SAN DIEGO (KGTV) - The target at the center of a murder for hire plot is suing his former business partner and his associates. Ninus Malan says, he suffers from severe emotional distress as a result of his business partners actions."I wish this would go away, but I wake up every morning, and it's there," Malan told 10News. In November, federal authorities charged Salam Razuki, Sylvia Gonzales and Elizabeth Juarez with offenses related to a conspiracy to kidnap and kill a business associate over a dispute involving real estate investment properties, most of which were leased to marijuana dispensaries.   According to a complaint filed on November 2018, in October of that year, Salam Razuki and Sylvia Gonzales met with a Confidential Human Source and asked the source to arrange to kill Malan. The complaint says according to Razuki and Gonzales, they had invested in multiple properties and business ventures together and were not involved in a civil dispute over their assets. The complaint alleges, "Razuki and Gonzales told CHS1 (confidential human source) that they wanted CHS1 to 'Shoot him in the face,' 'to take him to Mexico and have him whacked,' 'or kill him in some other way.'"Federal authorities say Elizabeth Juarez later joined Razuki and Gonzales, and the three talked about having Malan killed.The complaint says the confidential human source, Gonzales, and Juarez discussed a cost of ,000 for "the job." Federal authorities say during one of the meetings, Gonzales went to the Goldn Bloom Dispensary and returned with ,000 cash. "After the meeting, CHS1 provided agents with ,000 case provided by Gonzales," the complaint says.Federal authorities say, "according to the complaint, on November 15, 2018, the source met with Razuki and stated, 'I took care of it.'" Razuki replied, "So he will take care of it, or it's done?" The source replied, "Done." Malan told Team 10 investigator Adam Racusin that he's now forced to live his life day by day afraid for his family's safety. "My nine-year-old daughter had to see this on the news, and she knows all about it," Malan said. "I don't know how to explain it to her." Malan is suing Razuki, Gonzales, Juarez and a handful of businesses. The lawsuit alleges, interference with exercise of civil rights, unfair competition, intentional infliction of emotional distress and negligence. The lawsuit says the "defendants committed the acts herein despicably, maliciously, and oppressively, with the wrongful intention of injuring plaintiff, from an improper and evil motive amounting to malice, and with the conscious disregard of the rights and safety of Plaintiff and others." "Mr. Malan and Mr. Razuki were involved in a number of businesses together," said Malan's attorney John Gomez of Gomez Trial Attorneys. "That relationship kind of fell apart, so litigation commenced." Gomez says Razuki brought a civil suit against Malan and Malan filed a lawsuit against Razuki. "That's a big litigation involving a lot of money," Gomez said. "Mr. Razuki apparently thought it was ok to put a hit on Mr. Malan to eliminate him from the litigation." Gomez told 10News all the businesses and entities named in the lawsuit are affiliated with Razuki and participants in the litigation. "When he puts a hit on Mr. Malan to advance the litigation he's doing it on behalf of all of these businesses and people," Gomez said. With a criminal case underway, Malan was limited in what he was willing to discuss. He thanked the FBI, his family and told Team 10 investigator Adam Racusin he'll always be looking over his shoulder. "In the courts is where I'm seeking justice, not only for me but for my family who were terrorized by these people," Malan said. Criminal defense attorneys for Gonzales and Juarez have not yet responded to 10News requests for comment.Razuki's attorneys told 10News they have no comment. 4194

SAN DIEGO (KGTV) -- Thousands of people spent their final day of the holiday weekend at San Diego beaches, just as the Beach Hazards Warning expired. Mother of two, Shannon Crais spent the day at Ocean Beach Sunday. "We live a couple of blocks away, so we come down here a couple of times a week."Her daughter Sam likes to play tag with the waves, as they ripple towards her older brother Alex. The Ocean Beach residents say they know the potential dangers of their favorite play area. "I talk to my son about it because he is a little bit bigger," Craig said. "But my daughter, she stays close. We talk about the ocean being dangerous."Sunday afternoon, the National Weather Service dropped the Beach Hazards Warning for all of San Diego County. But all weekend, beachgoers faced strong rip currents and high breaking waves. This was a point of concern for some, but great news for surfers like Jesus Rodriguez. "I think the hurricane is bringing the swell from down south and it has been awesome!" Rodriguez said. Rodriguez says the waves were much better this long holiday weekend thanks to the high surf advisory. They were so good that he had to share the waves with a lot more people than usual. That is why he was doing two-a-day sessions over the last few days. "You get a lot better waves and a lot better form on the wave, so you can start ripping them up," Rodriguez said. Craig also appreciates the beautiful, ridable waves. As a mother, wants her kids to be safe, but she is not totally against having her children learn about the water on their own."If you get wiped out a couple of times, you gain a little bit more respect for the ocean," Craig laughed. 1678

SAN DIEGO (KGTV) - The USS Midway Museum is celebrating 15 years in San Diego with a ticket discount offer for area residents. The deal announced Tuesday is rolling back admission to 2004 prices during the month of September. Tickets are for adults and seniors, and for youth and students. “Midway would not be the 5th most-popular American museum of any type (35,000 museums) if it were not for the nearly 800 San Diegans who donate more than 275,000 hours annually,” said founding president and CEO Mac McLaughlin. “They are the rock stars of Midway and the foundation of its success.” September marks the 74th anniversary of the USS Midway’s commissioning. The retired aircraft carrier opened as a museum in June 2004 after a 12-year campaign. The ship has been host to special events including an SDSU basketball game, an NFL pregame show, and episodes of The Bachelor and American Idol. The Midway is the most-visited ship museum in the world and the top-rated San Diego activity according to TripAdvisor, the museum reports. SAN DIEGO (KGTV) — The remains of a Kansas Marine who fought in World War II have been identified.U.S. Marines Corps Reserve Pfc. Raymond Warren was killed in 1943 during the Battle of Tarawa, according to the Associated Press. After his burial site was discovered in 2015, his nephew, Warren Cooper, of San Diego, and niece submitted mouth swaps for DNA testing, The Wichita Eagle reported.This month, the Defense POW/MIA Accounting Agency announced Warren's remains were identified in part through DNA analysis.RELATED: Veterans honor 75th anniversary of Battle of Iwo JimaWarren was awarded the Silver Star after his death and is eligible to be buried at Arlington National Cemetery with full military honors.“We figured that enormity of the sacrifice and the great honor it is to be buried at Arlington tipped that in the (direction) of him being buried there,” Cooper told the AP.According to the agency, Warren was part of Company K, 3rd Battalion, 8th Marine Regiment, 2nd Marine Division, Fleet Marine Force, where they faced Japanese troops on the island of Betio in the Gilbert Islands region. About 1,000 sailors and Marines and nearly all of the Japanese troops involved in the battle were killed.Warren was killed between the first and second day of fighting at Tarawa, the agency says. 1307
