NEW ROCHELLE, NY — Gigi Martinez held tight to her daughter, sobbing in the doorway of the Dumont Rehabilitation Center in New Rochelle Thursday.It was the first time the 60-year-old mother and grandmother from Yonkers was seeing her family in the outside world since March 28 — four months ago — when she landed in Lawrence Hospital with COVID-19."This is a miracle," Martinez said.By early April, Martinez was intubated and put on a ventilator. She remained on the breathing machine for three months, even when she was transferred to Dumont at the beginning of July.After three days on the ventilator, Martinez said doctors were delivering a scary prognosis to her three daughters."Three doctors told them to 'let me go,' but they kept fighting for me," Martinez said.Many COVID-19 patients don't survive after being placed on a ventilator. Patients usually average just three weeks on the machines — far less than Martinez's three months.Martinez developed kidney failure, sepsis and heart failure along the way."The doctors gave her zero chances and told us to 'make arrangements,'" said Milagros Rivera, one of Martinez's three daughters. "I never thought I'd lose my mom to this. We're a prayerful family. We FaceTimed every night and prayed with her."Martinez was weaned off the ventilator in early July and looked frail as she was wheeled out of Dumont on Thursday."I'm a little bit tired, but I'm blessed and so thankful," Martinez said.Because she suffered kidney failure, doctors told Martinez's family that she would likely need to undergo dialysis treatments for the rest of her life. But Rivera says her mother is not currently on any machines to assist with daily functions."I think she was given another opportunity at life," she said.Rivera recounted how her mother, who was born in Puerto Rico, had turned 60 this past February."She was very young and active with an amazing personality," Rivera said.Martinez had been working as an administrator at a transitional housing program for homeless people when she got sick.Following her return home, Martinez extended family gathered at her Yonkers apartment."We ate all together," Martinez said.Rivera called her mother a "true warrior."When Martinez was asked what she wants to do when she gets a bit stronger, she didn't hesitate."When I get better, I'll go to my church," she said.This story was originally published by Mary Murphy on WPIX in New York. 2428

Northwestern University in the Chicago suburb of Evanston was under a lockdown order for nearly an hour after reports came in Wednesday afternoon of a person on campus with a gun and shots fired. It turns out that the whole incident was a hoax. According to ABC News, an Evanston Police official said that the report was a swatting incident. The emergency call to police claiming there was a gunman on Northwestern's campus came from out of state.  Swatting pranks have been taking place in recent years involving a call to police prompting a SWAT unit to respond to a person's home. The prank sometimes end up being deadly. In December, a 28-year-old Kansas man was shot and killed by police after a prankster claimed the man was holding his family hostage after shooting his father. When police arrived, the man reached for a waistband, causing police to kill the man. It turns out he was unarmed, and the call came from 1,400 miles away. Northwestern University originally reported that a person with a gun was located near Engelhart Hall. Evanston Police said that several streets nearby were closed. After an initial search, Evanston Police said they could not find any victims, gunmen or crime scene. Students and employees were being told to seek shelter around 2:40 p.m. local time. An hour after the initial lockdown order, Northwestern said that only those in Englehart Hall remained in shelter. An all clear was given shortly after 4 p.m. local time.  1540

NEW YORK CITY — Defense attorneys are not only calling for two NYPD officers to be fired after body camera video showed them beating a man, shoving him to the ground and macing him, but lawyers are also calling for one of the officers to be charged with felony assault.The video, recorded on May 25, was released on Wednesday.Edda Ness is a Legal Aid Society attorney assigned to represent the man."It's unjustifiable what they did," Ness said. "They should have been fired immediately. This case should've never been prosecuted."Police confronted 30-year-old Joseph Troiano for taking up more than one seat in the mostly empty subway car, a crime that hasn't been prosecuted by Manhattan District Attorney Cy Vance's office since 2016.Troiano was charged by police with resisting arrest and other misdemeanor charges. But the district attorney's office added a felony assault charge after Vance's office determined that Troiano had injured one officer's hand in the encounter. That charge was when the video of the incident surfaced."After a thorough investigation, our prosecutor intended to offer the individual an Adjournment in Contemplation of Dismissal at his next court appearance," a spokesperson from Vance's office said in an e-mailed statement. "The District Attorney was provided with the available footage last night and determined that our office will advance the case for this purpose, dismiss the assault charge, and offer an adjournment in contemplation of dismissal for the remaining misdemeanor charge."The Legal Aid Society called for the officers' dismissal by name."[We're] calling for the two officers, Shimul Saha and Adonis Long, to be immediately fired," Ness said.Officers Adonis Long and Shimul Saha confronted Troiano around 12:30 a.m. on May 25. After Troiano was told to leave the train, he moved to another subway car. Police followed him."Step off the train," one of the officers said in the video. "You're holding up the train for everybody. Step off or I gotta drag you off."Troiano asked them how he was holding up the train, and he refused to get off. When Long reached out for Troiano's arm, the subway rider pushed Long's hand away."Don't touch me," Troiano said. "Don't touch me. Get off of me."Long then repeatedly punched Troiano in the face. The first punch caused Troiano's eyeglasses to fly off his face. Long and Saha pulled Toriano from the subway car, and he was thrown to the ground in the station.One officer pulled Troiano over to a wall while the other kicked his belongings off the train. Police told him to sit down, and then pepper-sprayed him in the face when he didn't immediately comply.Toriano turned to the wall and covered his eyes; he cried and took a few steps away from police, then fell to the ground where he continued to cry. Officers made him stand, but then told him again to get on the floor."Help me," Troiano said as he got down on the ground.Video shows that Troiano, face bloodied, struggled with police while on the floor. Officers pulled at his hair and held a hand on his neck. One of Troiano's shoes came off. He asked to be allowed to stand up."I'm having a panic attack, please," he said. "I'm sorry. Please, guys, you're killing me."Troiano was taken to a local hospital on a stretcher. He was charged by police with resisting arrest, obstruction of governmental administration and taking up more than one seat on the subway.Walter Signorelli, a retired NYPD inspector who's now an attorney who represents clients suing police, pointed out that Troiano first disobeyed an order from the officers, after which Long struck."It's always difficult to second guess an officer," Signorelli said. "The officer might have [first] said, 'You're under arrest,' which would have made everything clearer and more legal."Legal Aid is calling for prosecutors to charge Long with felony assault. Nine-year-old Jacob Thompson is your average kid. His obsessions include Minecraft and Legos, and he's a huge "Star Wars" fan.He's also a photographer, singer and comedian, according to his stepmother, Tara Artinyan. And most of all, he really, really loves penguins.But Jacob has Stage 4 high-risk neuroblastoma, and doctors told his family in early October he probably only had a month to live.So they'll celebrate Christmas early this year, and Jacob wants people to celebrate with him by sending him cards, his mother, Michelle Simard told CNN."He got some cards from this Halloween, and he opened up and saw them and it was like getting a gift. He read it to us and had a big smile his face and his nose scrunched," Jacob's father, Roger Guay, told CNN in a phone interview. "He was excited to see what people had to say and it just brightened his day."Fighting a long battleJacob was diagnosed with high-risk neuroblastoma when he was 5. According to the American Cancer Society, only half of children diagnosed with the disease reach the five-year survival mark.After Jacob was admitted to the Barbara Bush Children's Hospital on October 11, doctors discovered that the neuroblastoma had spread to his head and was incurable, according to a GoFundMe page set up by his mother."People have called him an old soul and I believe it because he has taught us so much about life and about people," said Guay. "He's accomplished everything that he needed to do by 9 years old, and a lot of people don't accomplish that, ever."An early ChristmasArtinyan said the family decided to "fast-forward" Christmas to give Jacob one last celebration.And for him, that means a lot of snow, a decked-out tree, and of course, a real-life Santa Claus.But before his improvised Christmas celebration takes place in early November, Jacob asked for cards from anyone around the world who wanted to share his Christmas spirit.And only five days after he announced his wish, he has already received more than 100 cards from people all over the country -- and even beyond."We got over a hundred, and they're from all over the world. We have some from the Netherlands, from Australia, from Denmark," said Artinyan. "We've heard from all over the world at this point. NORTH READING, Mass. – An off-duty police officer in Massachusetts is being credited with saving three people from an early morning house fire on Tuesday.The North Reading Police Department says Sgt. Thomas Encarnacao had just finished his shift and was on his way home when he noticed flames emerging from inside the home.After alerting dispatch of the fire, Encarnacao entered the home to alert the residents. He was able to locate a man sleeping on a coach at the front of the house and helped him outside to safety, according to police.The man told Encarnacao and other officers who had arrived to help that there were two more residents in the home, a 13-year-old boy sleeping in a back bedroom and a man in the basement of the home.The man in the basement was able to get out on his own after officers alerted him, but police say first responders had to pull the boy out through a window of a smoke-filled room.All three residents were evaluated by EMS at the scene and didn’t go to the hospital. No firefighters were injured. One officer suffered a cut to his hand while attempting to breach a basement window.Firefighters were able to put the blaze out, but the house ended up sustaining smoke, fire and water damage. Police say the residents were displaced and are being assisted by family members.The origin and cause of the fire is under investigation.“The work of the three officers this morning was truly courageous, and I am incredibly proud of them,” said Police Chief Michael Murphy. “Sgt. Encarnacao took decisive and immediate action, which very likely saved the lives of the residents inside the house. Once he got the first resident out, all three officers went back into the house, without protective gear, to look for additional residents. Their actions to get all of the residents out safely was truly heroic.” 1841
