SAN DIEGO (KGTV) - The City of San Diego released Friday body-worn camera video and hundreds of pages of documents related to a 2018 officer-involved shooting. Raul Rivera was shot and killed by police on Hollister Street and Tocayo Avenue in May 2018 after police say he came at them with a knife. The new documents show police collected 28 9mm cartridge casings, nine bean bag cartridge casings, and four Taser cartridges from the scene. At one point, the video shows police tasing Rivera. He appears to rip off the barbs and continued to struggle. After several minutes, the violent scene comes to an end when police shoot and kill Rivera. They say he charged them with a knife. The San Diego County District Attorney's office did not bring charges against any of the three officers who fired.The report noted, "law enforcement officers were confronted by an agitated subject who was armed with a knife and was under the influence of narcotics. Mr. Rivera urged officers to shoot him as he advanced toward them."  At the time of the shooting, family members told 10News Rivera was in a bad mental state and wished the police had helped him, not hurt him. On Friday Rivera's sister told Team 10 investigator Adam Racusin she was too shaken to talk about the loss of her brother. She would only say that she loves him and is disappointed in the way police have handled things to this point.  1495

SAN DIEGO (KGTV) - The coronavirus pandemic, combined with a recently enacted state law, has created a new problem along San Diego's streets and boardwalks.Business owners say they're being overrun by vendors who set up makeshift stores and crowd sidewalks and walkways, while also luring customers out of long-established businesses."It's pretty much a free-for-all," says David McDaniel, the owner of Paradise Cove near Crystal Pier. "Anybody can sell anything, anywhere."He's partially correct. A new state law, Senate Bill 946, went into effect in 2018. Passed by the legislature and signed by Gov. Jerry Brown, it decriminalizes street vending, telling cities that they can create their own guidelines and can only enforce them with tickets for vendors who violate the rules, instead of criminal charges.Several cities in San Diego County, including Carlsbad and Vista, were quick to establish their regulations. San Diego still hasn't.As more vendors set up shop, the Pacific Beach Town Council is asking city leaders to move the process along."We're calling on city leaders to end the swap meet on our boardwalks now," says Brian White, the President of the Pacific Beach Town Council. "We have lots of pedestrian traffic, bicycles, skateboards. There really is no room for this type of vending activity."Earlier this month, the Town Council sent a letter to Mayor Kevin Faulconer and the City Council asking for specific rules.The San Diego City Council started to establish new rules for vendors in 2019. Faulconer sent a draft ordinance to the Economic Development Committee.It would have prohibited vendors on the boardwalk and other high traffic areas. It also would require business permits, set hours for vending, establish distances from public facilities, require vendors to follow health and safety rules, and several other rules.That ordinance passed the committee unanimously on July 25, 2019.The city then held three public forums about it in October. But it never went to the full council for approval."It is an issue that's becoming a real problem. We definitely need to get some regulations going with this," says City Councilmember Jennifer Campbell, who represents Pacific Beach and Mission Beach."It's really up to the mayor's office to bring us these recommendations to City Council," says Campbell.ABC 10News reached out to Faulconer to see why there has been a delay in moving the draft ordinance forward. SAN DIEGO (KGTV) - The La Boheme complex in the heart of North Park offers plenty of amenities. It even has a salon and Pilates studio at street level. "Pretty sure the rent's pretty up there," said Arthur Reynoso, walking by the building on Thursday. What most people don't know, however, is that 45 of the 224 condos in the building are affordable - to own. It's rare for one to come on the market, but a handful do each year. In fact, one is about to sell for 5,341, which is about 40 percent off the median condo price of 6,000 in North Park. The commission oversees about 250 for-sale affordable homes in San Diego - located in Carmel Valley, Black Mountain Ranch and North Park. Only four are for sale now, and Raman said all have been matched with buyers. However, they can list anytime. A homeowner can sell the property to anyone he or she wishes - so long as they are qualified - but the commission still maintains an interest list and is accepting applicants. Currently, there are about 275 households qualified for that list. The homes are not listed on the MLS. Still, there are restrictions when owning one of these units. Owners must live in them, and cannot rent out any part to supplement income. The commission checks that annually. Qualified buyers usually have 60 to 110 percent of area median income. The homes are deed-restricted for generally 45-50 years, meaning they have to be sold at an affordable price for that time span. SAN DIEGO (KGTV) - The coronavirus pandemic has put extra pressure and stress on families across San Diego. Now, experts worry that could be leading to a rise in child abuse."It's extraordinarily troubling," says Dr. Shalon Nienow, the Child Abuse Pediatrics Program's Clinical Director at Rady Children's Hospital's Chadwick Center."Since we started the pandemic, our volume has increased," Dr. Nienow says, noting that outpatient services are up 82% and inpatient treatment is up 75% since mid-March.Studies over the last decade have shown that economic struggles often lead to increases in child abuse. Nienow believes the Pandemic coupled with the economic downturn, has made it worse."People are isolated," Dr. Nienow says. "They don't have access to support services, and they're forced to take on roles they're not prepared for, such as being a teacher."The increased instances of child abuse and maltreatment may not be purely physical. San Diego County District Attorney Summer Stephan says her office has seen a dramatic increase in internet crimes against children during the pandemic. She says the amount has quadrupled since March."Kids are at home, they're on their tablets," Stephan explains. "On the internet, the predatory behavior of people trying to sexually exploit and recruit and get our kids to go into harm's way is really exploding... There is a direct correlation between kids being at home, out of school, out of their sports, and the increase of predatory and abusive crimes against them."Making matters worse, says Stephan and Dr. Nienow, is that the number of calls and reports of child abuse to Child Welfare Services has dropped dramatically since March.An ABC 10News Investigation in early April showed a nearly 60% drop in calls to CWS at the start of the pandemic. The county says now they're still seeing a 30% drop.In 2019, CWS fielded around 27,000 calls from April through August. In 2020, CWS took only approximately 19,000 calls."We certainly know families have more needs now than ever before and are struggling with all of the effects from the pandemic," says Dr. Kimberly Giardina, the Director of San Diego County Child Welfare Services.Experts believe the drop in calls is because kids are spending less time around teachers and doctors, who are legally required to report any signs of abuse they see."They tend to be a significant safety net for kids, and now that safety net is somewhat gone," says Dr. Nienow."Our teachers and counselors are the eyes and ears," adds Stephan. "They are the Safe Harbor."In their absence, the County and DA's office has launched training programs, which teach people how to recognize signs of abuse during online interactions like Zoom classes or telehealth visits. The county also authorized million in CARES Act funding to pay for community outreach and education.Stephan also sent a 7-page letter to Governor Gavin Newsom, detailing the scope of the problem. She asked him to take it into account when deciding whether or not to let schools reopen for in-person learning."I felt a responsibility that these alarming statistics become part of that conversation because the health of our kids and their safety has to be paramount," says Stephan.Dr. Giardina says Child Welfare Services is also working hard to make sure kids are safe. Their employees follow up on every call they receive and found ways to conduct in-person visits during the pandemic safely."We are out there," she says. "Our staff are working hard every day to make sure that those kids are safe."Experts all say it has become critical for parents, other family members, and neighbors to report any signs of abuse they see."Educate yourself," says Stephan. "Educate your children so that they can remain safe while we wait for our life to go back to normal and for kids to go back to school and to the safety of having those mandatory reporters.""It takes a village to raise healthy kids," says Dr. Nienow. SAN DIEGO (KGTV) -- The city is backing state legislation that would change when police can use lethal force. The bill would authorize officers to use deadly force only when it is necessary to prevent imminent and serious bodily injury or death. Currently, police can shoot to kill when an objectively reasonable officer would do the same.Democratic Assemblywoman Shirley Weber, who represents the South Bay, co-authored the legislation."The current standard hits communities of color especially hard," she said. "Young black men are 20 times as likely to be killed by police as their white peers." More than 100 people spoke in favor of the bill Tuesday as dozens of officers looked on.San Diego Police Chief David Nisleit called the bill well-intentioned but based on flawed data. He noted while officers killed 172 people in 2017 and only half had guns, more than 90 percent had other potentially lethal weapons. "Officers must make the best call they can with the information available to them at a critical time, and sometimes factors like human limitations in processing information will cause them to make decisions that turn out to be wrong," he said.
