EL CAJON, Calif. (KGTV) - The grieving mother of an accused thief filed a lawsuit Thursday against the homeowner who shot and killed her son.The civil suit identifies the homeowner as Michael Poe, and it stems from an incident in the early morning hours of March 11. Police say the homeowner woke up to the sound of glass breaking. He went outside and found someone breaking into his work truck. He told police there was a confrontation and he shot the thief.RELATED: Confrontation between?homeowner, suspected thief ends in deadly El Cajon shootingJoseph Mercurio was man killed. His mother Monika Anderson says Joe had a drug problem but was doing his best to stay sober.“He was on Suboxone, a drug to stay sober, and someone had stolen his Suboxone,” Anderson said. “Although it's really hard for me to imagine my son at  31 years of age would just start stealing, but I think he was just desperate for drugs and in a lot of pain. I don’t think he deserved to die over that.”Police are investigating the incident and no criminal charges have been filed. Anderson’s attorney, Dan Gilleon, says that investigation should not affect their civil lawsuit.“The bottom line is Joe shouldn't have died and at a minimum its because this guy didn’t act reasonably,” Gilleon said. “This is not the Wild West. If you decide to play that gunslinger role, then you’re going to end up losing everything you own.”The lawsuit does not specify an amount.“It’s like a mother’s worst nightmare,” Anderson said in tears. “I told Joe, time and time again how much he meant to me.”10News has tried to make contact with Poe several times since the shooting happened, but have not heard back.   1715

EL CAJON, Calif. (KGTV) --  A woman was hit and killed by a vehicle Tuesday night in El Cajon. The crash happened on the 600 block of Greenfield Drive near Magnolia Elementary School around 5:15 p.m.Police say it appears that the woman was walking westbound on the south sidewalk of Greenfield Drive when a blue 2004 Chevrolet Suburban was traveling westbound on Greenfield Drive and veered across the eastbound lanes and left the roadway, hitting her.Paramedics administered CPR and transported the woman to the hospital where she later succumbed to her injuries. The name of the woman has not yet been released. She is believed to be in her 40's. The male driver of the Suburban, a 49-year-old resident of El Cajon, remained on scene and has been fully cooperative with the investigation, according to police. It is unknown at this time if drugs or alcohol were a factor in the collision.The El Cajon Police Department is asking anyone with information regarding this collision to call (619) 579-3311. 1046

EL CAJON, Calif. (KGTV) - A man fatally stabbed inside an East County condominium has been identified as an active-duty service member.Anderson Lopes, 24, was found unresponsive at his El Cajon condo just after 10:30 p.m. on March 6, according to the San Diego Sheriff's Department. Lopes's wife said her husband was injured in an assault inside the home in the 13000 block of Pinkard Way.Lopes was treated at the scene and brought to a nearby hospital, but died from his injuries. His wife, who said she was trying to break up the fight, was stabbed in the thigh and underwent surgery.RELATED: Suspect arrested in El Cajon stabbing deathSDSO said Lopes was an active-duty service member in the U.S. Navy.Deputies detained Dylan Poston, 26, at the scene. Poston has been charged with one count of murder and is being held without bail at San Diego County Jail.It's not clear what led to the reported altercation.The murder is still under investigation. (KGTV) -- Neighbors in the El Cajon area have a warning: Beware innocent-looking boys.Around 10 p.m., the doorbell rang at Steve Banner's home in the Horizon Hills. "I opened the door, and I saw looking down that it was a little boy, holding a flashlight," said Banner, noting the boy looked around 10-years-old. "He told me he was looking for a friend named William Endo or Indo," said Banner. 424

  

EDINBURG, Texas - A bizarre incident during a high school playoff game in Texas on Thursday left a referee with injuries after being attacked by a player he had just ejected.Edinburg High School defensive end Emmanuel Duron was penalized for shoving another player to the ground and attempting to tackle the opposing team's quarterback after a play was over The Monitor reports.Referee Fred Garcia ejected Duron from the game for the two unsportsmanlike penalties.After Garcia announced the ejection, Duron charged back onto the field and slammed into the referee, causing him to fly back into the artificial turf.Duron's teammates and coaches held the player back while crews attended to Garcia. Four off-duty police officers escorted Duron out of the stadium and away from the premises.Garcia was able to walk off the field on his own and was evaluated in an ambulance outside the stadium. He was reported to have suffered a concussion and a shoulder injury.After the delay, the game resumed and Edinburg ended up defeating Pharr-San Juan-Alamo 35-21 to advance to the playoffs, The Associated Press reported. But on Friday, the team was removed from the playoffs by the school district, the district announced in a statement."The district has decided to remove the Edinburg High School football team from the playoffs after an unexpected incident involving a student that occurred during a football game on December 3, 2020," the district said. "We extend a sincere apology to the referee and his family. On behalf of the Edinburg CISD Board of Trustees and administration, we apologize to the athletes, staff, and our school community. We will take the appropriate disciplinary action once we understand the facts and circumstances underlining this incident. The district takes these matters very seriously; however, we cannot comment further on a pending investigation."Duron was charged Friday with assault and is being held in jail on a ,000 bond.The Monitor reports Duron was suspended from the school's soccer team for a similar incident last season.This story was first reported by Jeff Tavss at KSTU in Salt Lake City, Utah. 2146
