SAN DIEGO (KGTV) - A man was arrested after the mother of a three-year-old girl called the San Diego Police and said her daughter was kidnapped and inappropriately touched by her neighbor.Police say the ordeal happened just before 10 a.m. Saturday, on Maple Street near Oak Park Elementary School.Two uncles spoke with 10News off camera, saying they heard their cousin "making a fuss" about her window being broken into, the same bedroom where their niece was taking a nap."He snatched her from the window... Three minutes to ten minutes that she was in there," one uncle said.When the girl was back home, the uncles said she seemed upset and reserved. Once she started talking, and the family had an idea of what may have happened, emotions boiled over."My cousin just went in for the shine like the first shot he made him bleed like I think he cracked his nose," he said his sister pulled them apart, and the man ran off.Blood stains were visible on the concrete outside. "Something had to be wrong with him, for him to balls up and come through a window with like ten people in the house," he said. The family knew the neighbor was mentally ill but did not think to this extent.The toddler and her parents then went to the hospital to get "a rape kit, just make sure everything’s fine, and we don’t exactly know what happened to her she saying that she was touched."The incident happened right across the street from Oak Park Elementary School, where students will come back to class August 28th. The San Diego Police Sex Crimes Unit is investigating the incident. 1635

SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. SAN DIEGO (KGTV) - A resident inside an Encanto home opened fire on an intruder Wednesday, San Diego Police said.The victim first vandalized a car in the 6800 block of Charlene Ave. in the Broadway Heights section of Encanto, according to police.Police believe the victim then used a rock to break into a home where people were inside. One person was armed and fired a shot at the intruder.The victim was taken to the hospital. He may be related to the people in the home, and may have been under the influence of alcohol or drugs, police said.Officers did not release the victim’s identity or condition. 612

SAN DIEGO (KGTV) - A new report says San Diego Unified School District is losing nearly million a year due to the exploding number of charter schools.School districts receive funding per student. The report by the organization, In the Public Interest, found SDUSD loses nearly ,913 a year per charter school student, largely due to costs that cannot be reduced when a student goes to a charter school. SDUSD is the second-largest district in California.There are about 120 charter schools in San Diego County. Roughly 50 of those schools are in the SDUSD. Elva Barajas’ son attends a local charter school.“I liked what they were offering for the students. There were smaller classrooms… less than 25 kids in the classroom. It was more individualized for the students,” Barajas said.Miriam Rodriguez’s daughters go to traditional schools within SDUSD.“At the end of the day, the schools are in my community,” Rodriguez said.The report, called "Breaking Point: The Cost of Charter Schools to Public School District," analyzed three California school districts including San Diego.Superintendent Cindy Marten and SDUSD trustee Richard Barrera argued that local districts need more control over school charter decisions. Barrera said district leaders need to ask critical questions, including fiscal impact. Currently, he said they are not allowed to do so.“What is it bringing to the table, what is it adding to the mix of schools… but also, what is it taking away?” Barrera said.Michelle Anderson, Regional Manager for the California Charter Schools Association, said districts already have enough oversight. “This is really a misrepresentation of issues that came through from a report that was paid for by special interests. Charter schools are really not the bad guys in this issue,” Anderson said.Both sides agree that education funding goes beyond this particular issue, although they differ in the impact of charter schools.
