SAN DIEGO (KGTV)-- The special needs teacher accused of having a sexual relationship with a student, pleaded not guilty to 20 felony counts. He also declared he would represent himself in the case. Against the advice of the judge, 49-year-old Juan Carlos Herrera told the courtroom, he will fight this alone. "I would like to represent myself," Herrera said. Relinquishing rights to counsel, the San Diego High school special needs teacher read the 20 felonies for the first time inside the defendant's box. Those charges include having sex, performing other sex acts, and physically and emotionally abusing one student between February 2018 and this March, when she was 15 and 16 years old."They occurred on an almost daily basis," Deputy District Attorney, Jessica Coto said. "They took place in hotels, in his car, and in his classroom." Coto said his ongoing manipulation extended to making threats."The defendant also routinely threatened the victim, that if she told anybody about what was happening, that she would cut off her arms and legs," Coto said. This all came to light on May 5, 2019, when police arrested Herrera at the US-Mexico border. Days prior, the girl's mother found inappropriate messages from Herrera on her daughter's phone.Because of the nature of the charges, and Herrera's second home in Mexico, the prosecution requested million bail. As his own attorney, Herrera fought back, saying he is a Navy veteran with a 25-year clean record with the district."It's not conceivable for someone with my earnings to make million, nor would I flee," Herrera pleaded. "I have been a person of honor and honesty since the beginning."The judge disagreed and kept the bail at million, handing Herrera his first loss, leaving him in utter disbelief.The judge also put a criminal protection order for the now-17-year-old victim. If convicted, Herrera could face a maximum of 16 years eight months in prison. But the prosecution mentioned, more time could be added if they find more evidence of sexual abuse. 2037
SAN DIEGO, Calif. -- Virtual interviews and job fairs are among some of the biggest changes when searching for a new job during the COVID-19 era. And the millions of newly unemployed Americans are vying for fewer jobs.Christy Schmidt, a 34-year-old who lives in Bend, Oregon, has been scouring job boards ever since she was let go by her employer. "The amount of jobs up there or jobs that are very close to a fit for me are just non-existent, and I have come to realize that there are tons of other wonderful qualified people applying for the exact same jobs I am," said Schmidt.She was working as an executive assistant for three vice presidents at Navis, a company that specializes in technology for the hospitality industry. Some of their biggest clients include hotels and resorts."It was literally my dream job. It was the best company culture I had ever been a part of, just some of the most brilliant people that were just so down to earth. I loved going to work every single day," said Schmidt. Schmidt thought working from home would be temporary, just during COVID-19, until the day managers called an all-team meeting."And it was very tough for them to tell us we no longer had jobs, that they were doing everything they could to make the company survive," said Schmidt.After months of searching, she finally found an opportunity that made her hopeful, only to learn it was a scam. When it came time for the virtual interview, the scammer instead wanted to have a text conversation over Google Hangouts. "All they want is personal information; they did not want to know anything about my experience or background," said Schmidt. The FBI says hiring scams have spiked during the pandemic.Now, Schmidt is considering moving out of the small town of Bend to go back home to California, where there are more jobs available. "Maybe I need to relocate myself just to be able to survive right now," said Schmidt. Tim Best, CEO of Bradley-Morris RecruitMilitary, says Schmidt is far from alone. "This isn't going away, so it's not even about, well this is what I need to do now. No, this is a competency we all need to develop because this is here to stay at some level," said Best. The Army veteran has spent the last two decades helping military veterans and their spouses find careers through massive job fairs at venues like Yankee Stadium.Now, they're going virtual."Really, no one understands what a virtual career fair is until they experience it," said Best. Employers market their brand in virtual chat rooms, which can lead to a video interview on the spot.While some sectors, like hospitality and tourism, will likely be slow to come back, essential jobs like delivery drivers are in demand. As well as IT, tech, customer service, online teaching, and construction jobs."I've seen this before in previous recessions, where people do rethink their career paths," said Best. The San Diego Workforce Partnership is offering on-demand training videos online. They're also connecting job seekers with affordable certificate programs to help people learn new skills. Workforce development partners in other cities are offering similar resources. Schmidt is broadening her search, considering jobs she might have overlooked before the pandemic."Knock on every single door because I know eventually one is going to open, and it's going to be the right fit for you," said Schmidt. SAN DIEGO (KGTV)- It was a battle over workers rights at a rally downtown Thursday. Assemblywoman Lorena Gonzalez directly addressing the group against her proposed Assembly Bill. Assembly Bill 5 would affect any independent contractor including Uber and Lyft drivers, yoga teachers even hairdressers. The group at Thursday’s rally was made up mostly of adult entertainers. “I’ve been doing fine I like the freedom to educate myself and if someone’s going to stop me from that I want to do something about that and voice my opinion," one woman told 10News. The bill would make many independent contractors full time employees, forcing employers to provide overtime, health care and sick leave. Assemblywoman Gonzalez rebutted the group today. "There’s nothing in the law that says an employee has to work from 9 to 6. Any employer can tell you to work two hours, one hour, any hours you choose. There’s nothing in the law that says an employer can’t be flexible.”Some say they don’t want it because they prefer the flexibility and freedom to decide hours that comes with independent contracting. 1104
SAN FRANCISCO (AP) — A lawyer for the man who styled the hair of U.S. House Speaker Nancy Pelosi says he believes she was set up when she went to a San Francisco salon that wasn't permitted to have indoor services because of the coronavirus pandemic. Pelosi is facing backlash after Fox News Channel aired footage showing the speaker walking through the salon without a mask on. But a lawyer for the stylist says the owner gave permission for the appointment and made “vitriolic and incendiary comments" about Pelosi. Messages seeking comment from the owner weren't immediately returned. 595
SAN DIEGO (KGTV)-- The owner of MetroFlex Gym in Oceanside said he is now in compliance with San Diego County's public health order after refusing to close his doors for months.Lou Uridel fought back against the closure orders of all gyms and fitness centers in California, saying he would lose the business he worked so hard to build if he closed his doors. Uridel also said he provides wellness services that don't fall under the order.Friday, Uridel received a letter from Dr. Wilma Wooten, the county's public health officer, to immediately close.The letter states that MetroFlex Gym was operating indoors in violation of state and county public health orders.Uridel quickly moved some fitness equipment on the sidewalk outside of his gym and is now getting a permit from the City of Oceanside to expand and build a more extensive outdoor gym.He said he would be closed down until later this week while he gets it all squared away, but some services inside will continue."We have nutrition supplement store, food pickup services," he explained.Before Dr. Wooten's letter was sent, Oceanside Police visited Uridel's gym a few times to try to gain voluntary compliance with the public health order.Uridel tells 10News he received positive feedback about his gym's cleanliness, and he went above and beyond to ensure the safety of employees and members."We hired a virologist, and they said the biggest things were capacity, social distancing, and airflow. So that's what we focused on," he said.Uridel said he purchased a high quality disinfecting spray gun for ,000 and bought six industrial-grade fans to circulate the air while leaving front and back doors open at his gym.He said the gym was disinfected every hour, equipment was moved to allow for social distancing, and capacity was limited to 20 percent."I've had 38,100 visits since May 8th, we have ten trainers here, and we've not had one outbreak," he said. "It's just like a nail in our back to be treated like an egregious violator. I've had death threats. I have people calling me a mass murderer, irresponsible and selfish; I don't see myself as selfish for trying to provide employment for ten trainers and staff."Uridel said had he followed the closure orders from the beginning and closed down his gym, he would lose the business he worked so hard to build."You can't keep throwing us on life support and expecting us to stay around," he said. "Businesses aren't light switches; you can't turn us on and off."Uridel was cited back in May for refusing to shut down during the initial orders from the state. He has since hired a lawyer. 2614
