The civil suit alleges McDaniels recorded the intimate moments with an 18-year-old female student while they were both seniors at Federal Way High School near Tacoma, Wash.The lawsuit goes on to say while McDaniels later told the plaintiff about the unauthorized recordings and that he had shared it with his friends, she learned from other students that the video became widely circulated. When she confronted McDaniels, he explained he had gotten away with a similar incident involving another female student, according to the lawsuit.The plaintiff's attorney, Joan Mell, who filed the suit, wrote her client has suffered from several self-destructive behaviors as a result, including attempting suicide.SDSU is accused of wrongdoing in the lawsuit as well.Mell alleges in the lawsuit that SDSU was contacted by Washington police to provide them with McDaniels' phone number, but failed to do so. The suit says SDSU, instead, alerted former basketball coach Steve Fisher, who secured McDaniels a lawyer, and McDaniels refused to cooperate.The suit goes on to allege McDaniels' refusal to cooperate and, "that others concealed his wrongdoing prevented prompt criminal investigation and referral to the prosecutor's office for timely filing of criminal charges under Washington’s criminal offense of distribution of intimate images."In a statement, SDSU said there would be "no change in [McDaniels'] status at the university" at this time, after an investigation by Washington authorities resulted in no charges before McDaniels' enrollment at the school: 1837

SAN DIEGO (KGTV) - Members of Congress are responding to a Team 10 investigation that uncovered allegations the government is not providing adequate medical care to some U.S. citizens in its custody.Two recently filed lawsuits allege that dozens of individuals’ medical needs were deliberately ignored by Department of Homeland Security (DHS) agents, and Americans were forced to undergo life-threatening and torturous detox in temporary holding cells at the border.In a statement to 10News U.S. Congressman Bennie Thompson, Chairman of the Committee on Homeland Security wrote, “The allegations made in these lawsuits are extremely troubling. Anyone in CBP custody who is in medical distress should receive urgent medical care if they require it. Across the board, it’s clear that CBP has work to do to ensure safe and humane conditions for all detainees.”San Diego area Congressman Scott Peters also responded saying, “Everyone in federal custody deserves access to basic care. Ignoring a detainee’s pleas for help runs counter to CBP’s own national policies, which say detainees are entitled to medical care if they report an illness or appear to need help. Officers at the border may be overwhelmed, but if CBP is going to detain people, they have a duty to provide proper medical care to the people in their custody.”10News also heard from ACLU of San Diego & Imperial Counties. A spokesperson wrote, "Unfortunately, horrible detention conditions at U.S. Customs and Border Protection facilities, including inadequate medical care, is nothing new – though they are violations of the agency’s own internal standards for treatment of people in its custody. As a result of recent federal policy decisions, far more people are being unnecessarily held in CBP custody, for longer, under these deplorable conditions. These decisions are greatly exacerbating CBP’s longstanding failure to meet the basic humanitarian needs of the people it insists on detaining.”When asked for a comment on the allegation in the lawsuits a spokesperson for Customs and Border Protection said the agency cannot comment on matters that are currently under litigation. 2159

The new Census Bureau migration data reveal a post-recession shift in the migration of young adults and seniors. From 2007 to 2012, San Diego lost more than 7,400 people between the ages of 25 to 34 annually. From 2012 to 2017, the number dropped slightly to a little more than 7,000. The Del Cerro and Torrey Highlands are the best San Diego neighborhoods for renters, according to HotPads.Analysts evaluated rental size and price per square foot. San Diego’s median rental size is 1,154 feet, and renters can expect to spend .32 per square foot of space.The median rental size in Torrey Highlands is 2,033 square feet, at .14 per square foot, HotPads reported. Del Cerro residents pay .77 per square foot, with a median rental size of 1,710 square feet. SAN DIEGO (KGTV) - In a follow-up to a Team10 story from last week about sexual harassment allegations at a local nonprofit, the man who is accused is coming forward to try to clear his name.  Last week Team10 aired an emotional interview with San Diegan Angelique Williams, who claimed that Gregory Hamilton, a former teacher who works as a local pastor, repeatedly harassed her with unwanted sexual advances. Hamilton is now firing back. "Read my lips. There has never been sexual harassment with Angelique Williams on any day on the face of this earth," he tells us. After cancelling on us multiple times before our original story aired, this week he finally agreed to do an on-camera interview to share his side of the story.  Williams was an adult student at San Diego's Second Chance nonprofit training program, where Hamilton was her job training instructor. He also works as a pastor at Uptown Church of Christ. The church's website reads it first congregated under his leadership in 2009.  When we asked the nonprofit about the sexual harassment allegations, they sent back a statement that read in part, "We agree that what happened to Ms. Williams should not happen to anyone." It also read, "He was later terminated." In the new interview, Hamilton tells us he never received anything from the nonprofit saying he was charged with sexual harassment. He says that before his termination, he had been threatening legal action against the nonprofit. "[It was] about the disparity of the treatment of African American people that come [to the nonprofit] compared to Latino people for assistance," he says. Hamilton showed us a letter that he says he got from the nonprofit. It explains how he was terminated for not meeting the requirements of a performance improvement plan. There is no mention of harassment. In our initial story, he sent us a copy of another letter that he says he got from the nonprofit. It was a confidential separation agreement with a severance payment of ,760.00. There was also no mention of harassment. When we had asked Second Chance about the separation agreement and severance, they declined to comment, citing privacy issues.  Williams firmly believes Hamilton sexually harassed her. She says he'd inappropriately touch her, repeatedly call her, and send suggestive text messages.  Hamilton maintains it was Williams who advanced on him. Not the other way. He says his only intention was a friendship. He would not show us most of the text exchanges between the two of them, adding he would save those to show in court.   We asked Second Chance for an explanation as to why harassment was not included as a basis for the termination in the letter he showed us. As of air time this Wednesday, Second Chance wrote it was unavailable for comment.Below is one of the statements Second Chance issued to us before the original story aired. "Second Chance strives to ensure all members of our community have the means to achieve self-sufficiency, regardless of gender, age, race, or criminal history. Our organization maintains and adheres to a zero-tolerance policy for harassment and takes appropriate measures, including maintaining written policies, providing training, and promptly addressing any allegations made to the organization to ensure all individuals are provided an environment that is professional and free from harassment. Additionally, all potential employees undergo multiple pre-employment screenings, and state and federal background checks must be satisfactorily completed before an individual begins working for our organization. The situation in question was promptly addressed by the organization in full accordance with our policies. Out of consideration for the privacy interests of those involved and our legal obligations, we cannot further comment on the specifics of this situation."  Hamilton sent us a text on Wednesday stating he plans to start a support group called #NotMe for men and women who have been accused of offenses they did not commit and subsequently suffer psychologically, emotionally, financially and socially.  4713
