SAN DIEGO (CNS) - Two men who took part in a fatal Pacific Beach home invasion that resulted in the shotgun slaying of a resident were sentenced Friday to state prison terms.Carlos Yslas, 25, and Pedro Ramirez, 28, were sentenced Friday for their roles in the death of 44-year-old MarcAnthony Mendivil, who was shot in a home in the 2300 block of Wilbur Avenue on Dec. 29, 2018.Mendivil was living at the home of another defendant, Paul Charles Weinberger, 51, at the time of his death and was killed in what court documents describe as a forcible eviction gone wrong.Yslas, who was the gunman in the incident, was sentenced to 27 years in state prison, based on his plea to a voluntary manslaughter charge. Deputy District Attorney Flavio Nominati said Yslas was released from prison on a residential burglary conviction about a week prior to the shooting.RELATED: Three men plead guilty to Pacific Beach shotgun slayingRamirez was sentenced to eight years in prison on Friday, while co- defendant Freddy Sosa, 38, was sentenced last year to eight years in prison. Weinberger was sentenced to three years earlier this week.Sosa pleaded guilty to voluntary manslaughter, while Weinberger pleaded to an assault with a firearm charge.According to court documents, Sosa had previously lived at the home, but was kicked out by Weinberger following a dispute. Mendivil then moved in, but soon after, Weinberger contacted Sosa asking him for help in removing Mendivil from the home for unspecified reasons, investigators were told.Weinberger told police he was drugged on the night of Mendivil's killing and forced to withdraw cash from his bank to pay Yslas and Ramirez, who were brought in to assist in forcibly removing Mendivil from the home, court documents state.However, in the process of forcing Mendivil out, Yslas shot Mendivil twice. According to defense attorney Kristen Haden, Yslas believed the victim was reaching for a weapon, which later turned out to be a knife beneath his mattress.Officers found Mendivil suffering from a gunshot wound when they responded to a 1:47 a.m. call of a possible shooting, San Diego police Lt. Matt Dobbs said. He died at a hospital about 45 minutes later, Dobbs said.Weinberger and Sosa were arrested the day of the killing, while Yslas and Ramirez were already in custody on unrelated charges when they were re- arrested and charged last February for their roles in the homicide. 2430

SAN DIEGO (KGTV) — A driver heading the wrong-way on Interstate 805 died following a fiery crash with another vehicle Saturday.A Mitsubishi Lancer traveling the wrong-way on southbound I-805 near the I-8 connector collided with a Toyota SUV just before 3 a.m., according to California Highway Patrol. The collision sparked a fire, engulfing both vehicles, CHP said.Both drivers were transported to a nearby hospital with life-threatening injuries, according to California Highway Patrol. The wrong-way driver later died. Another vehicle received minor damages in the wreck. That driver received minor injuries.CHP was still investigating where the wrong-way driver entered the freeway. It's not clear if alcohol or drugs was a factor in the crash.A portion of I-805 was closed as crews cleared the scene, but was reopened before 7 a.m. Saturday. 855

SAN DIEGO (KGTV) -- County leaders and the American Red Cross are being forced to change fire evacuation plans due to coronavirus.According to a news release, residents under evacuation will now be housed at hotels or motels, or multiple shelters with less than 50 people instead of traditional shelters.The Red Cross says it’s working with nearly 100 lodging businesses to make rooms available during a crisis.“We’re entering the riskiest part of the wildfire season while still being in the middle of an unprecedented health crisis,” said county Supervisor Dianne Jacob. “That is forcing us to rethink and retool our disaster-planning efforts.”The County Office of Emergency Management is also asking people to include face coverings and hand sanitizer in their evacuation kits.“As we head into our warmer months, we need all resources available,” said County Supervisor Jim Desmond. “The question isn’t if, but when. We know fires are a part of living in San Diego, but putting in the preparation ahead of time is the best tactic we can use.”The Red Cross also says packaged meals will be provided instead of the usual cafeteria-style dining in light of the virus.“Disasters require flexibility and planning for a number of variables – especially in the COVID-19 environment,” says Sean Mahoney, Regional CEO of the American Red Cross Southern California Region. “As wildfire season approaches, the goal of the Red Cross remains to provide comfort and support to anyone in need after a disaster, and we are prepared to do just that.” 1545

  

SAN DIEGO (KGTV) - A former North County contractor who pleaded guilty to several charges, including grand theft, received a five-year sentence on Monday.Prosecutors said Marc Morningstar owes thousands of dollars to more than a dozen former customers. Team 10 first exposed Morningstar in early 2017 after several people contacted Team 10 about his questionable business practices. Morningstar pleaded guilty to failure to file a tax return, two counts of grand theft of personal property, and using personal identifying information of another person. He also admitted to two misdemeanors—failure to secure payment of compensation and contracting without a license.The judge sentenced him to local custody. He will receive credit for the time he has already served, which was more than 200 days. He also owes 13 victims nearly ,000, according to deputy district attorney Amy Lafer.During the hearing, Morningstar’s girlfriend Maria Meeuwisse requested to address the court. She said she is a victim of Morningstar as well.“He will not be living with me when he gets out, whenever he does get out. He has used my social security number,” she told the judge. Meeuwisse previously pleaded guilty to her role in the scheme, which included a misdemeanor of contracting without a license and failure to secure payment of compensation.Judge Timothy Walsh said that Morningstar has to “rethink the way he approaches his life.” 1430

  

SAN DIEGO (CNS) - With one of the largest holidays of the year just a day away, getting around and conducting business before and on the holiday can be tricky to navigate with what is closed and open.The North County Transit District will have a normal service schedule for Christmas Eve. However, the Amtrak R2R partnership with NCTD -- which allows Coaster customers to travel on Amtrak trains in the San Diego area -- will be blacked out through Monday. During this time, all Amtrak Pacific Surfliner customers will be required to show a valid Amtrak fare and no COASTER passes will be accepted.NCTD schedules will be reduced to a Sunday service schedule on Christmas.The San Diego Metropolitan Transit System will run a similar schedule, with normal weekday hours Christmas Eve on all Trolley lines and MTS local, urban, Express, Rapid and Rapid Express bus routes.Christmas is more complicated. All Trolley lines except the Silver Line will operate on a half-hour frequency on Christmas Day. Rapid, urban, and local bus routes will operate on a Sunday schedule.No service will be provided on Rapid Express routes 280 or 290, Rapid routes 204, 237 and Express routes 50, 60, 110, 150, Sorrento Valley Coaster Connection and most express bus routes. MTS Access subscriptions are cancelled. Subscription passengers who still want service must call ahead of time to arrange their transportation.Finally, several rural routes have been rescheduled. There will be no service on rural route 892 on Friday. Rural route 888 will operate Thursday instead of Friday, while rural route 891 will be pushed back to Monday instead of its normal Friday schedule.MTS Information and Trip Planning, the Transit Store, Compass Service Center and customer service offices will close at 5 p.m on Thursday and be closed Dec. 25. Customers who need MTS information on Christmas Day, Dec. 25, can visit the MTS website or download the mobile app OneBusAway for real-time information.On Saturday and Sunday, MTS allows up to two children 12 and under to ride free with a fare-paying adult on all MTS routes. On Christmas Day, MTS allows a friend to ride free with a fare-paying customer on all MTS routes.All county COVID-19 testing sites will remain open Christmas Eve, but they will close at 4 p.m. On Christmas, three sites -- University of San Diego, San Marcos and Southeastern San Diego -- will be open from 10:30 a.m. to 2:30 p.m.Walk-in testing sites do not require appointments. However, as of Dec. 20, nearly all drive-up COVID-19 testing sites have become appointment-only locations. This change is in response to safety concerns caused by traffic backups. Appointments are accepted up to three days in advance with new appointments becoming available each day about noon.The exception to the appointment-only drive-up testing will be sites operated by the San Diego County Fire Protection District. While appointments are highly recommended, and those with them are given preference, people without appointments will be tested as capacity permits."With vaccine distribution in its very earliest stage, COVID-19 testing remains extremely important to protect the public's health," said Dr. Wilma Wooten, San Diego County's public health officer. "People experiencing any symptoms, or who feel they have been exposed, are encouraged to get promptly tested. Those with symptoms should isolate until getting results, while others should adhere to the best practices of wearing a mask, social distance, and good hygiene."The San Diego Food Bank will be closed for the upcoming holidays on Dec. 24-25 and Dec. 31-Jan. 1.For details on testing locations or in need of food assistance, visit 211sandiego.org or call 2-1-1.All San Diego administrative offices will be closed on Christmas holiday.Curbside trash, recyclables and yard waste will not be collected on Friday for customers served by the Environmental Services Department. Residents in other cities should check with their waste hauler for holiday service schedules.San Diego's Miramar Landfill will be closed on Friday.Torrey Pines, Mission Bay and Balboa Park golf courses will be open until 3 p.m. Holiday rates will apply. All city skate parks will be open.All public buildings in Balboa Park will be closed, including the Balboa Park Activity Center, Botanical Building, Casa del Prado, Municipal Gym and War Memorial Building.All city reservoirs will be closed. Chollas Lake will also be closed.Parking meters, time restrictions for parking on streets and yellow zones within the City of San Diego will not be enforced. Red, white and blue zones are still enforced every day. Parking rules on Port of San Diego property and in different cities may vary, please read posted signage.Also closed in San Diego are all libraries and book pickup service, city pools, the city's refuse/recyclables container sales office on Miramar Place, Open Space and Maintenance Assessment District offices, the Testing, Employment Information Center and Background/Fingerprinting offices within the Personnel Department and The Family Justice Center.Individuals needing help related to domestic violence should call 9-1- 1 and/or the Domestic Violence Hotline at 1-888-385-4657. 5293
