SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. SAN DIEGO (KGTV) — A local woman is suing the Greyhound bus company after an unscheduled stop allowed border agents to come on the bus and question the citizenship of passengers. Rocio Cordova was traveling from San Diego to Phoenix in November 2017 when her bus was stopped.Her lawyer, Darren Robbins, tells 10News, “Well this practice was brought to our attention and our client was one of the people subjected to these warrantless searches conducted without probable cause.”RELATED: 'Minutemen' wants troops at border gaps near CampoHe continued to say these immigration raids have been happening on multiple different Greyhound buses. Cordova is accusing Greyhound of violating state consumer protection laws by allegedly consenting to racial profiling by law enforcement officers. Cordova is a United States citizen, however, watched people on the bus around her questioned based on their race, according to her lawyer, “it is highly invasive and inappropriate to facilitate such action of law enforcement officials against its own passengers”. The complaint was served to Greyhound on Friday.Robbins is now waiting for their response, “the best response would be they'll refrain from any additional illegal behavior and stop allowing this kind of warrantless searches to take place on greyhound facilities or Greyhound buses,” he tells 10News.  1388

SAN DIEGO (KGTV) — A new restaurant with a "Sam the Cooking Guy" concept is coming to Seaport Village. The Port of San Diego this week approved a 10-year lease with the owners and operators of Carnitas Snack Shack, Broken Yolk, and Little Italy food hall to open a new kind of restaurant at Seaport Village.The new restaurant, which will be on the east end of the property, will have a "Sam the Cooking Guy" concept. Sam Zien, also known as Sam the Cooking Guy, is a celebrity chef who aims to make cooking more down-to-earth, using ingredients that come from the everyday supermarket. SAN DIEGO (KGTV) -- A measure that would increase San Diego's hotel tax is heading to the ballot on March 3 and a recent poll shows how San Diegans feel about Measure C. Measure C would increase San Diego’s hotel visitor tax from 10.5 percent to 11.75, 12.75 and 13.75 percent depending on hotel location through at least 2061.The money would go toward expanding the convention center, funding homelessness programs and fixing San Diego roads. According to the “Yes on C” campaign, the measure would create 7 million for homeless programs in the first five years of the initiative. The campaign also says the measure would create 7,000 jobs. The measure also includes criminal penalties if politicians misuse the funds, according to the campaign. A new poll shows how San Diegans are feeling about the measure. The measure requires two-thirds supermajority to pass. A 10News-San Diego Union-Tribune poll shows that, as of February, 61 percent support the measure while 21 percent are opposed and 18 percent are undecided. “A majority of San Diegans are uniting behind Measure C because it is straight forward in its approach to tackling the city’s most pressing issues with a tax on tourists, not San Diegans," said Greg Block, a spokesman for the Measure C campaign. "People already know Measure C will help with homelessness, street repair and job creation by expanding of the Convention Center."Michael McConnell, an advocate for the homeless, is leading the opposition and warns the measure has “loopholes and risks.”"They are hiding up to Billion in bonds with no guarantee that money will be spent the right way," he said in a statement. SAN DIEGO (KGTV) - A judge decided Friday to place a sexually violent predator in the East County community of Boulevard. Michael Joseph Martinez, 64 has multiple previous convictions including child molestation and lewd and lascivious acts upon a child under 14, according to County Supervisor Dianne Jacob’s office.The judge added Friday that the sheriff’s department will be extra vigilant and security will be heightened.The judge decided to place Martinez at the Department of State Hospitals recommended location of 2135 McCain Valley Road. The schools closest to the address include Clover Flats Elementary School and Jacumba Elementary School, according to the San Diego County Sheriff's Department.A mother of one of the victims from 25 years ago spoke at the hearing saying, “I know that you can’t change the order and I’m glad that there’s going to be very strict ordering, but I hope this doesn’t happen to another child or family.”RELATED: Dianne Jacob slams proposed placement of predatorJacob said the placement would put public safety at risk.
