LOS ANGELES (AP) — The pork industry is challenging the constitutionality of a voter-approved California measure that will prohibit the sale of meat products from hogs born to sows confined in spaces that don’t meet new minimum size requirements.A lawsuit filed late Thursday in San Diego federal court by the National Pork Producers Council and the American Farm Bureau Federation targets Proposition 12, which voters overwhelmingly passed a year ago and goes into effect in 2022.“Proposition 12 has thrown a giant wrench into the workings of the interstate market in pork,” the filing states.The measure bans the sale in California of pork and veal from farm animals raised in conditions that don’t meet its standards. It also requires that all eggs sold in the state come from cage-free hens.The rules will apply to pork products coming to California from farmers nationwide, not just from in-state farms. The industry lawsuit contends that extraterritorial reach intrudes on authority given to Congress.”Plaintiffs seek a declaration that Proposition 12’s requirements with regard to breeding pigs violate the Commerce Clause and principles of interstate federalism embodied in the U.S. Constitution, and an injunction against the enforcement of Proposition 12’s requirements concerning pork,” the lawsuit states.The ballot measure, dubbed the Prevention of Cruelty to Farm Animals Act, was sponsored and financed by the Humane Society of the United States.The lawsuit was termed “frivolous” in a statement from Jonathan Lovvorn, the Humane Society’s senior vice president for animal protection litigation.“It’s an industry out-of-step with the preponderance of consumers who find animal abuse unacceptable, yet is still trying to hold on to archaic practices — like those banned by Prop 12 — that inflict an immense amount of pain and suffering on animals,” he said.Proposition 12′s requirements include giving breeding pigs at least 24 square feet (2.2 square meters) of floor space in group pens.It also bars the use of individual stalls that do not meet “stand-up, turn-around” requirements, except during brief periods prior to farrowing and during weaning.The lawsuit states that the measure’s requirements “are inconsistent with industry practices and standards, generations of producer experience, scientific research, and the standards set by other states.”It also imposes “enormous costs” on pork producers that will ultimately increase costs for consumers, it says.Before the election, the nonpartisan state Legislative Analyst’s Office said Proposition 12 would likely result in an increase in prices for eggs, pork and veal partly because farmers would have to remodel or build new housing for animals.It could also cost the state as much as million a year to enforce and millions of dollars more a year in lost tax revenues from farm businesses that choose to stop or reduce production because of higher costs, the office said.According to 2017 U.S. Department of Agriculture data cited in the lawsuit, nearly 65,000 farms nationwide sold hogs that year with a market value of more than billion. Pigs are raised nationwide, but production is concentrated in the Midwest and North Carolina.California’s pork consumption accounts for about 13 percent of the national market. But the state has only about 1,500 commercial breeding sows and needs the offspring of about 673,000 sows to satisfy its residents’ annual demand for pork meat, the lawsuit states. 3487

LOS ANGELES (CNS) - Los Angeles City Councilman Mitch O'Farrell and the city's Bureau of Sanitation will remind all restaurant managers that starting Tuesday they will be required to withhold plastic straws unless a customer requests them. ``The new city law picks up where the state law stops,'' O'Farrell said in April. ``As a coastal city and state, we owe it to our environment to do everything in our power to ensure we reduce single-use plastic waste.'' The first phase of O'Farrell's ``Straws on Request'' initiative took effect this year on Earth Day, which applied to businesses with more than 26 employees. The new law takes aim at reducing single-use plastic waste from littering beaches and waterways, O'Farrell said, and it applies to restaurants of all sizes. O'Farrell plans to speak this morning at a news conference with various city officials and local restaurant owners. Both the state and county recently adopted a single-use plastic straw policy, but O'Farrell said Los Angeles' law is more restrictive. In drive-thru restaurants, the customer will be notified to ask for a straw if one is needed. O'Farrell cited a report from the nonprofit Lonely Whale's campaign called Strawless Ocean, which stated Americans throw away 500 million plastic straws each day. Worldwide, plastic straws are among the top 10 marine debris items, according to the environmental advocacy group. 1404

  

LONG ISLAND, N.Y. — A helicopter crashed offshore near Jones Inlet Wednesday afternoon, according to the U.S. Coast Guard.Officials said the pilot, a 64-year-old man, appeared to be attempting a controlled descent at Meadow Island at around 4:15 p.m. Wednesday. The chopper landed in an area with about three feet of water.Rescue crews from the Coast Guard and several other local agencies responded. The pilot was rescued from the aircraft and taken to a local hospital with minor injuries, including a facial laceration and back and rib pain. He was the only one on board.There was also some damage to the helicopter.Chief Petty Officer David Turner of the U.S. Coast Guard said he did not know the cause of the crash, nor did he know details of the flight plan.There was very thick fog in the area Wednesday, and while Turner did not know if it was a contributing factor to the landing, he said it's difficult to operate in those conditions.Visibility was only a half-mile in the area at the time of the incident with misty conditions in the area."I kept on hearing this helicopter, circling and circling, and after a couple of circles, it didn't sound right to me," said Damian Walsh the man who helped rescue the pilot and took video of the immediate aftermath.Walsh was out on his boat when he says a thick fog quickly rolled in around 4:30 p.m. Wednesday afternoon."It turned pretty quickly probably had about 20 yards of visibility," he said.He and another boater rushed to the scene after hearing a loud splash.One coast guard officer told Walsh that the pilot fell 1,000 feet in three seconds.The helicopter fell into shallow water."He was lucky; if he fell 50 yards over, he wouldn't have survived," Walsh said. "I got him on the boat; I called his wife, let her know he was alight."Walsh said he and a couple of other Good Samaritans got him over to rescuers."They wouldn't have found him in that fog. LONG BEACH, Calif. (KGTV) -- Cell phone video that surfaced Monday shows good Samaritans rescuing passengers from a sinking car.The rescue happened in Long Beach after the car accidentally crashed through the railing, slamming into the water.Inside the car at the time of the crash were a woman, her son and a dog. All the passengers made it out safely thanks to the heroic actions. 390
