LARGO, Fla. — The family of Linus Phillip, a man killed by a Largo Police officer in Florida on Friday, is accusing detectives of using the dead man's finger to gain access to his cell phone.On Friday, police approached Phillip's car at a WaWa gas station in Clearwater. Police said the vehicle he was driving had illegally tinted windows. While standing near Phillip's car, the officers claim they smelled the odor of marijuana coming from the vehicle. Police claim Phillip tried to drive away and use his car as a deadly weapon. One officer, Matthew Steiner, says he was dragged by the car when he tried to open the door and feared for his life.Phillip was shot and killed by police. He did not have a gun in his possession. Steiner, a seven year veteran with no disciplinary action against him, was injured during the incident but is OK.Phillip's family is demanding surveillance video from the incident at the WaWa gas station in Clearwater where he was killed. Police claim the encounter was not caught on video, only officers giving Phillip CPR.The family lawyer, John Trevena was surprised."There was no denial of the video to the family so this is the first I've heard of that," said Trevena.The family also claims that detectives used Phillip's lifeless finger to access his phone at the Sylvan Abbey Funeral Home."So they are allowed to pull him out of the refrigerator and use a dead mans finger to get to his phone. Its disgusting," said Armstrong.Police did not comment on the allegations, citing that there is a still an active investigation into the case.Phillip's mother, Martha Hicks started crying during an interview on Wednesday."They killed him after his 30th birthday. Oh god, he turned 30 on March 11," Hicks said. "It's too much too much we just want to know what happened."The couple has two children together. Their young daughter lost her battle with leukemia last year.Their son, Isaac is 16 months old."My son is no longer going to go have a father, or to make his dad proud. He's not here anymore because of this and the police are slandering his name like some awful person," said Armstrong. "We are fighting to find out what happened." 2240

LAKELAND, Fla. — An 85-year-old man was bitten by an alligator at a retirement community Monday afternoon, FWC says.Officials say the alligator was 9-feet-9-inches and trappers pulled it out of a pond Monday afternoon.It happened at the Cypress Lakes Retirement Community.The man was reportedly bitten on the foot and taken to Lakeland Regional Medical Center where the extent of his injuries are not known at this time.The community posted on its Facebook page about the incident and reminded residents about safety around alligators.Jane Rickel lives here and says trappers found the man’s white sneaker in the gator’s mouth confirming they got the right one.“His wife heard him screaming supposedly. LAKESIDE, Calif. (KGTV) - Divers searched the San Vicente Reservoir Saturday for a missing 12-year-old girl, San Diego County Sheriff’s Department and San Diego Police said.The girl fell off a ski-type boat and into the water Saturday afternoon while with her family, officials said.The search started at 6 p.m. Saturday with seven divers from San Diego Fire-Rescue. The team later found the girl’s damaged life jacket in the water.By Saturday evening, the search was designated a recovery mission instead of a rescue. Divers stopped the search as night fell.The reservoir is 306 feet deep when full. It is a popular recreation spot for boating and fishing. No swimming is permitted unless it is related to water activities including water-skiing and wake boarding.The San Vicente Reservoir will be closed Sunday, according to officials. The dive team will resume recovery work at dawn with the help of sonar technology.The girl's identity was not released. 965

  

LA MESA, Calif. (KGTV) -- The man caught on video being arrested outside a La Mesa trolley stop has filed a lawsuit against the City of La Mesa.The lawsuit was filed by Amaurie Johnson against the City of La Mesa, Matt Dages, and six John Does.The lawsuit alleges arrest without a probable cause, negligence, excessive force, and violence because of race.The suit comes after viral video showed Johnson’s controversial arrest outside a La Mesa trolley stop in June. In the video, an officer is seen pushing Johnson into a sitting position on a bench. Eventually, Johnson is handcuffed and told he is being arrested for assaulting an officer.RELATED: VIDEO: Incident between La Mesa officer, man at trolley station surfacesLa Mesa demonstration highlights several anti-police brutality ralliesThe La Mesa Police Department announced later in June that it had dropped charges against Johnson.“After a full review of all of the evidence in the criminal investigation" against Johnson, the police department will not seek prosecution "on any of the alleged misdemeanor charges,” La Mesa Chief of Police Walt Vasquez said."We do believe that the officer should be investigated for potential criminal liability, but there is also a civil aspect to this. Mr. Johnson and I are discussing our options as far as moving forward with a complaint with the city of la mesa and potentially taking this to state or federal court," Johnson's attorney Troy Owens said in a previous news release. Troy Owens, Johnson's attorney, told ABC 10News, "Mr. Johnson does not feel that his situation or his experience is unique. And we're seeing a pattern of behavior specifically coming from the City of La Mesa and the La Mesa police department, and that is upsetting to everyone."Owens added, "The City of La Mesa pledged transparency and pledged accountability, and we are seeing the exact opposite of that. We're seeing closed investigations. We're seeing no action being taken we're not being given any information, and it's upsetting ... It appears as though law enforcement in the City of La Mesa is not calming down, it appears as though they escalated instead of de-escalating situations, and that is concerning.""We're being given the runaround, and we're tired of that.
