SAN DIEGO (KGTV) -- San Diego County is suspending enforcement of restaurant closures following a Wednesday court ruling.Superior Court Judge Joel R. Wohlfeil issued an injunction prohibiting a cease-and-desist order from being enforced on strip clubs and "San Diego County businesses with restaurant service.” At a hearing on Thursday, Wohlfeil said his ruling encompasses all restaurants, not just strip clubs.In November, the county fell into the state’s purple tier, forcing eateries to cease indoor operations. SAN DIEGO (KGTV) - San Diego County leaders have stressed education over enforcement regarding the rules and laws surrounding the coronavirus, but there are laws in place to help stop the spread."There is civil liability and criminal liability," says Professor Joanna Sax from the California Western School of Law.Sax says many of the laws rely on a standard called "reasonable care" to determine liability."As long as you are taking precautions reasonably, then it's unlikely that you'll be held negligent. That would be the legal term," Sax says.For businesses, that means following the rules like posting a safe reopening plan and sticking to it to keep customers safe. It can also mean providing PPE and hand sanitizer for employees.But for businesses that aren't using "reasonable care," San Diego officials have shown the ability and willingness to use the laws to force compliance.One of the most prominent cases over the last few months involves Boulevard Fitness in University Heights. According to the city, that gym stayed open for indoor workouts for 45 days, violating the county's rules. City Attorney Mara Elliott threatened Boulevard Fitness with a ,500 fine for each day, citing "unfair business practices."The gym closed after receiving Elliott's letter and has since reopened while obeying county guidelines for capacity and distancing.Sax says those kinds of laws work for extreme cases, but may not apply for smaller violations."If businesses are not behaving reasonably and they are behaving recklessly, and they have no plans, and they're letting people in, maybe they should face liability," Sax says. "Those aren't the businesses that should be open to the public. They're doing a disservice to the rest of the community."As for individuals infecting other people, the California Health and Safety Code has strict standards.According to Section 120290, five things all need to happen for someone to be guilty of "intentional transmission."The Code says: 1988

SAN DIEGO (KGTV) - San Diego city leaders met Monday to look for new ways to tackle homelessness. Several departments and organizations gave presentations to a committee, lead by Councilmember Chris Ward.The Select Committee on Homelessness met to discuss how to create new employment opportunities for homeless and how to get them into the existing rapid-rehousing programs. They also discussed a new program that would house all homeless services in one location.The San Diego Police Department provided an overview of their new Neighborhood Policing division. They say they are working to provide outreach, mental health services, and enforcement when needed.San Diego residents spoke during the public comment portion of the meeting, thanking the committee for their work but asking them to do more.Several other agencies also had presentations, providing updates on the temporary bridge shelters and the homeless storage facilities.The Select Committee on Homelessness meets one to two times a month. 1013

SAN DIEGO (KGTV) - San Diego Metropolitan Transit System officials say ridership spiked in the first quarter of the 2020 fiscal year by more than a million trips compared to the same time last year.From July through September of 2019, 22,258,345 trips were taken on an MTS trolley or bus. In 2018, MTS saw 21,313,801 trips. It's a 4.4% rise from one year to the next."It's encouraging," says MTS Chair Nathan Fletcher.MTS officials say a heavy focus on investment over the past few years is starting to pay off. They recently completed a million plan to streamline services and add frequency to many bus routes. They also added the South Bay Rapid route from Otay Mesa to Downtown and expanded the Rapid Superloop service in the University City area."As we add those services where folks want them, as we squeeze every dime we can get out of our existing budget, as we make a full commitment to engage the community in what they want, people will use it," says Fletcher.The surge in riders helps MTS buck a nationwide trend where public transportation is on the decline.Even in San Diego, year-to-year numbers had been dropping for four straight years, since hitting a record high in 2015 (see chart above).Fletcher says it's a positive step as the city tries to meet strict climate goals that require a reduction in greenhouse gas emissions.Recently, SANDAG put out a plan to increase transit ridership to 10%. That sparked a debate over how much money should go towards transit vs. road construction.Fletcher says any money spent on transit also benefits drivers."Every person who chooses transit is one less car driving," he says. "The individual who says, 'I'm always gonna drive,' should support transit because that means less congestion. Less congestion means less toxic pollution and less greenhouse gas emissions. So it's a win for everybody whether you use transit or drive your car."To raise money for more expansion, MTS is looking into a ballot measure for the November 2020 election that would add a half-cent sales tax. 2046

SAN DIEGO (KGTV) — San Diego Lifeguards say beach attendance was much larger compared to a typical weekend, but drastically smaller than the usual Independence Day crowds. Still, lifeguards conducted hundreds of rescues along San Diego's coastline.America's big beach birthday bash was not as jam-packed this year."We didn't know what to expect," San Diego Fire-Rescue Lifeguard Lt. Andy Lerum said. "We thought maybe with LA beaches and Orange county beaches closed, we'd see an influx, but we didn't really."Lt. Lerum says only about 200,000 to 300,000 people came to San Diego beaches this July 4th weekend, compared to over 1,000,000 visitors in years past."Obviously, with the fireworks being canceled, people didn't camp out all day waiting for them," Lt. Lerum said. "So parking lots were full; however, the beaches and parks were not at full capacity."This meant leftover trash was not nearly as bad either. Volunteers of the local Surfrider Foundation spent a fraction of their usual time picking up Sunday morning.Those who did come to the beaches could not wait to dip their feet in the sand."For three months, we are in quarantine, and so it was so hard for me!" Fay Beygi said.Only a few people were seen wearing masks, as many visitors stuck together with their families, or were in the water.While some were hoping for more enforcement, lifeguards shifted their focus on the dangerous high surf. On July 4, 2020, they conducted about 300 rescues — 197 of them were at the La Jolla Windandsea. That number includes responding to swimmers in distress, stingray patients, and boating emergencies.While that is a lot for a typical day, lifeguards say that it is less than half of the usual July 4 numbers. Still, they say Windandsea is a popular place where even experienced surfers and swimmers can get washed away."Avoid rip currents when you can," Lt. Lerum said. "If you get stuck in a rip current, try not to panic. Swim parallel to the shore and go back to shore. And please, supervise your young children. Watch them very carefully."A high surf advisory is in effect this weekend until 12 p.m. on Monday, bringing rip currents and generally hazardous conditions for swimmers. The high surf also could bring some minor flooding to low-lying areas during high tide, including in La Jolla, Del Mar, and Cardiff, according to the National Weather Service. 2377
