SAN DIEGO (CNS) - A motorcyclist died Sunday in a head-on collision with a truck in the San Pasqual neighborhood, police said.The accident happened at 1:41 p.m. when a 65-year-old man riding a 2020 Harley Davidson motorcycle traveling east in the 18000 block of San Pasqual Valley Road crossed over the double yellow line and hit a 1997 Ford 250 driven by an 88-year-old man traveling west, according to Officer John Buttle of the San Diego Police Department.The motorcyclist died and the driver of the Ford and his passenger were taken to the hospital.Traffic Division is investigating the collision. 609

SAN DIEGO (CNS) -- A prominent local civil rights leader called on the San Diego County Sheriff's Department Monday to fire a deputy who allegedly shared a "lewd and racist and vile" altered photograph of George Floyd taken from the viral video of the Minnesota man's death in police custody.The doctored image showed a nude male "porn star" kneeling on Floyd in place of Minneapolis police Officer Derek Chauvin, who kept his knee on Floyd's neck for nearly nine minutes as the detainee repeatedly protested that he could not breathe, according to NAACP San Diego Branch President Francine Maxwell. Floyd died on Memorial Day.The words "quit resisting" also were added to the picture, Maxwell asserted in a prepared statement.RELATED: Sheriff's employee removed after reportedly sharing vulgar image"The image was lewd and racist and vile and should disturb anyone with a shred of human decency," Maxwell said. "Hours after being made aware of this incident, the employee was removed from his official duties and had his peace officer authority removed."In calling for the deputy's ouster, Maxwell also cited his shootings of suspects in 2005 and 2006, describing them as excessive and unjustifiable uses of lethal force. SAN DIEGO (CNS) - A regional stay-at-home order in effect in San Diego County and across Southern California due to surging COVID-19 hospitalizations is expected to be formally extended Tuesday, continuing a ban on all gatherings of people from different households and strict capacity limits at many businesses.The order, which covers an 11-county Southern California area, took effect at 11:59 p.m. Dec. 6 and was set to expire Monday. But with the region's intensive-care unit capacity at hospitals still effectively listed at 0%, Gov. Gavin Newsom said the order is all but certain to be extended."It is clear and understandable that it's likely those stay-at-home orders will be extended," Newsom said.A formal announcement had been expected Monday, but Newsom said the state was still compiling hospital and case data, and completing hospital-demand projections for the next four weeks."When we conceived of this framework, we are looking at projections four weeks out," he said. `We are looking at current case rates, positivity rates, looking at the community surveillance that we're doing and anticipating abased upon our modeling where that growth will be over a four-week period.He noted, however, that based upon large number of people who appeared to have ignored warnings against travel over the Christmas holiday -- and those who will likely so do over the upcoming New Year's holiday, the state is bracing for a "surge on top of a surge, arguably on top of, again, another surge."He said the official announcement on extending the order will be made Tuesday by Dr. Mark Ghaly, the state's Health and Human Services secretary.Newsom noted that COVID hospital admissions have begun to plateau across much of the state -- with the exception of Southern California, with Los Angeles, Riverside and San Bernardino counties continuing to be the hardest hit.Los Angeles County has rapidly become the epicenter of the pandemic in the state, with the state reporting more than 7,100 COVID-19 patients in hospitals, including more than 1,400 in intensive-care unit beds. Newsom said 96% of Los Angeles County hospitals diverted ambulances to other facilities at some point over the weekend due to overcrowding in emergency rooms -- up from a normal average of 33% of hospitals going on diversion.According to the governor, Los Angeles County hospitals on average spent 16 hours on diversion over the weekend, unable to find space for emergency patients.The Southern California region covers Los Angeles, Orange, Riverside, San Diego, Imperial, Inyo, Mono, San Bernardino, San Luis Obispo, Santa Barbara and Ventura counties. Restaurants are restricted to takeout and delivery service only. Hotels are allowed to open "for critical infrastructure support only," while churches would be restricted to outdoor only services. Entertainment production -- including professional sports -- would be allowed to continue without live audiences.Four of the five regions carved out by the state are under stay-at-home orders, covering 98% of the state's population. Only far northern California is not under a stay-at-home order.The order was triggered in each area when the region's ICU bed availability dropped below 15%. In some counties, the official ICU bed availability of 0%. That percentage does not mean that there aren't any ICU beds available, since the state adjusts the number based on the ratio of COVID- 19 patients being housed in the units.Newsom again had harsh words for counties and county officials who continue to "thumb your nose" at health orders. He singled out Riverside County, where Sheriff Chad Bianco has publicly criticized Newsom and said his agency would not be "blackmailed" into becoming an enforcement arm of state health officials.Newsom has said repeatedly that counties that don't adhere to health restrictions would lose state funding."We're in the midst of a pandemic," Newsom said. "I don't know what more evidence you need, particularly, as highlighted, Riverside County is experiencing what they're experiencing in ICUs and hospitals and lives lost. I mean, what more evidence do you need that trying to enforce good behavior will actually save lives? It's a noble and right thing to do. To dismiss as many have in the past and some of the same folks ... some still holding onto this as a hoax or face coverings don't matter. ... They're not helping. They're not advancing that cause, and so we will be assertive as we have been, we will be aggressive, as we have been."Bianco, in a video message posted online earlier this month, called state health mandates "flat-out ridiculous," while calling Newsom's stances hypocritical in light of his criticism of the federal government for withholding funds from states, and following Newsom's well-publicized attendance at a dinner party in spite of his own regulations against such gatherings.Bianco told residents in his message to wear a mask and practice social distancing, but said, "While the governor's office and the state has threatened action against violators, the Riverside County Sheriff's Department will not be blackmailed, bullied or used as muscle against Riverside County residents in the enforcement of the governor's orders." 5843

SAN DIEGO (CNS) - Former Navy SEAL Edward Gallagher, who was acquitted of murder and attempted murder charges last year stemming from allegations that he fatally stabbed a wounded teenage ISIS fighter and shot Iraqi civilians, is suing the Secretary of the Navy and a New York Times reporter, alleging the reporter defamed Gallagher with the help of Navy officials illegally leaking him documents.The suit accuses the Navy of leaking "about 500 pages of confidential documents from the Navy's criminal investigation" on Gallagher to reporter David Philipps, who extensively covered the allegations against Gallagher prior to and after his trial at Navy Base San Diego last year.The suit also names as a defendant Navy Secretary Kenneth J. Braithwaite, who was sworn in to his post Friday, the same day Gallagher's lawsuit was filed in San Diego federal court.Representatives of the Navy and New York Times could not immediately be reached for comment.Gallagher was acquitted in July of several serious charges related to the alleged slaying of a teenage boy, as well as allegations of firing indiscriminately on civilians from a sniper's nest, which could have had him facing life in prison. However, he was only convicted of posing with the teen's body in a photograph, resulting in a demotion in rank. President Donald Trump, who publicly supported Gallagher throughout the allegations, restored Gallagher's rank in November.According to the lawsuit, "corrupt Navy officials" conspired to defame Gallagher by leaking information to Philipps, who published several articles that Gallagher's attorneys allege presented false information to discredit the former SEAL.The complaint further alleges that Philipps wholly fabricated some allegations against Gallagher, including that Gallagher routinely fired on civilian neighborhoods and tried to run over a Navy Police officer in 2014.The suit alleges information leaked to Philipps included "witness interview summaries and seized text messages" from the criminal investigation and "a complete list of other SEALs that Chief Gallagher had deployed with on prior occasions" so that Philipps could contact them for his stories.Navy officials hoped "negative publicity would help to pressure Chief Gallagher into taking a plea, as well as to influence any potential jury pool," the complaint alleges."Navy officials presented David Philipps with a golden egg," the lawsuit alleges. "They would illegally provide him with certain protected documents, in clear violation of the Privacy Act and court orders, so that Philipps could write a damning portrayal of Chief Gallagher, with reckless disregard for the truth."The suit, which seeks unspecified damages, alleges Gallagher has suffered "significant mental and emotional anguish" through the Navy's "violations of the Privacy Act and unlawful disclosure of Chief Gallagher's private information to David Philipps."The lawsuit is not the first time Gallagher's attorneys have accused Navy officials of misconduct.Gallagher's defense team previously alleged Navy prosecutors used tracking software to spy on the email accounts of the defense and a Navy Times reporter covering the trial.The trial judge, Capt. Aaron Rugh, removed prosecutor Cmdr. Chris Czaplak from the case just before the trial was set to begin, ruling the prosecution sent emails to the defense and the Navy Times reporter that were embedded with code that would track the recipients' email activity.The findings led Rugh to order that Gallagher be released from custody due to violations of his Fourth and Sixth Amendment rights and that his maximum possible sentence of life without parole be reduced to life with the possibility of parole. 3715
