Employers may soon be able to require workers who make tips to share that money with other staff. It's part of a new regulation from the Department of Labor.The agency says the rule could help increase pay for back of house staff, like cooks and dishwashers who have historically been excluded from tip pools.The rule says pooling is only allowed if the tipped employee makes the full federal minimum wage.Federal law allows tipped workers to make .13 an hour, as long as they earn enough tips to match the minimum. State laws vary on that point, though.The rule also gets rid of a guideline that said tipped workers must spend at least 80% of their time doing tasks that earn them gratuity.The National Restaurant Association has praised the rule, calling it a win for the industry because it clarifies laws under the Fair Labor Standards Act.“Today’s Department of Labor (DOL) final rule revising tipping regulations under the Fair Labor Standards Act (FLSA) is a year-end victory for the restaurant industry and its workers after years of litigation," said the National Restaurant Association in a statement. "The changes in this rule bring much needed regulatory clarification for the small business owners and their employees about what the law allows and requires. At a time when the restaurant industry is faced with instability, this rule provides renewed sensible regulations on tip-pooling and tip-credit standards.”We spoke to an employment attorney named Louis Pechman who founded WaiterPay.com. He said there may be some clarification in the rule, but that's not the big issue.“Tips traditionally have been viewed by management as kryptonite. Don't touch the tips, servers' tips, stay away. That's my money. Now you have a whole situation where servers, it's my money. The tip was left for me. Why am I paying a cook in the kitchen?” said Pechman.The Economic Policy Institute has estimated the rule would let employers take 0 million from tipped workers each year. That's based on numbers before the industry suffered under the pandemic.As Pechman points out, some local laws are very protective of employee tips and will supersede federal regulations.“So, it's important if you're analyzing the issue, is there a state regulation, is there a city regulation which gives more protection to workers than the FLSA does?” asked Pechman.The rule is set to go into effect in 60 days. CHP says the man was driving east on Mission Road when he began to weave before striking a curb and tumbling down an embankment just after 1 a.m. According to CHP, someone gave the man CPR, but he died at the scene. CHP says the San Diego County Medical Examiner will determine whether or not a medical condition played a role in the crash. 505

I'm not just a doctor, but I'm also a parent to three young boys who are of trick-or-treating age. So, it's certainly a question that gets asked a lot in my wife's pediatric practice, as well,” said Dr. Kenny Banh, an emergency room physician and assistant dean of undergraduate medical education at UCSF-Fresno. “I have to say, I don't want to give a blanket answer, because it really depends on where you are and what the numbers are."Dr. Banh says there are ways to trick-or-treat this Halloween, but you first have to look at your local city and county ordinances."There’s simple things of just maintaining the guidelines. How do you do a mask? There are ways to incorporate masks in a costume and make sure we make or get costumes with masks integrated into them and trying to maintain social distancing,” suggested Dr. Banh. “The good thing about candy is years ago we moved away from homemade candies. Almost all candy is packaged already, so that’s helpful.”Still, limiting the number of people who touch the candy is a good idea along with wiping down the packaging.If you're wanting to pass out candy this Halloween, it's best to do it with a mask on and try to limit the number of trick or treaters handling the candy."Some recommendations are prepackaged candy, give little candy gift bags people can grab as they get by, instead of having kids reach in with their hands and grabbing a bunch of stuff, or you passing out with gloves or getting tongs and just dropping them into or getting a scooper letting kids drop it in," said Dr. Banh.Dr. Banh's biggest concern is with Halloween parties."Having Halloween parties and getting kids from the neighbors or friends all together, that’s really different than you as a nuclear group going as a family going out trick-or-treating and doing it safely,” said Dr. Banh. “Trying to understand that we’re finally making some ground in many states and we can easily go backwards. ESCONDIDO, Calif. (KGTV) — An arrest has been made in connection with an Escondido house fire this week where a man was found unresponsive and later died.Jose Trinidad Romero, 32, was arrested Wednesday after his truck was stopped by police in Escondido. Investigators said they believe Romero knew the man found unresponsive in the fire, but are unsure of the exact relationship. On Oct. 4, firefighters and police responded to the fire in the 600 block of Waverly Place. The victim, who has not been publicly identified, was found inside unresponsive. Police said he had injuries consistent with being assaulted before the start of the fire.RELATED: Man dies after being found unresponsive during Escondido house fireThe man was later pronounced dead at Palomar Medical Center. The manner and cause of his death are still under investigation.Investigators say evidence at the scene pointed to the fire being deliberately set. Just ask a family in Fallbrook that’s created a new card game they call, "It's Contagious," featuring a not-so-serious side of dealing with the virus while allowing players to work through their anxiety."Folks will find that the artwork on the cards is really relatable," said mom, Lola Pickett. "And also just like a fun take on this very challenging situation that we’re all in."For Lola, her husband, Tigre, and their two children, the pandemic came very close to home in March when the kids' Grandfather, Rich Pickett, tested positive for COVID-19."His case ended up becoming quite severe, putting him into the ICU," Lola said.Lola says while her father-in-law was in the hospital and the family was quarantined. They coped while at home by spending time together and playing games together. But the stress of the pandemic and its very personal impact was never far off."We noticed our kids were processing things by like adding hand washing stations to their Lego builds," said Lola. "We thought, that’s how we do things as humans. We play through it and figure out how we’re feeling."With that in mind, a project was launched.Dad, Tigre Pickett, says the family found some old poker cards, "Lola took a Sharpie and whiteout and started marking them up. We were like what if we had this card that did this?"Virus cards, spreaders, and antibodies. The headlines and stories of 2020 were becoming the cards of “It’s Contagious!” Like the café in Germany that required patrons to wear pool noodle hats for social distancing."We thought, well, there’s a card. That’s hilarious," said Lola as she and her husband showed off various cards. "So, we have things like that. We have home haircut. We have the t-p shortage which we’re going through again." "Like Zoom birthday parties," Tigre pipes in, as Lola continues, "And then things like antibodies become superheroes. They become a superpower card in the deck just like they do in real life."And the game itself becoming a part of real-life as the Picketts have invested in professional artwork and production in the hope that “It’s contagious,” catches on."We found that play is one of the fastest ways for processing," said Tigre.
