SAN DIEGO (KGTV) - As police ramp up their probe, an Otay Mesa dog owner believes his dog may also have been targeted by a pepper spray-wielding mail carrier.The owner of 9-year-old Roscoe didn't want identified, but he tells 10news about two months ago - moments after their mail carrier left - Roscoe started to twitch in pain, which lasted minutes. He say Roscoe was behind a gate and not a threat to the postal carrier. Hours later, the dog's eyes were still red. The dog's owner didn't report it, but says another neighbor complained about a similar occurrence. Both of their homes are just blocks from the Galindo home on Agosto Street."Makes me feel angry and so sad that he's causing so much pain," said Alfonso Galindo.Earlier this week, he spoke to 10news about the strange stains on his patio that prompted him to check his surveillance video. He watched the unbelievable unfold: a postal carrier appearing to hold pepper spray under the mail, as he walked by a metal gate. Behind the gate is his 7-year-old rescue Pupa. At the same time, Pupa begins convulsing for minutes."Sickening. It's scary how nonchalant he is. He's done this before," said Galindo.Galindo says he found nine similar incidents in the recordings on his hard drive, about a month's worth. The Postal Service issued an apology, saying the 'appropriate action' will be taken."That left me with a question. Is this person going to be retrained and put back on my route? That's not going to cut it," said Galindo.There are also more questions about the impact on his two young children, who are constantly touching and hugging Pupa. For months, they've suffered mysterious respiratory issues, requiring frequent trips to the hospital. On Wednesday, both were diagnosed with asthma. Galindo says more tests need to be done, but doctors believe the pepper spray could be the cause, and at the minimum, is an aggravating factor."I'm scared to find out where this could take my children. SAN DIEGO (KGTV) — A 14-year-old teen has been arrested and charged with a hate crime after punching a Rabbi near a University City synagogue, police say.San Diego Police said Rabbi Yonatan Halevy, of the Shiviti Congregation, was walking near the synagogue located near 3200 Governor Drive on Oct. 10, when he was punched by the teenager. The teen reportedly yelled racial slurs during the attack and fled the location, police added. SAN DIEGO (KGTV) -- In an effort to lower costs in one the country's most expensive states for medications, Gov. Gavin Newsom wants California to manufacture its own generic drugs.Newsom is expected to send a proposal as part of the new state budget to the legislature Friday that would allow the state to negotiate contracts with drugmakers to manufacture selected prescriptions on behalf of California.“The cost of health care is just too damn high, and California is fighting back,” Newsom said in a statement. “These nation-leading reforms seek to put consumers back in the driver seat and lower health care costs for every Californian.”Three of the most expensive U.S. cities for medications are San Francisco, Los Angeles, and San Diego. According to a survey by Kaiser Family Foundation, six in 10 Americans take prescription drugs, and 79 percent of those surveyed say the costs are unreasonable. Prescription drug prices have gone up 38 percent since 2017. Newsom's plan would make those medications available at an affordable price for 40 million people living in California. Details on what the drug program will look like will be available when Newsom submits his full proposal Friday afternoon.If approved, California will become the first state in the U.S. to have its own generic drug label. 1315

SAN DIEGO (KGTV) - A former Yuma Police officer testified Tuesday in his trial for the rape of a woman in Kensington.Jared Elkins, 34, raped his wife’s cousin after a family gathering at her home on Marlborough Drive last year, prosecutors said. The group had been out to dinner, then watched a movie while drinking beer and wine at home.She testified last week, saying she didn’t yell during the alleged attack because Elkins threatened to kill her. His wife was asleep across the hall at the time.After the encounter, the woman said she ran into her mother’s room for help, and they both escaped out a window.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Police said Elkins told them that the sex was consensual and the rape charges were made out of guilt.Elkins told the jury the alleged victim started flirting with him after everyone else went to sleep.“There was mutual flirtations between the two of us and we were being adults,” said Elkins, who testified the woman was “cuddling, almost snuggling” with him.“She said yeah, it was surprising to me; I was excited a younger attractive woman, you know, it kind of confirmed everything on the couch,” Elkins said.Elkins resigned from the Yuma Police Department in 2017. He is facing nine felony counts including forcible rape and could serve 14 years in prison if convicted.City News Service contributed to this report. 1462

SAN DIEGO (KGTV and ABC) - Fishermen had a close encounter with killer whales off the San Diego coast that was caught on camera. The group was on a 21-foot boat looking for yellowtail when they came across the orcas. "Out of nowhere, one of them popped up right next to the boat 3 or 4 feet away from me…landed, splashed me, and splashed the whole side of the boat. I screamed,” witness Nathan Benge told Good Morning America. One of the killer whales had a playful interaction, performing a belly roll beneath the surface of the boat’s wake, GMA reported.
