SAN DIEGO (KGTV) -- The cost of housing is a huge issue in California, as the issue of rent control heads to the November ballot.Proposition 21 would allow local governments to establish rent control on residential properties over 15 years old. It allows rent increases on rent-controlled properties of up to 15 percent over three years from previous tenant’s rent above any increase allowed by local ordinance.The proposition would exempt individuals who own no more than two homes from new rent control policies.Mark Doering is a landlord who rents out two homes. While Prop. 21 would not apply to him, he said he is against rent control. "I think the government has put enough burden on landlords like myself," he said. During the pandemic, numerous local governments issued bans on evictions for those facing hardships due to COVID-19. While Doering understands this difficult time, he said he and other landlords depend on the rent money."If they relied on that rent, they're in a bad enough situation as it is right now," Doering said. The No on 21 ad airing on television is sponsored by the California Apartment Association, with major funding from Essex Property Trust and Affiliated Entities, Equity Residential, and AvalonBay Communities. Pt. Loma Nazarene University's Chief Economist Lynn Reaser said the No and Yes on 21 ads do not actually explain what will happen if the measure passes. “It allows local governments to set their own rent control measures that would be different from what the state now has, which basically caps rent increases at 5 percent plus rate of inflation,” Reaser said.The ad claims that voters rejected a similar measure two years ago, which is true. There are a few differences with Prop. 21 than Prop. 10, which failed in 2018. This measure would apply to housing more than 15 years old. Owners with one or two properties would be exempt. Reaser analyzed Census statistics and said roughly one out of 10 rental units would be affected by Prop. 21. About 45 percent of Californians are renters. In San Diego County, about 450,000 rental units would be affected, or about 85 percent of all rental housing.The ad also claims that Prop. 21 would reduce home values by up to 20 percent. Reaser said it is likely property values will decrease over time, but not immediately."That will spill over into lower property taxes, which funds primarily our schools," Reaser said. The Legislative Analyst's Office said even as owners sell off their properties, "revenue losses from lower property values would be larger than revenue gains from increased sales." "It's very important to vote, but it's also very important to be an informed voter," Reaser added. 2698
SAN DIEGO (KGTV) - The Downtown Central Courthouse plans to resume jury trials in two weeks after a six-month postponement during the shutdown, but there are concerns about the massive backlog of cases and keeping jurors safe. Non-jury trials are currently in progress through a remote virtual process.“I do have an incredible backlog, not only in criminal but also in civil cases,” said San Diego Superior Court Presiding Judge Lorna Alksne on Monday. So far, 900 jury duty summonses have been sent out for telephonic standby for in-person appearances in groups of 70 people. “The jury lounge [holds] 500 to 600 people but instead of that were going to bring in 70 [people and] socially distance them,” she added.Those people who are selected for jury will sit in courtrooms which have been retrofitted with protective measures like plexiglass barriers. Judge Alksne said there around about 2,400 criminal cases ready for trial that must be reset. Beyond that, there are thousands of other criminal proceedings to get to. “There's about 17,000 other things that need to be reset before they can even get to a trial,” she added.Civil cases are another obstacle. A spokesperson for the Courthouse confirmed that there are approximately 54,000 civil cases that are pending. There are about 2,800 that are ready to go to trial but Judge Alksne said Monday that civil jury trials likely won't resume until sometime in 2021.“The only way that I'm going to beat this backlog is if jurors come in for jury service so if you feel like you're able to serve, we would ask you to respond to the summons and come into court and help us get the jury trials started again,” she added.She noted that civil bench trials will start in mid-October and in-person arraignments will start on November 1st. 1792
SAN DIEGO (KGTV) -- The County Board of Supervisors voted to temporarily ban the sale of flavored e-cigarettes and combustible tobacco product in unincorporated areas of San Diego.Supervisors Nathan Fletcher and Dianne Jacob, first proposed the ordinance in October in response to the nationwide epidemic of serious lung injuries linked to "electronic smoking devices, the alarming uptake in e-cigarette use by teens, and the terrible toll of combustible tobacco (cigarettes, cigars, little cigars) on San Diegans."There have been a reported 43 cases of vaping-related lung injuries in San Diego County. There haven't been any local deaths, but all patients have had to be hospitalized. Those affected range in age from 17 to 70 years old, according to the county.As stewards of public health, the County has a responsibility to act in the interest of the public health. The ordinances the Board passed today to restrict the sale and use of smoking and vaping products in unincorporated areas of the County will save lives," said Supervisor Fletcher after the ordinances passed. "These actions are a necessary and critical step to protect public health."RELATED: San Diego woman hospitalized with vaping illness warns othersThe ordinance prohibits the sale or distribution in unincorporated parts of the county of e-cigarette devices and flavored smoking products, including bubblegum, mango, creme brulee, vanilla, menthol and mint. “It’s critical that we do all we can now to address this nationwide crisis as health experts work overtime to find out what’s behind it,” said Chairwoman Jacob. “With lives hanging in the balance, doing nothing is not an option.”The board also passed a ban on the sale of flavored tobacco products and a ban on outdoor smoking at restaurants. The proposed policy aims to curb secondhand smoke exposure for restaurant patrons, as well as the service industry employees, by restricting smoking at outdoor areas in unincorporated parts of the county.San Diego is now among the several dozen counties across the state that have passed ordinances prohibiting or restricting the sale of flavored tobacco products.A second meeting on the ordinances will be held on Jan. 28. SAN DIEGO (KGTV) - The coronavirus pandemic, combined with a recently enacted state law, has created a new problem along San Diego's streets and boardwalks.Business owners say they're being overrun by vendors who set up makeshift stores and crowd sidewalks and walkways, while also luring customers out of long-established businesses."It's pretty much a free-for-all," says David McDaniel, the owner of Paradise Cove near Crystal Pier. "Anybody can sell anything, anywhere."He's partially correct. A new state law, Senate Bill 946, went into effect in 2018. Passed by the legislature and signed by Gov. Jerry Brown, it decriminalizes street vending, telling cities that they can create their own guidelines and can only enforce them with tickets for vendors who violate the rules, instead of criminal charges.Several cities in San Diego County, including Carlsbad and Vista, were quick to establish their regulations. San Diego still hasn't.As more vendors set up shop, the Pacific Beach Town Council is asking city leaders to move the process along."We're calling on city leaders to end the swap meet on our boardwalks now," says Brian White, the President of the Pacific Beach Town Council. "We have lots of pedestrian traffic, bicycles, skateboards. There really is no room for this type of vending activity."Earlier this month, the Town Council sent a letter to Mayor Kevin Faulconer and the City Council asking for specific rules.The San Diego City Council started to establish new rules for vendors in 2019. Faulconer sent a draft ordinance to the Economic Development Committee.It would have prohibited vendors on the boardwalk and other high traffic areas. It also would require business permits, set hours for vending, establish distances from public facilities, require vendors to follow health and safety rules, and several other rules.That ordinance passed the committee unanimously on July 25, 2019.The city then held three public forums about it in October. But it never went to the full council for approval."It is an issue that's becoming a real problem. We definitely need to get some regulations going with this," says City Councilmember Jennifer Campbell, who represents Pacific Beach and Mission Beach."It's really up to the mayor's office to bring us these recommendations to City Council," says Campbell.ABC 10News reached out to Faulconer to see why there has been a delay in moving the draft ordinance forward. In a statement, Ashley Bailey, the mayor's Deputy Director of Communications, says, 2526
